They don't even get this. If they wanted the citizens to stop filming them or hunting them with video, they would not act like such asses when observed. These are the types of "cops" that make people like this videographer and myself, actively look for them. We hunt them. We want to find them. We want to expose them and weed them out. Once this becomes boring, we would probably stop. LoL.

She had no reasonable reason to approach. The man is well within a reasonable distance from the scene. Female LO seems to be constantly over reacting and escalating situations which can cause a violent reaction. I suppose it's a psychological reaction on their part from not being validated at some point in their youth. None the less, it creates a potentially volatale situation witch may well lead to very dire consequences. In any case, she knew you had her beat.

Not a Police Officer But Peace Officer and Police Commissioner retired. It is true you do not have to show your identification in my State of Illinois and I can not force you to show me your Identification.. You are however required to Carry State issued Identification on your person at all times. The caveat is at the point I need to include you in my report because I feel you have injected yourself into my case and at any point I believe you may be committing or have committed a crime I then need to identify you, then you can and will be detained and held in the County Jail up to 72 hours without criminal charges to identify you. If you still refuse, You will then appear before a Judge as a John Doe and asked to Identify yourself. Further refusal will garner contempt of Court Charges and Obstruction Charges. You can continue to keep the ball rolling all the way to State Prison where they will give you a number and you will no longer need a name until time for Parole. Then if you refuse you will be denied Parole and found in contempt starting the process all over again. Have fun with that. When he refused to show his hands he disobeyed an order from a Police Officer who has reasonable cause to suspect he could have a weapon he set the ball in motion.. The Supreme Court has ruled this does not Violate the 4th or 5th Amendments. (725 ILCS 5/107-14) (from Ch. 38, par. 107-14) Sec. 107-14. Temporary questioning without arrest. (a) A peace officer, after having identified himself as a peace officer, may stop any person in a public place for a reasonable period of time when the officer reasonably infers from the circumstances that the person is committing, is about to commit or has committed an offense as defined in Section 102-15 of this Code, and may demand the name and address of the person and an explanation of his actions. Such detention and temporary questioning will be conducted in the vicinity of where the person was stopped. (b) Upon completion of any stop under subsection (a) involving a frisk or search, and unless impractical, impossible, or under exigent circumstances, the officer shall provide the person with a stop receipt which provides the reason for the stop and contains the officer's name and badge number. This subsection (b) does not apply to searches or inspections for compliance with the Fish and Aquatic Life Code, the Wildlife Code, the Hepatitis-Herps Act, or searches or inspections for routine security screenings at facilities or events. For the purposes of this subsection (b), "badge" means an officer's department issued identification number associated with his or her position as a police officer with that department. It's nerve racking being a cop. You need to understand that when your talking to a cop you need to keep your hands out of your pockets. It doesn't matter what you think or feel, if an officer feels threatened by you, they have a RIGHT to investigate you and frisk you....YOU gave them that right by simply being a U.S. citizen. When you get shaky and nervous it makes police nervous. If you were smart you would have taken your hands out of you pockets and just continued to video tape. However I understand that this is what makes you feel important and you do need good content to get people to actually watch your videos. your just lucky she didn't hit you with R.D.O. because she could articulate that your presence was taking her attention of her job.

City of Houston v. Hill, 482 U.S. 451 (1987) Upon shouting at police in an attempt to divert their attention from his friend during a confrontation, appellee was arrested for "willfully . . . interrupt[ing] a city policeman . . . by verbal challenge during an investigation" in violation of a municipal ordinance making it unlawful for any person "to assault, strike or in any manner oppose, molest, abuse or interrupt any policeman in the execution of his duty." Court's ruling: Although the preservation of liberty depends in part upon the maintenance of social order, the First Amendment requires that officers and municipalities respond with restraint in the face of verbal challenges to police action, since a certain amount of expressive disorder is inevitable in a society committed to individual freedom, and must be protected if that freedom would survive.

Smokey McMillan "it was his proximity to the officer." Are you referring to a distance? How far would you say he was from her? I would conservatively estimate at least 20 yards. Is that not a reasonable safe distance? Are you implying that she effectively shut down that gas station, because of her traffic stop? He was no closer to her, than the gas pumps. "She was able to articulate that his proximity was taking her attention off the suspect while she (The Officer) was "attempting to discharge the duty of (his or) her office." Still not clear how him merely observing from at least 20 yards away could be construed as interfering, when in the case of City of Houston v. Hill, 482 U.S. 451 (1987), Hill was literally shouting at the officer in an admitted attempt to divert the officer's attention. I have no problem with police being paranoid. If she didn't feel comfortable, then she can call back up to watch her back. She can not order people to simply go away.

Smokey McMillan Terry cannot be triggered until the employee (Sgt Sperry) has "reasonable suspicion" that an individual has committed or is about to commit a crime. She certainly could not do so in this case, so a pat-down could not be justified by Terry. Period. It's nerve wracking? I'm sure it is. BUT: her nervousness does not place ANY obligation on me to show ID, take my hands out or anything else she might want me to do. Idaho has no stop-and-identify statute, so even in a Terry stop, no requiement to identify exists. An in NO state is there any General requirement to even carry ID, let alone produce it on demand from a state employee. And RDO, really? You really mean "Contempt of Cop," don't you? Yes there could have been an arrest, but any lawyer worth his salt would get that bounced. The tragedy is that the arrestee would be out his money and his irreplaceble time. What the uniformed state employees never seem to understand is that conduct such as we saw here (mild, to be sure) only undermines police credibility and authority. God bless you as well. I don't remember what state this was shot in and can only speak for NC. Out of the 24 states that do have stop and identify laws, NC does not have ID on you until you start to operate any motor vehicle. In NC, if an officer can articulate based on the totality of circumstances that a person was making the officer feel threatened, they may detain that person until the possibility of threat is proven or dismissed. No I don't mean contempt, the RDO came in when she told the gentlemen that he was taking her attention off of her duties and asked him to relocate to the sidewalk. If you would like I can find the exact NC statute to follow that. If she wasn't in a bad part of town I think she was being excessive, but if she was in somewhere like Salem I don't blame her one bit. For anybody reading this if a law enforcement officer approaches you please take your hands out of your pockets if asked to, it makes law enforcement nervous as crap. Second, don't ever try and argue with law enforcement, you'll never win. Know your rights, and if that officer wants to violate your rights take him to civil court where you actually have a good chance of winning. There's this cop around here who is a straight jerk. He's beyond excessive and very very verbally abusive to people around him which directly violates the Police Canon of ethics. There have been numerous complaints filed about him, but never any evidence. So instead of complaining about him I decided to become a cop myself and treat people with respect regardless of how they treat me. There are some bad cops out there, but you can't stereotype all law enforcement officers. If you do you might as well say that all blacks are criminals, all whites are racist. We know that's not true, we know those are just stereotypes that are placed on people from what they here from narrow minded people and T.V. But short of having been in law enforcement no one can say that they wouldn't have done the same as this officer in the video...it's amazing what you'll do if you start to feel threatened. This guy was no threat but he was taking her attention off the traffic stop which very well could have been a threat. Many officers get killed on traffic stops. How many people here can say they risk their lives every time they go to work? Not event he military risks their lives EVERY TIME THEY GO TO WORK (God bless the Marines). God bless you for critisizing my post in a respectful and productive manner, unlike most people who just blurt out profanities because they can't think of anything.

Where does law enforcement get it's powers from? Answer: WE THE PEOPLE. We cannot grant powers to anyone if we do not also have those same powers. Anything a cop does must also be something we can do. We cannot grab a cop or make people stand on a certain part of the street just because we feel "uncomfortable". She was wrong grabbing him and certainly can't tell him where to stand on that private property they were on.

This isn’t the 1700s Police are still citizens but they have general civil authority over other people.. and the ability to temporarily remove your rights in order to keep the peace... without a police force with those abilities, there is no discipline and there are no checks. REMEMBER Police were created after the constitution was written thus many of the things written in the constitution are more relevant to military police and the right for people to govern themselves. Police were established after the fact and have a little more authority over citizens for legit and good reason.

Other people were pumping gas and driving through the area at a distance closer the to cop than this videographer was. So the officer cannot legitimately claim that he was interfering. The request for his ID and to take his hands out of his pocket were attempts to intimidate him so that he would stop filming.

It's ok to film, but the police has a very tough job. We don't get to see all the crazy calls they have to go on. If someone is watching them, they really need to know what your up to. Be polite to the police, it's not an easy job. Without them, it would be crazy out there. They best way to handle this is to show ID and ask if she minds being filmed. With your cooperating, things would have gone much better. The police are not out to get you. They do have a job to do.

RESUME.... 1st) she said... video tape is not a problem. 2nd) she said "out your hands of your pocket". It is the usual comment before assault everybody, like standard procedure because police microphone is recording her voice. 3rd) yes, she assaulted you, like standard procedure. 4th) she told you cameras on gas station are recording (yes....sure...and he is the owner). 5th) she tell to another officer "I'm gonna talk to him later", that "prepotent comments" like ever. 6th) (SEE 10:00 to 12:00)...After she finished with the detained car, when she got to you, she recognized take your hand, and as soon you told her "you assaulted me", she fled. Did you people understand?.....good. Because it is a total harrasment.

You defo go round looking for conflict. Ironically you stand up and fight for the fact that police should be serving and protecting the public yet the time they waste dealing with you is less time they're not serving and protecting the public. In the time you've wasted this officers time not giving ID someone could have robbed the gas station but you're more concerned about refusing to give ID. I completely understand why she asked you to remove your hands from your pockets as she had no idea if you had a weapon and as a citizen she has a right to protect herself let alone as a cop. I don't like cops either and I agree for the most part they extort money from us but if I get pulled over by cops I just answer the questions they ask, hand over my licence when asked and most of the time they let me off with a warning. I was once stopped for speeding and the officer just told me to slow down and that was that and the other time I was pulled over I pulled away from lights to quick with my mate on the back of my motorcycle and the front end come up and happened to be a cop car in the opposite lane and he pulled me over. Just gave me a section 59 warning because I didn't give any bullshit I just co-operated as I for one have better things to do than stand there arguing with cops.

I like how many people are saying "Oh, if you came to my area, you'd get (blank)". First off, he could sue the cops if they did, especially if he filmed it. He has a team of lawyers behind him, and he has gone to court multiple times. He did not break any laws, and he is very well aware of the laws of the areas he visits. Second, I bet most of you are very much exaggerating the brutality of your officers. You make it sound like it's a good thing that you cops are terrible.

There is your problem. Why has he gone to court so many times? I have never been to court and never had a feud with a police officer. This guy goes out looking for trouble and when he gets it he makes it look like a pity party of how they are breaking the constitution. When in they first place if he would mind his business and let them do there job then none of this would be a problem. If you don't want to interact with cops then don't attract attention to your self and don't break the law. How easy is that? I've done it for years and maybe talked to a cop once. It's people like him that give media something to slander.

I think we should watch and police the police (Police body cams are available for public review btw) but don’t intentionally make them feel uncomfortable. They are people who are apart of your community.. they probably live in ur town.. be respectful by abiding by their wishes if it helps make them feel safer.. otherwise you make them worried, nervous, anxious, possibly scared.. and for what.. so u can post a video and call urself a white knight because they got mad at you for standing directly behind their car in an empty parking lot in the middle of the night? Gavin Seim I have a serious question...Please respond. I know the cops always ask us to keep our hands out of our pockets but I have a serious concern with that. I know if we keep our hands in our pockets we might get shot by them but doesn't it make sense that if we have a right to our own security of life that, just as the cops have guns on their hips and sometimes their hands on their guns, that we should also have the right to have our hands in our pockets especially if we are conceal carrying so that if any crooked cops attempts to shoot us we may defend ourselves quick enough to live?? Because I don't find it fair that a cop could easily protect themselves with firepower yet we cannot protect ourselves from them even to the point that they disarm us. This is just a thought, I know it's a dangerous one but it's a real concern considering I've seen videos where cops pull their guns out on guys without a real reason to do so. I've seen a guy pull a gun out on someone just because they had a camera.

You are the only auditor that has explained why he does what he does in such a way that if we don’t back you and if we don’t resist we are hurting our children and I think that is a message that any mother or father would proudly get behind. I know I don’t want the police treating my children the way they treated me when I was a teenager. So yes, I will teach then what their rights are and to not let LEO bully or threaten them in to doing something they do not want to do or are uncomfortable doing. However if they want to show the cop their ID I will tell them that is ok to just do long as it is what they want and not what the cop wants. I think it is a bit excessive to always to refuse o ID of the police officer is being friendly I mean why not and you can always make him/her admit that he has no right to ID you before you show him your ID. It would go something like this: I will show you my ID if you admit or confirm that you do not have a right to see my ID and the only reason you are getting it is because I choose to let you see it of my own free will. Now if you can agree to that then yes I will show it to however if you think you have the right to ID me for no reason then I will just keep it in my pocket and prove my point.

She is concerned that a random dude is behind her AT NIGHT in a PARKING LOT pretty close.. she said she would feel safe if he stood AND FILMED by the gas station, but she is uncomfortable with him directly behind her car. - GAVIN knows this... he intentionally stands right behind police because he knows it’s threatening to them and they will confront him.

Gavin wasn’t actually filming this cop.. he intentionally stands behind her car because he knows that is something they do not like and ask you not to do. Watch the video... notice how you can’t see anything at all but the back of the car.. not even the officer or the person she is interacting with. He claims he is making sure she doesn’t step out of line yet at the same time he can’t even see her. He is there only to instigate a reaction he can use to escalate the situation for literally no reason.. don’t stand behind cops.. or ANYONE for that matter.. in the dark.. if its not a cop ur probably gonna get hurt. And actually in some cases if its a cop you’re probably gonna get hurt too. Making people threateningly uncomfortable will give you a negative result.. don’t do it. So many levels of wrong O.o "I have a deep fear of men" WHY ARE YOU ON THE FORCE?! "You have to do what I say" If I've done something to warrant you telling me to do anything, which I haven't or I'd be in handcuffs. She blatantly admits assault, a pre-judging of males based solely on presence, a disturbing lack of legal knowledge. Was she really the only one that got reprimanded?

What was the intention of filming in the first place, apart from hoping to record something worthy of getting some attention via public media. How about trying to see the situation from an officer's perspective and how your actions could easily be taken as interfering, distracting and or antagonistic. The general public are oblivious to the stresses mounted upon police officers, who could be in harm's way at any moment while on duty. I see this officer's actions as completely justified, simply wanting to minimise the number of potential points of threat. Anyone who respects the job that police officers have to do, or has the capacity to sympathise with their desire to feel safe while on the job, would have identified that the officer was distracted and nervous about them standing there, so would have simply offered to move further away, or at the very least, complied with the officer's requests. By refusing to move, take your hands out of your pockets or provide any ID when requested, is absolutely antagonising and would only increase the level of unease the officer had with you being there in the first place. I find the whole situation an absolute joke and feel sorry for the officer involved. I'm sure the chief also only made the comments they did through the advice of their public relations liaison. A more realistic and unfiltered response would have been something like "To any individuals that have a vested interest in law enforcement and are passionate about ensuring the liberty of those we've sworn to serve and protect are being upheld, I encourage you to join the force and take an active part. If not, please assist us to do the job to the best of our abilities by cooperating whenever possible and by refraining from either directly or indirectly interfering with law enforcement officers while on active duty."

I think you should go home to your family. I realize you have the right to record a traffic stop, but why would you. You recorded more video of the 2 officers than you did of the traffic stop itself, so what was the point. And if you’re getting cold, GO HOME

Whatcha gotta understand is that they are there to keep peace.. they do work for us but they are in a line of duty that can be extremely dangerous.. doing something that makes them feel threatened gives them the right to take action against you. If they ask you to do something then just do it. If you refuse.. now ur causing trouble.

Raine they have the right to detain you if you male them feel threatened... so if you do that, and the officer feels threatened by it.. you will be placed in cuffs. They will probably let you go after cuz you might not have done anything else to break the law.. but threatening an officer is a reason for them to place you in cuffs.
