Sir I have a confusion regarding the correct stage of recoding confession. As per your lecture it can be during investigation and inquiry only if done afterwards it will be called as plea of guilt. But the section 164 of crpc says that Any Metropolitan Magistrate or Judicial Magistrate may, whether or not he has jurisdiction in the case, record any confession or statement made to him in the course of an investigation under this Chapter or under any other law for the time being in force, or at ANY TIME AFTERWARDS BEFORE THE COMMENCEMENT OF THE INQUIRY OR TRIAL. please clarify

If the confessional statement is rejected wholly that means the public prosecutor has to prove the case beyond the reasonable doubt and than such statement can be used by prosecutor for corroboration purpose in order to prove the confessional statement

Thnku Sir ...Sir it means exculpatory statements are not confession ...they only comes into picture when some part of statement is inculpatory and some part exculpatory ...then inculpatory part can be used against the accused and exculpatory will be rejected as an exception to the general rule that confession should be accepted or rejected as whole ..?

Sir, what would be the exact definition of confession?Since, the definition you mentioned is that “a statement made by a person charged with a crime that suggests an INFERENCE of guilt”. This definition was rejected by the court in PAKALU NARAYAN SWAMY v State. Just to make my more question more specific, if a person charged with murder gives a statement that he was in possession of the knife that was found out to be used for the murder. Will it amount to a confession?In accordance with the Pakalu’s case the answer to it is negative. What is your point on it? Source- Principles of the law of evidence by Avtar Singh.

Voluntary and direct admission of guilt by the accused from which inference could be drawn that he might have committed the guilt. Kassab vs state Kasab said he is happy that his friend can learn something from his deed. I am also a student & a lot of things are getting clear from this video.
