Ridiculous ruling. I don't believe for a second that the judge thought they could work together. The judge may have felt better not saying the plaintiff was out of luck about her money, but it was loud and clear even before the update. The plaintiff is a bit looney as shown when she 'demanded' the defendant come over and thread the machine. The defendant comes across as a liar and opportunist proclaiming it was a gift.

This is not a good ruling 😢 the woman said she was learning as a therapy. Meaning she had some trauma she was trying to work through. Now forcing her to stay in a very uncomfortable relationship is more trauma. She could have made the woman pay back what wasn’t used. I love this judge but she missed the mark on this one. I think she rushed through the reason the woman needed a hobby which she clearly said in the beginning was therapy

these 2 were liking the interaction of teacher student and in chatting they got closer and more started talking hypothetically when one said why not do your idea and we can do it together.I will help. Well no good deed goes unpunished. Be careful of those needy instant friends that glob onto you. It never turns out well. And the defendant knew it was a give and receive interaction.

This case Judge Milian was INCORRECT. The plaintiff did not prepay for classes but invested. How I know this?? because what customer gets a copy of the key to the business? If she gave the money to prepay, she would of never had a key. That is an investment into the business. Unfortunately, the plaintiff wined too much for too long that defendant was not allowed to present evidence of the investment.

I kinda agree. Nothing was going to be clean here, but this is exactly why courts usually don’t force specific performance in contracts cases, unless there real estate. The court would then likely have to also police a good faith attempt for both sides to complete the contract, knowing at least one party doesn’t want to be there.

And the judge gets paid and gets the attention to help these people with their issues no matter how small. It is small claims court duh. I don’t agree with her making them carry out the lessons. I think this is one of the situations where the plaintiff once they give someone money they’re mindset is “you have to do everything I say until it’s paid off” That instead of adding monetary interest on top of the $1400, the defendant being at her beck and call is the “interest”. The defendant probably didn’t like her new attitude and tried to keep it professional, but the plaintiff didn’t want to just keep it professional.
