@@roberth4727 I think he's saying IF you talk to the police. Some folks are good at communication, good at de-escalation, and know how to have an interaction with the police. Now, yes, you can get some cop who is hyped up and it's useless trying to have an actual conversation with them - he's saying if you're not going to talk to them, to affirmatively inform them (politely) that you are exercising your rights.

Steven Cav I disagree. He said it wouldn’t look good in court if you remain silent. While the Supreme Court has said not to talk to the police because they will use anything against you. Thank you for your service. I am a current med student non traditional prior military as well. Thought about being a lawyer but thought again lol

This video upset me, why the fuck cant I arrest the cops involved? Why do police play by different rules when they clearly know little to nothing more than the average person about the laws they think they're enforcing, only how to best go about "enforcing" them and not getting hurt? Its absolutely ridiculous. If I held someone against their will for hurting my feelings I would be a kidnapper and get charged with a slew of felonies, but cops do it and get a stern talking to by one of their buddies then go on with their day.

Sure, he's a scrawny little lad, but it's people doing this auditing that has brought about the necessary need for the Police forces across the world to finally address the issue of egotistical narcissists using it as a platform to gain authority. Kid might not be from a very wealthy family and therefore not be well fed, not his fault.

When officer's say "Where'd you get your law degree?" they've lost the argument and they are simply being unprofessional. You don't need a law degree to understand your rights as a citizen and it's sad that so many officer's don't know the laws they swore to uphold.

This is what bothers me about so many auditors. They often can and do things that are well within their rights. I have no problem with that but it seems that so many auditors go out of their way to act like human hemorrhoids.

As do a very high percentage of police officers. That's why these auditors are out there. Cops are supposed to be trained professionals, yet they are usually the ones who get overly emotional during these interactions. Short-tempered cops should lose their jobs on the spot. They have no business in that job

I watch this channel a bit every day with my kids as part of their schooling. I call it civil rights and public knowledge. Very educational, necessary discussion here, I believe this should be shown as part of every standard school curriculum, as well as to every PD. It would save lives.

@@buster7345 The officer was ready to arrest him for disorderly conduct, not his refusing to comply with orders. Since there was no disorderly conduct from the recording, and recording from the street is entirely legal, this was an easy answer: no charges. Just because someone doesn't like something does not mean you should be arrested for it. If so, then a cop could arrest you if I called them since I can claim that I am offended by the moniker "Buster".

It’s amazing how many officers aren’t taught simple laws and rights. In the academy and as per apartment policy they should be forced to be made aware before put on duty

There is an incentive to NOT teach patrol officers the law. If the officer believes they are acting in good faith not only are they immune from reprisal but often their actions (illegal searches, for example) can be upheld. For that reason LE agencies have less reason to teach the law than to not.

@teflontelefon I always find it funny that second amendment auditors will always say "I'm out hear practicing my second ammendment right" or something to that effect. However, these public recording videos you never hear them say "I'm practicing my first amendment right." That would literally take care of their problem if they go to court, and open the city up to a nice lawsuit.

I just think these public recording should know they are practing a protected first amendment activity and thus when cops ask what they're doing just respond with "engaging in my first amendment right." But they never say something like that. If they did, it could nip a lot of problems in the butt, either right there or in court. Just a strange observation I've made after watching these and open carry videos.

@@j12mkx1 I agree. I'm sure we'd also agree even *that* wouldn't even be respected a meaningful amount of times. But really, that kind of makes the argument to say "I'm out exercising my 2A rights"....because those are being less respected. The whole point of these audits is to educate the public and the interacting LEO about the rights we have, not to necessarily stay out of jail or out of a courtroom. That possibility is kind of the risk you take when you're demonstrating under practiced protected activity.

Mr. Smith, I respectfully disagree. As a licensed mental health clinician, I can, and do, determine an individual's mental state. As a licensed clinician, I can make the judgment, based upon my education, experience, and state licensure with regard to a mental health crisis. I have the authority to place a person in mental health crisis (A danger to them self, or others) on a psychiatric hold in a behavioral health unit. This is a serious responsibility and every engagement is challenging. The authority granted by the State of California to take away a persons freedom is very serious. If I make the wrong decision someone could die.

The person commenting is talking about a citizen calling the cops and then an officer taking the improper procedure to assume someones mental health WITHOUT a mental health examination and arresting them just because some citizen says they have NO IDEA what the status of this individuals mental health is. You realize how this makes you look right? I really hope there are less and less people in your field that get licensed that have no business doing so. Imagine me coming into your place of business and pointing at you and then telling the officer I have no idea what this guys mental state is, so please arrest him. Without probable cause or proper procedure to even come to that conclusion this is just idiocy.

Canada has a non-emergency hotline as well. And recording and filming something as well as mild disputes are considered non-emergency. Emergency is when Criminality (robbery/murder/assault), Fire or Ambulance is involved. A shouting match between people is non-emergency. If anything instead of defunding police we need to fund a new organization solely for dealing with non-emergency issues. See a lot of crime actually goes undetected as a result of the burden of all these management of criminality and incidents, if there is a non-emergency based organization that operates like Security guards but for cities, you will see a massive reduction in criminal activities because security forces can deter them without the need for weapons or such as they can report and enforce laws, like traffic cops with tickets. No one wants a spying ring though so these jobs are all volunteers minus the more paid organizational roles for paperworks and such.

Exactly! As a law enforcement officer you need to be totally objective when approaching a situation! You can definitely tell by the female officers tone of voice that she was emotionally invested in the interaction and was seeking too impose her will which is mostly likely clouding her rational judgement of the said situation!

I really appreciate your videos I find them very informative man entertaining. I typically find auditors to be a very very obnoxious confrontational bunch and I usually disagree with you when you give the auditors Good grades after listening to them at the pool. I like that you called out this particular auditor for being obnoxious and I can't remember the other word you said If you did, yes filming a retirement or nursing home with people inside that are already having enough troubles was at the least very obnoxious. If the cop asked people who are taking videos on the sidewalk, you get mad. If the cop don't do anything and something did happen, you get mad. What do you guys want these people to do when they receive a report and they patrol the area for that reason?

As a cop for the past 12 and a half years, I wish I could come across one of these auditors. I guarantee you the encounter would be nothing less than enjoyable, and hopefully would end up as taking a selfie together, and perhaps exchanging numbers to grab a beer sometime. Photography is not a crime, and I wish more officers would see it that way. Unless somebody is on private property taking pictures through window blinds, I can't possibly foresee any illegal act here.

@@ObservationofLimits Chris was detained after multiple people complained that they were concerned with his actions. Looking at what Chris looks like, a young kid, and seeing him just wandering around a retirement home... yeah I would worry what the kid is up to as well. The cop asked him what he was doing. She ignored the cop. First mistake. He made the cop upset... understandably. Cop simply asked him to stop and tell him why he was there. The "auditor" can simply say "exercising my first amendment" but he didnt because he wants the cop to question him... this is like reverse profiling. Purposefully making yourself look sketchy to get a cop to question you. Then when he was finally detained, legally, he attempted to flee. If you ignore a cop they can take your silence as guilt. If a cop shows up to a 17 year old kid wandering around a retirement home they dont belong in, and the kid then ignores the cop completely... yeah you just incriminated yourself.

It's not illegal to be an ass. Being an ass doesn't warrant a false arrest. Taking video from a sidewalk isn't 'suspicious activity'. I would say it's quite natural to be defensive or deflective when being detained for exercising your 1st amendment, imo I would go a step further and say knowing your innocent, and the cop having nothing but 'suspicion' warrants a 'in fear for my life' reponse given the track record, but I'm a bit extreme about my rights. If he was in the window with it sure? but was he NO, was it reported that he was NO, did he say that he was NO. So Release Him. Then toss 'i do what i feel' brunette in a cell for a couple months and strip her badge. REALLY your gonna cite mental health? They likely encounter a lot of people who absolutely don’t know the laws. It’s a rarity which someone actually knows the law. A lot of auditors don’t know much about the law, and just spew stuff they watched here on KZbin. I do find it odd officers think they know the law despite no law degree either.

@Tiniest Violin These laws are generally orders to stop doing something e.g stop walking, stop fighting etc, not to actively do something e.g shoot him, sign this. Murder and other common law offences are also likely to trump any order and no reasonable person would believe the order should be acted upon.

I had a police officer years ago admit that he made a mistake and then tell me that he encouraged the use of recording devices by both the officer and the public. He said that he did his best but sometimes another perspective was helpful and that it kept both sides accountable. He also said that he and the officers he knew would be glad to wait until you had a video recording on your phone during a traffic stop before discussing the reason for pull over. Any public servant that is not ok with being filmed should find another profession.

Chris I believe is the civilians name and it is my understanding that Chris didn't have a good grasp of what Terry v. Ohio court case actually says. The supreme court ruled that a police officer cannot legally "stop and frisk" with reasonable suspicion, BUT if you are detained by police you must cooperate with them and Chris was not cooperating after he was detained. Chris was being rude right from the beginning by ignoring the requests of the police officer and it's only fair in my opinion for the sargent to be snarky towards him in return. It's a challenge, the sargent was challenging Chris's knowledge of the law because Chris was challenging another officer.

Of course they're going to call in back up dude human behavior can be unpredictable at times for all we know this guy could have came from an asylum recently if that's the case what's stopping him from just going crazy and stabbing you in the face this is what cops think about at times human behavior is very similar to animalistic behavior at times and can be unpredictable only if you know that particular person well is when you can actually predict their behavior and even then they might surprise you at times if this guy was under the influence of drugs anything could have happened especially if he was hiding a weapon of some sort cops don't have X-ray vision

I have spent too many years working along side cops. Most of which liked to instigate and escalaye situations until they have legal justification to put hands on you. So unnecessary. Why was she so accelerated, and stressed out? Cant be that she felt intimidated or overwhelmed by a teenager who could have been hearing impaired or mildly autistic. Although there seems to be a degree of familiarity, she knew him personally and called him b his first name.... she did get involved personally, as if challenged or provoked by a teenie minding his own business for her inquiry. But she was presenting it wrong, if she wanted to deal with him in a more respecting way than patronizing him as many adults do with young adults or minors still. Why was she overwhelmed by such a flat out non-stressful situation, even if a pedestrian is not interested to open up about their non-crime activities.

She has been called by the residents, does he think the residents will be pleased if she said, "i called him, but he didn't answer, so i think he's fine". Anything can be legal, but doesn't mean it's ok. Help the police to help yourself, if you challenge a police, don't be shocked if they challenge you back. Even the op said, detain can be made, based only from suspicion. Not every police is bad, dude, sometimes they just did what s/he instructed to. That's SOP, every workplace has it own SOP. For her, call-ask-(if you're silent) detain-(if you're proofed being guilty)say the miranda rights. After the miranda rights, yes, you have the rights to remain silent, but before miranda right, no, you're obstructing the justice. That's why it's stupid if you're being pulled over, then the police asked for your documents, you ignored them, and thought you're a chad. gbu 🙏

Cops have had ample time to change their ways. So, I say I can't see it happening as they have been doubling and tripling down on their illegal actions and arrogance despite mounds of evidence against them. If WE THE PEOPLE demand community oversight, transparency, and professionalism from the law enforcement departments which our tax dollars fund then change will happen. Just my opinion.....
