The auctioneer was as confused and bothered as the rest of the crowd. Don't think he was in on it. However the real crook of the whole debacle was the manager...not the owner. I suspect if the owner knew this manager was pulling this kind of BS he would be unhappy to say the least. The manager was the one who thought this was fine cause it would make him more money or there was some kind of kickback. Personally i would check on Yelp to see if this has occurred before and if so let the BBB know. I bet that manager would be given his walking papers.

Forgive me if I'm wrong but I believe that once a unit goes to auction the manager cannot negotiate someone's debt for his own profit (regardless if he is owed money from that unit, it's still a gain and not a recuperation) that unit owned by the debtor until it changes hands at the purchase, I don't believe a manager can step in and negotiate a selling price of somebody else's items other than the auctioneer. Most definitely has a right to stop the auction but not for those reasons..lol

25 years ago he would have been doing good to get $75 for that locker. Since the TV programs have been on assholes like him have it all screwed up. That is why I will not bid an online auction. Those online auctions, someone from the facility has already gone through the locker,, and anything worth anything, has already been taken out.

In my auction experience in Florida...if there is a "reserve", then it should be stated prior to bidding. (period!) If the auctioneer does not reveal a reserve and received only 1 bid, he can refuse the sale. BUT, if he receives more than one bid, he must sell to the highest bidder, regardless. I've literally been to hundreds of auctions and what I seen here...was not legal and frankly I'm surprised that the auctioneer handled it accordingly.

Rob, I completely agree...(and please see my other comment here). above or below this response... And there are several (mostly southern) states that have reciprocity in auctioneer licensing requirements/training, etc...so if auctioneer relocates to one of those states, the new in-state (or multi-state) license is easy to get. I'm in Florida, now...retired.

Manager saw the bidding trend. He didn't want to let it go for $20-30. I've never seen a minimum bid on a storage auction, and if indeed it's allowed, it should be stated up front. If I was the guy who had the $20.00 bid, I'd be pist to have the rug pulled out from under me like that. Manager has no ethics whatsoever. Auctioneer is probably afraid to say anything negative about the manager, because he wants to auction there in the future.

I cannot speak to auction law in Ohio, but in Florida ALL auctions are considered auctions with reserve UNLESS it is written or stated that it is an absolute auction. So if the auctioneer does not say absolute - it is considered to be a reserve auction.

Wayne, I was told you need 2 bids for it to be legal. If there was no counter bid, then it isnt an auction, if the auctioneer or the property owner want to bid, they must tell the other bidders before it starts, there are laws covering that. Many shenanigans associated with auction, would be good to know who to call to complain about the crooks.

I would find out if that's the owner manager. In Texas we don't have "no sale" if we did would have to go through the lien process again which takes at least a month. I don't know if he can legally clean that unit out. As a former Self Storage Property Manager at auction my job was to get that unit sold and cleaned out, not to worry about how much it sold for. I need that unit to rent. If the unit sells for what is owed then collection agency tries to collect the balance. If unit sells for more than owed the remaining $ has to be held and be available to tenant for up to a year. Personally I would complain to the Auctioneer board of Ohio and to the owner of facility

That sucks! I lost all I owned for 20 years. Over $100,000 worth of stuff. I called to ask if the the person who bought it would call me so I could buy back personal items. The manager told me he could not give out that info. He told me it sold for more than what was owned. Never told me I could claim the money

When he said he could sell it on let go that is illega, right there! It's one thing to auction off the locker. However, it's a completely different thing for the management to go into the locker and start selling items as they see fit. They cannot do that without through courts. Report him!

Talk to a lawyer about that last lot, most states say that abandoned property may only be claimed at auction(sealed or open bid) and I can't think of any state that allows an auction to be stopped except by law enforcement.

Auctions are a legal process. Once the auction begins its too late to do anything about it. I'd say he was breaking the law.. If he wants the stuff himself he should get a friend to bid for him. That would still be against the law but at least its a level playing field for the bidders... Its also not legal to tell the bidders what the reserve is. You can give an estimate as a guide for bidders but thats all.. The auctioneer should have taken the manager to one side and explained it to him...

However, before their day even started the auctioneer did go over terms related to "pulling units at any time during sale" and their own set of rules and discretion at the jump... id say, for morality sake, he shouldnt be able to jump in once bidding began but hindsight, he did mention terms from jump street so... its sensitive for sure...

Before the sale starts, all rules concerning the sale are announced and any units with a minimum bid are noted. After that it’s a straight cash sale. The manager can’t pull a unit after he sees what’s inside. Especially after the auctioneer has taken a bid.

Item should have been pulled before asking for bids. Can be taken down at any time means anytime during the sale before bidding begins on an item. I bought a tractor once (1954 Jubilee) that had a real nice contractor grade blade on the back. just before bidding began the auctioneer had the blade disconnected so he could sell separately. legal but I was pissed as the auction listing said tractor and blade. I wound up buying both cause the blade was worth far more than I paid. 26 years later I still have both.

when we sold our house in PA we had an auctioneer come to our house and take our nice pieces to his auction house to sell. We gave him the minimum bids we wanted him to sell for certain items so that bidders knew before the auction. otherwise they would bid whatever they wanted.

Legally he can't pull a unit once it is listed for auction. Period. Check the lien paperwork that has to be public record. The manager broke the law and should be brought up on at least civil if not criminal charges.

No way. The “right to pull a locker at any time” that can only apply prior to bidding. Otherwise every locker that ends with a lower bid, then the manager just pulls the locker? If that storage place is part of a larger chain then have the manager reported. Manager shouldn’t even be there once the units have been decided to be going up for auction. If th3 manager is also the facility owner, then I’d boycott his business.

Actually auction laws are the same in every state. An auctioneer has the right to pull an item all the way up until it's paid for! It very rarely happens, but usually it's in states that forbid the sellers from access to the unit before it's sold and also restrict the sales of certain items. In Texas it's pretty much open season. Only titled property is subject to lien holder release, but even then you can only get a salvage title. Then there's contraband of course. But some states will not permit you to take possession of any firearm at storage auctions and some won't let you assume the tittle of a vehicle unless the title passes an investigation and the name on the title matches the name on the storage unit....

I'd say it sounds illegal, because if it was legal, managers would jump in and stop bidding if they didn't think the unit was going for enough. I'd say this manager was unprepared for auction day and the auctioneer cut him so much slack he shouldn't have. It's a manager's duty to confirm no agreement and no payment has been processed before the auction begins- if the unit goes up, all the manager can do for the previous owners is apologize and tell them maybe they ought to have paid sooner if the stuff meant that much to them.

To save all the angst, had the manager said "$250" and the auctioneer accepted that as a bid, then that is the bid and the auction can then rise or fall on that amount. Under (Australian) law of Torts, the manager was out of order and anyone at the auction could (if they never wanted to be allowed back in there I would reckon) challenge him in court. This way it could be interpreted that he is going to sell the proceeds for himself. If I were there, I would check with the law and pursue it. Could be fun with all those people turning up in the courthouse to see the judges decision.

PULL a unit...yes. But set an unannounced minimum on a unit AFTER auction is underway? ...probably a very risky and legally expensive move. (I'm a retired Licensed and Bonded Auctioneer). NO WAY would I have done that....and I'd have to have an immediate legal pow-wow with that facilities manager...auctioneer was surprised by it, and the manager could cost that auctioneer his license, plus fines and possible jail time... Pretty serious stuff

And auctioneers have a Bond and/or state-mandated cash fund to pay out damages for these situations. I still say the auctioneer should pow-wow with that owner...or he should have set minimum bids. I will tell you another way to fix this storage facility so they can eat storage licker cleanup. You rent several units with a fictious name and pay cash. You then take all of your junk from the storage lockers you have purchased. You also fill these lockers with junk Trans scrap tires and just pure junk. You then don't pay the bill for the rest of the term. The storage lockers comes up fo sale and no one bids on them. Everyone attends the auction and let's the manager know that he should have never stopped the auction and informs him that it is going to cost an average of 500 dollars to take it to the dump. Remind him it's only money and he needs the storage. You need to have at least 10 or more units so he feels the pain. You can get more junk from Craigslist on the free site. Don't get mad. Get even. This is what is happening in our area because you have to pay 15 or more dollars to get rid of a TV. They rent a unit and dump their trash in it and it is cheaper than going to the dump.Im just saying.

They can pull the unit at any time.... should have included before the first bid... once the auction is started the only way it should be called off is with a "no sale" or when someone wins... the manager could then have approached the winner to negotiate a price for the chairs etc...

The chairs were not the managers property in the first place. He commandeered them without legal reason. Three courses of action 1, Take court action 2, Never attend another auction at this venue 3, Shut up and stop talking. Your choice.

The Manager is a thief. The auctioneer is not at fault. It reminds me of an auction I went to where the manager opened lockers and went through them before the auction and kept everything of value. Scammers big time.

I know of one storage unit mgr ./ owner that admitted to me he went thru every unit before an auction. He was a weasel.

What a super cool couple @OH90sVintage 😎. Those 'weird' shoes lol had me all 🤩🤩, they're pretty awesome. Cool finds in their 2nd unit too. I dont know the legal in's and out's but I've watched your videos long enough to know what the manager did is highly unethical and most probably illegal so I would certainly lay a complaint. Drama makes for great entertainment 🤭🤣🤣

This sale was absolutely illegal and can be prosecuted against the autioneer and the owner. This is a crime against the buying public. I buy plenty of lockers and know the rules and laws pretty well for most states as I buy from many locker companies in many different states. This is horrrrriiiiibb"lllle!

What the Hale$ is that guy thinking??!! Seems to me the owner is a little slimey when it comes to business ethics and lacks good business sense. Doesn't seem he has any concept that time is money. Guess he's ok with losing the money owed on the unit and any amount he'd could have recouped from the auction (who knows how high above 20 it might have gone) and his TIME. All to sell a used chair? I have a feeling he's either going to waste valuable time and money he could be making renting the unit, to sell some used furniture, not to mention the labor to clean it out or he'll pick thru it for what he wants to personally keep, like the "%&@%$ expensive chair" he mentioned and auction off the rest in another auction. Bad juju at that facility. No wonder the cars are haunted...lol. they dont wanna be there.

In the contracts I have signed in the past, if I remember correctly (and I am sure I do) they will state that all units that go into arrears will be auctioned off. Nothing is said about the manager being able to basically steal the unit.

That manager sounds like a place I had some things stored at. He tried to tell me I was late on payment and locked me out three times lucky for me I would keep the receipts on me so he was not able to steal it on me

IMO... _”Legal”_ = Yes 👍.... (Unit 2 of 6) for numerous reasons.... #1: The storage facility is a privately-owned business. Which basically means, they can do whatever they want. #2: There were no bids on the unit; hence no “contract” was in place between the facility & a Bidder. #3: The Manager stated he _”needed the locker”_ (in regards to starting the bidding at a lower price. A full unit without the rent being paid is lost revenue for the facility. *Now...* the whole shenanigans on Unit 6 of 6 is RIDICULOUS! 👎👎 On THIS one, there was already a bid of $10 accepted (whether its in their “Terms” or not to be able to pull a bid/stop the auction... that’s just poor business practice); therefore it should’ve continued on with the bidding. This (minimums, etc) should all be set _BEFORE_ the auction starts! This _really_ made the facility (Auctioneer & Manager) look _really_ unorganized, & unprofessional! Not to mention, I bet that Auctioneer is like What The Hale$!! towards that Manager.. it made him (the Auctioneer) look dumb. 😢

Oh Hale$ No! Even though the auctioneer accepted the bid of $20, he did say in the beginning that it could allegedly be pulled. But the manager, NOT an owner shouldn't be able to wave his magic wand when ever it suits him! Shady! He's going to sell that unit & pocket that $$$ illegally! Report him! Let the owner(s) know. I'm a licensed auctioneer in PA (AU005908) so Ohio law may be a bit different. However, what happened there was, at the very least, unethical. I feel like the manager knew what was in the locker before it was opened. If he can evaluate the value of the locker contents that quickly, he should be in a different business. My guess would be, that was his locker. The "minimum bid", or Reserve, should have been set before the auction started and the auctioneer should have been advised. Not faulting the auctioneer here, clearly he was blindsided by the manager and that could throw anyone off their game for a minute. I wish that auctioneer had just pulled down that door and had a "quiet" conversation with that manager. I hope that auctioneer has the good sense to never return to that facility. @22:11 after the bidding had already started and the option of pulling lockers should be done before any bidding starts. Here you have the manager going into the locker Breaking All the Rules in order to evaluate how much he wants for this Locker. This is a noteworthy point in this video to show any lawyer 50 manager is trying to inflate the bid

no it is not legal . once he has excepted a bid he can not stop the auction . the man that bid $20 legally owns that unit ... he stop the auction after excepting a bid and then changes the minimum bid, then he over rides the minimum bid and stops the auction ..in fact I think he has broken state and federal tax laws ... he most likely could be fined ..

In my area, the contents do not become property of the owners fully until a legal auction has been held, if a min $$ is placed on a unit it must be declared prior to start of auction, if no one buys it at auction then owners can dispose of as they see fit, including get to "storage wars" look through. every once in a while a facility will take good to decent finds in these units and hold a managers auction with just these to see if they can get some takers, trash is pulled out and managers auction the good pickings, 2-3 units can be combined this way, these have been known to bring in 3-5 hundred for the facility. but once an onsite auction starts managers has to sit back and watch the auction. the facility I oversee we had 2 units go for $10 each, someone paid 10 to clean out a unit full of trash, and the facility just gave them a couple extra days to do it, better than paying 2-3 people and a 30 yd trash bin.

Perfectly legal because of the terms he announced at the beginning of the sale. It's a lame move, but I have seen it happen before. If he did not have the caveat in the terms that stated a unit could be pulled at ANY time, then it would have been illegal.

@@KinseySwartz Nothing is final until the auctioneer says "sold" Now if he didn't state what he did in the beginning, and he DID state all bids are final and everything sells to the highest bidder regardless of price, then what he did was illegal. I can't fault the auctioneer. He got blindsided by that guy and didn't sell because that was the only option he had. I hope when that sale was over he told that guy to find a new auctioneer.

The storage facility doesn't get to make up laws to suit their needs. There are laws on the books to prevent what they did from happening. Although someone has to report them to get the law involved.

@boastfuls If it was advertised as an absolute auction you are 100% correct, The terms he stated before the start were that they had the right to pull any unit at any time,. So if it was advertised as a public auction, he can do it. If it was advertised as an absolute auction, he can not.

While it may seem wrong. Unless the auction was advertised as Absolutel which means everything goes no matter what the bid is, it’s legal. The owner of any auction item can decline the bid. If the owner had a minimum about he would take he should have had a reserve in place. The auctioneer would need to announce that was a reserve on the unit. But not what that amount is. This is a nationwide standard that all auctioneers must go by. Most auctioneers have protection for this in their contracts. The fact that the owner wasn’t getting what he needed to cover the back rent was BS because I’m sure he isn’t getting it on $20-100 locker sales. Each state has their laws as far as getting rid of unclaimed property. Some states require an auction others do not. I am an auctioneer. Hope this helps to explain

That owner needs to stop having auctions,let him take out his own trash. I'd never go there again!
