What USCCA says in regards to this is completely spot on. I had an incident happen in the heart of crime in LA where the aggressor tried to scheme me into giving him money for “hitting his car”. It was a very narrow street and our two side mirrors love tapped each other. I pulled over to assess any damage and handle it the right way like a normal citizen.He blocked me in so I couldn’t drive away in my car and once he realized he wasn’t getting a dime out of me started talking about how this is his hood and a bunch of non sense. And got out his vehicle and lifted up his shirt to take out his weapon but before he even got to stepping out I drew on him and told him to not move. Long story short he called playing victim and I was held at gun point by at least 20 sheriffs. Mind you the aggressor had a warrant, no license plates, and no insurance. It really is a stress dealing with all this stuff but I did exactly what USCCA advises in these videos and just got a call a few days ago the DA rejected my case in a long story short.

My friend got into a road rage incident where the guy followed him miles to his job and blocked him in. My friend then stepped out the car with his handgun but didn't point it at the other guy. He ended up driving off and calling the cops and my friend did over a year in jail and some time in prison for it.

And remember, Bruen set the standard for historical and legal analysis in 1791. Were permits required back then? It's not a coincidence that more than half of the states are permitless carry, with more on the way. Law trumps illegal mandates designed to make you a subject of daddy government. Criminals could care less. If criminals obeyed the laws and didn't murder, assault, etc., then maybe permits might make sense in a perfect utopia. Until you've faced an imminent threat where your life or the perpetrator(s) life/lives was/were on the line, I bet you'll change your mind quickly. A life is intrinsically valuable but government only believes certain privileged few have value. You're on your own, no matter what marketing ploy the government puts on their police cars. To protect and serve, what a joke! Tell that to the woman who had to wait to get her gun but was murdered by her attacker even after he had a restraining order. The shootings at several 7-11s, two near me, by one murderer left several dead and severely injured. One or more of those who survived have children. Who's going to pay their hospital bills and long-term care? Where was the police when they needed them? People who grovel before government never think about these possibilities, or often when it's too late after they've been severely injured or a loved one has died? Could you live with yourself knowing that you could have, should have, would have defended a loved one but failed because you weren't carrying due to your fear of government? Maybe you live in a free state, county or jurisdiction. Some of us don't and we have to do the best that we can within our circumstances.

Ideally, brandishing laws should be changed so that you're allowed to display your weapon while telling someone who's threatening you to back off. Pointing the muzzle at someone may be too far, but a simple unholstered display is all that's needed to send most criminals running. Our legal system is capable of handling nuanced situations, like if someone exhibited outside of a true self defense situation. It's ridiculous that the couple in Missouri that defended their home was charged with a crime and had their guns confiscated, but the rioters outside their gate went away scot free.

@@Springfield1795 One possible way of doing a "nuanced" display of your firearm might be to let your concealment "slip," by unzipping your jacket, or taking off your jacket (Hey, you were too warm...). That only works for IWB/OWB carry. But you get my drift. Just have an explanation ready for the cops should it go against you. Another would be to force an escalation up by employing a pepper spray first, and then pulling your weapon after that should the perp react violently to your spraying him (which he probably would). Just tell the cops you were trying to PREVENT an escalation to deadly force by using the pepper spray first.

It is, but quoting one of my favorite lines from the movie "Train Day", "It's not what you know, it's what you can prove". Essentially he is saying is as a responsible gun owner, you have to be very aware of what consequences your actions can have. If you are able to articulate the account of what happened to where it makes reasonable sense and there is no evidence that conflicts with your statement, then it should work out in your favor. In the end there must be rules and guidelines concerning actions that would be considered self-defense to ensure it doesn't cross into the realm of intimidation or criminal intent.

There was this lady tailgating me last summer. I could see her flailing her hands in the air, having a temper tantrum because I was going the speed limit. The one lane road I was on turned in to a two lane so I stayed in the lane I was in so the lady could just go around me. She continued to tailgate, then after about 20 seconds she finally decided to go around. Doing about 75 in a 30. Half a mile down the road is a stoplight that was red. She was in the left turning lane and I was in the right lane going straight. I Pull up to the red light look over she's pointing a gun at me. So I called the police, took a picture of her license plate. She told the police I was driving like a maniac swerving all over the road preventing her from passing and she was scared for her life. Cops didn't do anything, they bought her BS story and kept insinuating I was the one that was wrong. I was completely disgusted with how that turned out. So I guess everyone can do messed up stuff and act like a lunatic, all you have to do when the cops show up is lie and say it was the other guy and you're good to go👍

To add to my previous comment, I currently reside in NV and I open carry. When I was a uniformed NJ PO I - open-carried - and only concealed carry while in plains clothes and off-duty. Although, technically, in NJ, you are NEVER ' off-duty ' - only ' off the clock ' as we are charged with criminal sanctions for failing to react / respond to ' crimes committed in our presence' - AKA - non-feasance of office .

I simply do not understand why it is implied that you must keep your concealment a secret until the very last moment. Makes no sense to me. If announcing or displaying is all it would take for a threatening perp to find something else to do, and everybody walks away, why is that not the preferred outcome? Why is that not the model of restraint and responsibility? When cops are dealing with a knife wielding guy, guns are drawn, and he usually gets multiple warnings. Imagine if cops stayed silent, guns holstered, waited for the guy to get a certain distance, then just dropped him? Really?

This is useful. I have always been a little scared about pulling out a firearm because I figured I could only pull it out if I HAD TO use it with no other option. If the situation arises in which I needed to draw the gun, but the threat dissipates, it is nice to hear I don't have to fire or get legally wrecked for pulling out a firearm without "needing to."

I'd like thoughts on these two things: 1) Assuming I believe I'm in danger of being killed or great bodily harm, can I pull my gun and hold it down at my side without brandishing it nor pointing it? The idea is simply to let the aggressor know that I have it and I'm willing to use it if need be. Or would it be better reveal the gun but not pull it from the holster? 2) I'm 73 yo with arthritis and heart failure. I have lost a lot of strength and agility over the last several years. I worry that a hard blow to may head or chest would cause great bodily harm to me. If I am approached by a person who is significantly bigger and stronger than me, (whether I know the person is armed or not) am I justified in pulling my gun under the concept of a disparity of force defense? I know your looking for an answer from the channel but i would say personally, if you are going to draw your weapon you should at a minimum point it at the threat. Basically as a way of saying you mean business (even if you dont) holding it at the side shows you have a gun yes but are not entirely willing to use it. Depending on distance away from the threat holding at your side (with you being 73) you may not have the agility to raise it in time to defend yourself. A story from the navy, an armed watch stander was presented with an unarmed threat and they drew their gun and held it at the side because they did not want to kill anyone, with them being scared the threat charged them got a hold of the weapon and killed the watch stander.

I know this is old but just in case anyone is wondering, the standard for threat to your life changes depending upon the agressor and victim. If you are a frail old person, significantly less is required to constitute a potential threat to your life or safety. Same thing if you're a petite young woman something along those lines. The same thing goes the other way, however, if you are a large, physically built man, you are less likely to be justified in believing there is a threat to your life depending on the circumstances.

The answer is "never," at least as long as there are prosecutors. Rule #1: DO NOT be in a BLUE state. Rule #2: IF you pull your gun, you are GOING TO BE CHARGED. Rule #3: Guilt or INNOCENCE doesn't matter - when there's a prosecutor who wants to run for judge. Take it from ME. I've been there. If you are going to pull your gun, don't. Or understand that it will (1) RUIN your life, and (2) remove all money you have in your bank accounts fro you, and (3) quite likely result in you doing at least short time behind bars. Yeah. The "self-defense" thing really, truly exists only in fantasy.

Only one time did I have to show that I was armed, that was near Crossville, TN on I-40 after a guy hit my car 3 times. We dialed 911 and pulled over at an exit. Cut to the meat of this... the guy pulled in front of us, dug around in his back seat then was walking towards us and I told him that we've called the police (we had 911 on the cell phone .. before smart phones) and I told him to stop. He didn't. When he was "too close", I held my pistol across my chest so he could see it and he stopped ( I was in the "V" formed by the door of my van, my wife and was in the passenger seat and my 2 young children were in the back seats - locked in their child seats ). After the cops came and, ultimately, put him in cuffs and into the back of the patrol car, I asked the State Trooper if I "did right"? He told me that if I had pointed my gun at him and ordered him around, I would be in handcuffs in the back of the patrol car. So, my question to you: is there a difference in having my weapon in my hand and pointing/aiming my gun at the target? In the case above, my gun was in the console and not on me in a holster.

Addendum: Apparently the guy was digging around his back seat for "cigarettes" and did not have a firearm. He was arrested for having 2 different state driver's licenses and fake insurance document. The cop told me that between the police, the hunter's that came out of the woods and told 911 dispatch where we were, and myself, guy was the only one without a gun. I had no way of knowing he didn't have a weapon as his hands were in his coat pockets as he walked towards us. Remember, he hit us 3 times.

It's baffling to me that we go so much out of our way to protect criminals. I understand that we have to take the loss of life seriously, but what the attitude should be is a begrudging shrugging of the shoulders and saying, "..tragic, but hey, once that criminal decided to < > , all bets are off. We obviously wish none of this happened, but ultimately the criminal decided to commit a crime, and the person did what they felt they had to do in that situation." I know here in Wisconsin You can draw your gun anytime you feel threatened. You just can't point it at anybody....and in some states, (im in Wisconsin) it is not illegal to "brandish" your firearm....you can do a low ready draw for non life threatening scenarios..... For instance if you walk upon somebody who has broken into your car and that person is not yet a deadly threat to you, it is not against the law for you to pull out your firearm and just hold it (brandish) in your hand pointed in a safe direction giving the criminal a chance to make a decision not to become a deadly threat... And of course 99% of the time the criminal will still say you pointed a gun at them, even though you didn't....

Yes, very good advice to have something to deal with an aggressor for situations that do not rise to deadly force, such as a fist fight assault. @rocky, if they've got a gun, you're not going to reach for pepper spray, use some common sense. @Mein321, that's not a lot of carrying. It's two things, it's not a full duty belt. Having said that, if that's too much burden, then don't carry anything. If a can of OC and a gun is too much too carry then either separate is too much to carry.

I'm slightly confused about how we are to report the incident to the police without actually talking to the police about the incident and accidentally convicting ourselves and making matters worse. Would you be able to further explain how to report a scene to the police where the gun is drawn but with no shots fired? I feel that calling the police and then once they arrive you say that you need to speak to an attorney wouldn't be helpful and I'd love to know what things we should report and what we shouldn't report to them when they arrive.

A BRIEF initial statement at the scene could be something such as, "That guy tried to rob me and pointed a black handgun at me, so I had to defend myself. As I removed my firearm from the holster, the guy turned and took off running east. I will gladly give a further statement at a later time with my attorney present." Other than that a physical description of the suspect would be ok to say without any issues. A good idea for you would also be to write down some notes (for yourself only).

I was thinking something more along the lines of "I was just in an incident which an aggressor caused me to fear for my life. I drew my firearm but did not fire, as the aggressor fled on foot. (give them information such as their description and direction of travel) I will gladly give a full detailed statement once I have my attorney present".

I went through this last year august in dallas tx had to use my firearm in self defense due to another trying to pull his out and use it against me so what happened happened he died on scene i didnt stay on scene i left 4 days later they came and got me didnt speak to any officers/detectives told my lawyer he got on it and 9 months later the case got dismissed now im free again and struggling to get back on my feet and get a good job again the one i had wouldn't take me back due to that case

Correct, police have a LOT more legal leeway to have a gun out and ready. Police have special privileges because they perform a special function in society. Their job involves putting themselves in harms way and taking risks that you as a civilian don't need to do. You, mr. armed citizen, do not have special privileges. So if you act like a wanna-be cop, you could end up arrested by a real cop.

You CANNOT fire your weapon at another human being unless your LIFE is being threatened by that person. And that person must have the means to harm you (knife, gun), be close enough to harm you (arm's reach, pistol range), and have shown intent to harm you (threat, brandishing, etc.). Protect your life! Not property. // Two, you CANNOT allow another person to take your gun away from you! Don't get into a situation where someone can snatch your gun, steal your gun, or hold you up for your gun. Protect your gun!

In all 50 states you cannot use deadly force to protect your property. The only exception that I know of is Texas in some circumstances, but that usually has to be on your own property if I’m not mistaken.

This abject insanity MUST be turned 180 Degrees: one has the right, wherever the innocent person being affect is legally allowed to go, to shoot and kill someone for attempting to steal your property (smartphone, wallet, car, etc), because the THIEF is WILLING to USE FORCE to accomplish the Thief's Task: Theft and Violence are two sides of the SAME COIN, and until people pull their heads OUT of their asses and understand this concept, innocent people will continue to be robbed, raped, injured, crippled up, and murdered. Thieves need to start dying, legally, and when that happens, you'll start seeing muggings, breakins, house burglaries/invasions, and yes, murders, all DWINDLE to a trickle; because those doing the stealing, mugging, beating, raping, and robbing, will understand that those innocents they are targeting, are LEGALLY ALLOWED to KILL the Thieves.

@@deebee4575 I've seen this play out in another state so I would have to say that may not be the general consensus, in Kentucky some teenagers vandalized a house pretty bad and then moved on to the next house and at this house they were stealing the owners car, the owner caught them told them to leave he's calling the police and they continued to try and hotwire his car, he withdrew his pistol fired 8 times 3 of which hit one that was just on other side of car, they ran but the other died on way to hospital after ambulance got him, they ended up catching the others later that night but point is they didn't have a weapon and they didn't bum rush the guy but they did try to steal his car and he fired on them, no charges were pressed

I remember back in 2017 when I stopped an armed robbery in South Florida. I didn't have to fire, as individual had fled the scene. The Sheriff's Office reviewed security footage and told me that I was in the right, asked for a statement and made an arrest when they found the guy downtown. However, I called the USCCA right away and let them know what happened.

This is why a total revamp/reform is needed. If you can't draw until "imminent fear", why not quick draw and fire? How does that prevent deaths? Also, why do you have to wait until the point of "imminence" to deter the possibility of harm coming to you? There has to be a logical step before "imminent"... a "forseeable approach"... a guy walking toward you with a baseball bat... at 30' you pull but don't aim and say "Leave me alone! I will defend myself!"... geesh.

He has covered that in an earlier video on "what to do" immediately after a self defense/use of deadly force incident. I believe an example might be to something like, "Someone tried to rob me with a gun, and I had to defend myself." Other than that, just request EMS for a gunshot wound (if needed), and give location and/or direction the suspect fled if they took off, and a description of the suspect(s). ALSO give your physical description too, so arriving police can hopefully identify you as the reporting party/victim upon their arrival.

I made that decision long ago (and by the way, I did not come up with the concept myself but was introduced to it by the late Col. Cooper many years ago): I won't draw my gun unless I am in a situation where the dead-penalty is immediately warranted in my mind... Witch means that the situation will immediately, while in the process of presenting the firearm, change (to a no-dead-penalty one) or someone is going to get shot as many times as needed until the situation changes to a no-dead-penalty one. It's a simple rule that needed a little beforehand introspection and preparation (like what is a deal-penalty situation, what is the line on the sand not to be crossed...), but once I had a clear understanding in my mind of what is and what is not a dead-penalty situation, it has worked well for me over the years.

I am an older guy, was raised around both lawmen and those who walked both sides of the law. I was raised in the 49th state of Arizona where gun issues were always in play. Being on the Mexican Border was a hightened level of anxiety. they taught me two things, how to bring it into play and do not bring it into play unless you use it. I wish there were someway to teach most LEO that bringing your weapon into play, it is time to use it -----IT IS THE ONE AND ONLY NUCLEAR OPTION -- pull it use it. you make your decisions before resorting to that level. Gunfighters of that time were in a different world Kinda wish it was still here

Great video - but every state has different laws. Such as here in Nebraska you have a "duty to retreat." Therefore, you have to prove or hope to God there's witnesses that can back up the reason a gun was drawn and possibly used - proving that there were no other options.

What is often not considered is that if someone wants to fight you but is not using force that would justify drawing your gun, there is a possibility that in the struggle that he could see your gun even if it's concealed, and decide to take it from you in the heat of the moment. I'm not going to remove it from my person to fight someone, either. I'd rather use a response that is disproportionate and walk away without a scratch than take my chances with either scenario.

In Joliet, I believe 2020 or when i just got my CCL in ILLINOIS. I was at my business in the parking lot. A shooting occurred and two men were shot, one in the hand the other in the chest. I saw the man running and yelled, Please, drop your firearm!" He looked up and say a long haired and bearded man. He picked up his firearm, and started running, I didn't fire due to the liquor store behind him. The firearm was no longer a threat but I was hard on myself! I was Infanrty in Afghanistan, now in civilian life, I believe now I did the right thing! But now LE could have killed him while shooting into a liquor store and been free from prosecution apparently, as a deputy later told me! I am 10000% sure I wouldn't have missed! But that .000001% wasn't worth it because in the US we aren't at war!!! But the deputy saying that made me think, am I the enemy??? Why would he not receive any punishment or at least in those 2 seconds, I made a tactical decision, why doesn't that apply to him???? Am I missing where I failed but he would have been correct by shooting a subject, while the background as an absolute NO GO?!!! It's a question no one answers! Hell I think I might still have the video, I hope!

Rule of thumb: if you are innocent, ask for a judge trial. If you are guilty, ask for a jury.

I would rather be judged by 12 than carried by 6. No articulation to investigating officers. Get a lawyer, write a statement with lawyer, and all questions thereafter can be referred to the statement.

Can someone answer this? He emphasized to NOT try to explain what you did and why until your attorney is present, and to be sure to call 911 immediately after drawing your gun. So you call 911 to report that you drew your gun because you were in fear for your life or felt you were at risk of great bodily harm. The police arrive. Do you say to them those same words or not say a damn thing?

I’ve been in 2 incidents. 1. A guy was walking into a store and I said “I’m asking u nicely pull your pants up.” He said “im going to beat yo ass.” That’s when I uncovered my weapon (DID NOT DRAW) put my hand on it and told him to try something.” He backed down. 2. I was living in apartment complex and worked nights, the woman above had children 6/7/8 years old and teens babysitting. Told her when I moved in to keep the noise to a minimum, for months they never did, I called the manager, I called the SEO, then PD, according to the lease agreement process. One day I yelled out “shut your kids up.” Is all I said, an hour later I was leaving and she was sitting on the steps with about 7 others. She said “what’d u say to my kids.” I told her. “U know I work nights, we’ve warned u, called management, PD on u, don’t come down those stairs.” she start coming down along with the others as I backed up and backed up, when she reached the bottom I told her don’t take another step towards me. When she did I put my hand on my gun she said “pull it, pull it, pull it.” That’s when I got on the radio I had (FD) and called dispatch to send officers. They arrived and de escalated the situation.
