We are all protected by Our Constitution. The Judge must respect Our Constitution. We are entitled to Freedom of Religion. Enoch is correct. One cannot call a boy a girl or a girl a boy.

I would have thought that Burke had the same right to refuse the student’s request as the student or the school had to make the request. Is there now a law forcing people to use certain words or could something like this start appearing in employee /employer contracts. What I am trying to figure out is how can he be disciplined for not using words that are selected by his employer?

It was Burke's refusal to use a so called pronoun that began the whole proceedings. Why should anyone be forced to call a pupil who has a name by a plural pronoun? Doesn't make much sense. I wonder would the Ireland census people accept ....they... If someone used it on a census return? If the Government doesn't take action on this trans and pronoun nonsense things will become farcical. In the USA recently a trans male was allowed to go to a female prison and impregnated two women. You don't even have to be a Christian to work out that there are two genders. You're assigned one at birth and it never changes.

He can be disciplined for misconduct, gross misconduct etc. Just like any employee. Are you aware that there are atheist and agnostic teachers up and down the country helping their classes prepare for first holy communion, confirmation etc? Because it is their job. They can still hold personal beliefs, but they are obliged to do their job. That is what the employment contract is about.

@@terrygorry Atheist, agnostic, Christian or whatever else, simple biology tells us that there are two genders. Maybe they don't do biology in school anymore. Difference is that the Christian Bible tells us that God created us male and female, as does the Quran. I wonder what would have happened if Burke had been a Muslim and stated that his beliefs did not stretch to calling someone by a pronoun. Would there have been a different outcome?

@@terrygorry Thanks for your reply Terry. I only heard of your channel in conversation during Christmas and I have enjoyed any of your videos I have seen since. Please keep up this good work. I do understand there are aspects of jobs that require employees to leave their feelings or religious believes or lack of to the side and carry out their duties to the fullest and best degree they can. If in this case Burke had pushed his religious believes on the student or had ignored them or anything of such a nature it would be unacceptable and I think it’s unfortunate for the student and their family to be caught up in this case. My main interests here are, how can refusing or failing to use pronouns be misconduct? Could this be a new law in the making? For my own part the idea that I could find myself been disciplined if I failed to use words which I don’t understand is mindboggling.

I have always felt, the school did not handle the disciplinary matter correctly. Verbal warnings, written warning, second written warning , then suspension. They seemed to basically just suspended him on the spot. So I reckon that's what Burke will claim at the injunction hearing. Which also might mean, the contempt proceeding was based on unsatisfactory evidence.So I think it's 60/40 in Burkes favour.

Didn't he threaten the principal at a dinner? For me that would be an instant suspension on safety grounds pending disciplinary hearing as opposed to going through your stages above.

Then that person contacts the Garda and makes a statement with witness's, and Burke is suspended pending the Garda investagation. B..Burke raises his voice, but doesn't issue a physical or verbal threat. Then we go back to employment law. Can you suspend a exempellary worker because they raised their voice once. Also who high is a raised voice? As I have said many times, I have no inside knowledge. I am just interested in the case. As I get older I have realised that a real life case. Is far more bizarre than anything a written as fiction.

The original order from high court is still valid, it’s up to school to go back to court to have him jailed for contempt. They have not done so (yet).

It does not command wholesale rebellion - it commands pray for those over you. If your employer legaly takes out an injunction to stay away from X - then that is what you do. The courts are not stopping him preaching the gospel - and you can do that via the internet, or X Km distance from the school as would be legal; he stated his case, lost in the courts, now shake the dust from your feet and move on - thats gospel Oh, and pay your fines.

its a clash of Constitutional rights, between religious freedom rights on one side and an individual's freedom of expression rights on the other. If a child calls himself a dog one month and a cat the next month under the transgender rules, and demands that others refer to him/her/whatever as that, and liberal headmasters and staff obey this nonsense, then will the courts implement this nonsense if someone disagrees on religious grounds, scientific grounds, and common sense grounds ? courts are being asked today to entertain this nonsense where people's genders keep changing all the time, there are 27 at the last count.
