Pretty sure in most states at least they still can’t do this until you finish high school. And afterwards they still have to give you a 30 day notice before they can actually make you leave.
@B345T1N355Official7 ай бұрын
They actually can take your stuff away as long as if they bought it because it would be considered a form of punishment. It’s the same thing with you driving recklessly or you assaulting someone. You drive recklessly and the government has the right to temporarily seize your car and take away your driver’s license. You assault someone and the government has the right to temporarily seize your firearms if you own any. A court would easily rule in favor of the parents when it comes to confiscating a kid’s cellphone or laptop or car keys if it’s proven the kid was abusing their usage of those.

In addition, once you turn 18 you become an adult family member, a licensee. In this case your parents cannot even kick you out, not even evict you, it requires an ejectment (at least here in NY State). On the flip side, a licensee is NOT a tenant, and while they can’t be kicked out, have no rights to a private apartment, private room, a bed, food, access to the refrigerator, etc. They do not have the right to hook their PlayStation to your TV, do not have the right to put their food in your refrigerator, have a bed in one of your rooms, etc. If you want to pack up all their stuff including their furniture and put it in the basement or garage and turn their bedroom into a guest room or home office you have that right. Unless they have a lease or rental agreement guaranteeing them their own bedroom then they are not legally entitled to it whatsoever. So in this case even after they are 18 you can still “take their stuff away”

Especially my mum, it felt like they were trying to financially control me. Thankfully they've dialled it back now. And no doubt if the property is destroyed what chance have you got in getting your parents to replace it? Since a minor can not own property or agree to contracts if a minor has money a parent or custodian is in charge of those assets or money. Since a parent is the custodian they can actually take and destroy property of a minor in their legal care if they deem it beneficial to that minor. This is because of a concept of Age of Majority. While a minor may be given or even buy assets or be in physical possession of cash they have no authority over it as a minor because they can not enter contracts or make decisions financially. So an adult that is a parent, guardian or conservator would be in charge of managing all assets until a minor can legally take possession. The only way a parent would lose authority over such assets is if they are specifically controlled through another parent or guardian or if it was managed through a trust or conservatorship that they do not control. Though they could still restrict access to those assets till they are an adult. In general a parent may have a fiduciary duty to take care of a child property or assets however they have a moral and ethical obligation to do what is best for the child and that may be contrary to that fiduciary duty making it possible to destroy assets if needed in their opinion for the welfare of that child.
