I live out in the country in a trailer park, and my house is always illuminated in some way. If you are in my house, you intend to do me harm in one way or another. You get one loud verbal warning, you WILL identify yourself, and if it is not a name I recognize or no answer, you have until I get a line of sight to be attempting to get out of my house or you will be leaving in a body bag. I am not taking any chances with the crazy ass people in this trailer park. This comment will probably get deleted, but oh well.

Your daughter or someone's daughter is home alone, she is 110lbs and 5ft tall. A guy 6ft and 200lbs walks into your house because you did not lock the door. He is not being aggressive but is walking toward the female. Will she be terrified or smiling and telling him to leave? Now she reaches for a gun and points it at the guy and tells him to leave but he is not being aggressive and not leaving. Continues to walk towards her. Now should she shoot? Scream for help, or just let the guy get close enough to take the gun away and do what ever he wants. Like rape or just killer?

Keep this in mind; humans are not like paper targets. Putting holes in them is a horrific sight/sound/smell, and can make a BIG mess. Then comes the legal mess. Undesirable. On the other hand, delaying the decision to shoot or not shoot is the same as choosing not to shoot, possibly bringing terrible consequences. In addition to developing firearm competence, it is vital that we all spend time putting preventive security measures in place, thinking through potential scenarios step by step, preparing ourselves to control our sympathetic nervous system reaction (fight or flight), and making wise/rational decisions.

You are so right. It's a horrible thing to behold, the blood, smell, memories, etc, especially when that body is you or your love ones. Think about that. I'd much rather deal with the justice system or the memory of taking a life than to deal with memory of seeing a love one murder and I had the opportunity to prevent it, but did nothing. That I couldn't live with.

The problem with not being able to shoot a gun at an intruder is you have a gun, the intruder shows not intent but refuses to leave and not aggressive. You can’t determine if they will become aggressive, you can’t wait for the police, you can’t grab a lesser weapon since you would have to relinquish your weapon. They walk toward you non aggressively but they could be acting and then they are close enough to take control, all because you couldn’t shoot. The current laws are not sufficient.

I believe the 98% deterrence by showing a firearm. HOWEVER, if you look at the case reports in the NRA and Concealed Carry magazines, many who break into houses at night are not common criminals but unbalanced or under the effects of substances. They are not in a logical state and, as shown in the cases mentioned, many are not deterred by the presentation of a firearm.

It's a trap in Illinois. Brandishing a firearm is considered use of deadly force, and if the attacker runs away, that's considered a disqualifier for the necessity of deadly force.

I see so many folks on the scenario videos saying what they would do, and so many would be so wrong, where I live (Massachusetts) we have the castle doctrine, you have to be absolutely in fear for your life to be able to protect yourself, if they’re retreating, they don’t show a weapon, etc, you are not clear to stop the threat, because there isn’t a deadly threat. So, lengthy legal vernacular aside, if you shoot an intruder, you will be arrested and charged with murder. I recall inquiring of a Washington State Legislator why USCCA cannot cover me in this State. She stated, “You can’t insure an act of murder.” We do indeed live in interesting times.

As far as USCCA or other self defense insurances not being allowed in WA, NY, NJ and CA, insurance businesses are regulated at the state level and some states have singled out self defense insurances as "murder insurance". Each event around your home does not require deadly force. I know a case where a father shot and killed his daughter thinking she was an intruder at 3:00 am.

If you see my other replies here, then you will note that I repeatedly state that "when can I shoot" is the wrong question and mindset. "When do I have to shoot" is the right one! If you had some basic modern self defense training that includes the legal side of it, then you would know that. Being a corrections officer over 50 years apparently does not qualify. I, as an NRA Life Member, know what nonsense the NRA did. It eventually lead to all the scandals being made public and to the NRA and Wayne LaPierre being sued.

This actually happened to a close friend of mine. He and his wife were upstairs sleeping, early hours of the morning he is awoken by glass break in his downstairs. The funny part of the story is, he and his wife sleep in the nude, I only know this cause he told us, he got out of bed, grabbed his Glock, he told us this too, went down the stairs slowly listing to what was going on downstairs and cornered a dude rifling through his stuff. We laughed, cause he had both weapons out 😂, he told the guy to freeze which he did and didn’t take a shot. His wife called the police, they came and arrested him, he was evidently drunk and stoned, broke the front window of his house and thought he was in another house of a friend? Turns out this perpetrator has had several break-in’s and home burglary’s in the past and was prosecuted and spent a couple of years in the slammer. We live in a state where we have castle doctrine laws and the sheriffs who showed up to arrest him said to my friend that he should’ve shot him and he’d within his legal right but my friend thought why take the chance of a political lynching because this perpetrator was black and my friend white. His insurance covered his property damage and the perpetrator was supposed to pay restitution, but that never happened. But the fact that he didn’t go confront blazing was the a moment decision, we thought what if this dude comes back etc, but that never happened. When law enforcement showed up and came in the house, he was still butt ass naked holding a gun on the guy. 😂

Using commands is always a good idea as well as calling the police right away. Warning shots, however, are not advised. You are responsible for every round that leaves your gun and you do not want it to go somewhere that you did not intend for it to go. Shooting your gun is a use of deadly force and if you are at that point, you don't want to waste any rounds.

Why do police escape consequences even after VERY sus killings? Other person had a shovel, pliers, screwdriver, sunglasses, etc but still 10+ yards away. Police could still backup, Taze, beanbag, etc. Police rarely try less leathal first. It seems they trained to shoot 1st, ask later AND are protected by the investigators. Qualified Immunity shouldnt be automatic, nor so hard to not apply. YT is full of examples of these incidents.

I live in Minnesota. MN is NOT a Castle Doctrine state. The State expects you, the homeowner, to make every effort to retreat to a safe/secure area (locked bathroom) and announce to the intruder you’re armed 🔫 before taking any action or use of deadly force 🤦♂️

I thought it mattered if you’re home alone compared to being home with family, that determined if you can stop the threat rather than retreat. If home alone you have to retreat first, if home with family you can stop the threat immediately? Any insight on this?

Castle doctrine, buh bye! The burden is not on the homeowner to conduct an interview with the intruder prior to shooting while trying to protect their home and family. You can’t shoot if they are fleeing, but…

If they are still in your house you can. Just because he is moving away from you doesn’t automatically remove that they are a deadly threat in your home. What if he’s just retreating to cover to start shooting at you? Why take the chance?

If I am some how able to detain the intruder can I do that? Like if I display a weapon and yell at him like a cop to hopefully disorient the intruder and hopefully he surrender am I allowed to detain him till the cops show up? Or could that be kidnapping

So the premise of a reasonable person’s perception of imminent danger/ harm applies still applies in a castle doctrine/ stand your ground situation. Could the threat have been abated had you not shot the person? Easy in retrospect, not so much in the adrenaline filled and fearful moment of interaction, huh? Regardless you have to accurately assess and not rely on a blanket protection, if you don’t want to be charged and treated like a criminal yourself. So if I in confronting an intruder ill have to ask myself can I maintain mine and my loved one’s well being without pulling the trigger. But, if they are facing me with a lethal weapon, or absent a weapon they rush me, I am thinking all bets are off and you are within your rights to shoot them?

This is why although I love guns and support the 2A 100% - I don't believe that most people should not have them for self defense purposes...and I take a ton of heat for that! I get sick of hearing about "the right to own guns" and that alone should trump any other considerations about carrying or using a firearm for self defense purposes and, bottom line, this is true. The problem is that there are many people who have lost their lives - in this case I mean that figuratively - do to either bad decisions in highly stressful circumstances that led to injury or death of another or decisions that, even if they weren't truly bad, are seen as bad by others - particularly those who are responsible for deciding your fate like law enforcement, prosecutors, judges, and juries. And, when I say lost their lives I mean that they are either behind bars, or they have lost everything to defend themselves - even if ultimately acquitted. Consider this: If there is an attempt to hold you accountable for someone getting hurt or killed by your bullet, you will NEVER get "a jury of your peers". Its impossible! Why? Because unless everyone on your jury used a firearm in self defense, they are not true peers! They cannot, in any way, understand what you experienced! What you will get are people who "can only imagine" the circumstances and far too many will never be able to imagine what you were dealing with and, in many cases, they have no desire at all to imagine anything other than holding another gun owner accountable for a statistic that supports their stance on banning guns!. In fact, there are some elements of incidents that are almost impossible for another to understand without seeing it for themselves combined with an ability to feel and react under the fear and panic that would exist only "in the moment". The result when they can't do that...because its impossible? You are convicted! I know Ill get the garbage "I'd rather be tried by 12 than carried by six" and, if thats the way you feel then blessings to you and hopefully you will never be put in a position that jeopardizes your well-being! Here is the deal: Without a ton, and I mean a ton of training (and not just shooting under perfect conditions at the range), and shooting, at minimum, 1X per week, you are putting yourself and your family at risk of the consequences of bad decisions and errant bullets. Is it worth it? Maybe. If you carry a firearm just do so understanding that there is another side to consider and after you have weighed the risks. One more thing - the reason so many people carry and own firearms for protection and do so without any, or very little training is because 1) they think that an encounter is always going to be at "can't miss" distances that don't require skill (which is very wrong in both distance and the assumption that a close range target cant be missed) or 2) although they carry a firearm they dont truly think anything will ever happen.

I have to really say a lot of these Internet "situations" are maybe for lawyers to have a drink and discuss. In real life, I'm fearing for my life, or my family, and I will not hesitate.
