I saw a case where the man knew he wasn't the father but signed the birth certificate. Later on the relationship ended and he decided he didn't want to pay for a child that wasn't his. The judge said too bad. You may not be the biological father but you signed the birth certificate and claimed yourself as the father, you are the father. Imagine how the poor child felt.

Something like this happened to my sister and her miracle baby at 40. She tried to have the father of the baby put on the birth certificate. Her divorce hadn’t gone through yet. They wouldn’t let her. She had to wait till she was divorced. If she wanted to,she could have gotten her ex to pay child support. She won’t even accept it from the father of the baby. It’s not like he’s offered though 😂

When I was laid up for a while, I unfortunately started watching Maury Povich. On NUMEROUS occasions, the mother was 100% sure that the man was the father. On MORE THAN NUMEROUS occasions it turned out that he was not. The mother always seemed SHOCKED that she was wrong. It always made me day just a little bit brighter. ROFLMAO

Have seen conversations when various parties would say they had not been contacted. Yes, there was proof that there was a phone call or email, but it was not an attorney contacting the office, so it was not recorded as communication. Personally, was punished (made judge unhappy) when lawyer maintained that she did not receive an email from opposing lawyer. But opposing lawyer was able to prove that she responded to that email (so original was in the thread), so obviously she did receive it.

I (the mom) paid child support to my mother until 3 years after her death. Because she had temporary custody while I was serving in the army. The kids came home once I got out, but I still had to pay child support. And child support had all the info they figured that I paid over $230,000 in child support when I shouldn't have. But they don't return any of the monies paid if they made the mistake.

@@beebee_0136 I am sure. I thought there was a mistake myself. Turned out I basically had their house paid off. And it was a NY state and AZ state mixup of some kind. When one state would close it, the other picked it up. We lived in 2 different states, and that was the B.S. excuse they came up with. Think about this: if the mother had this issue with custody, what are all these fathers and non-fathers going through?

Not biologically speaking, just legally speaking, which is what you asked.. When the child was born, the mother declared him the father. He was served some kind of notice of that while in prison, but lacked resources or know-how, so he did nothing about it until 5 years later when he was on the outside, getting his wages garnished. The judge explained at his last hearing that his window of time to contest that closed 3 years after he was served notice, so the child became legally his. I'm not any kind of legal professional. I'm just explaining what the judge told him.

Because the legal definition is different from the biological definition. (Some fellows have been known to allow their name on the birth certificate of babies that aren't even theirs, making them the legal dad.) All that said, this is terrible. Poor guy. He knows he's not the bio dad, so he wasn't especially worried about filling out some papers in between prison stints. Hopefully, he'll get justice soon.

That's just wrong Who cares why it took so long, maybe he wanted to be the father, doesn't mean anything if he waited 5 years, let him challenge it and move on, I actually went through a paternity thing when I was locked up, found out a girl was pregnant before I went in and thought for 4 years I had a daughter, first time I seen her I knew she wasn't mine so I had to jump through the hoops, thankfully I got it all squared away pretty quickly

For the 2013 case, he was released on probation but violated probation after 4 months so was jailed June 2014. I just can’t find information about when he was released. The 2013 crime was home invasion. This guy goes by “La Capone Libbett” and his description sounds a bit sus. I’m surprised she wasn’t allowed to testify about when they were together to conceive the child.

@kismet7645 in the first hearing, what the man said was he was in prison all the time from 2013 to 2019, with no conjugal visits, and the baby born in 2016. He may be lying. He may have forgotten that he got a contact visit somehow. Otherwise, one of them has to be lying and know they are lying.

As a woman, I believe that any woman who commits paternity fraud should be charged by prosecutors and actually jailed for their lies. If they don’t know who the father is prior to DNA testing, that’s all they need to say. It would be much easier if every child was required to have DNA testing at the time of birth, similar to other required test which evaluate for potentially deadly or debilitating metabolic diseases. I’m always infuriated by the stories where the mother knows that a particular man isn’t the biological father, but because he is financially responsible she lies and says that he is. A few years later he somehow finds out that he isn’t the biological father, but has been providing financial support, usually through a child support order. In that situation, the mother should be charged and the accused father should be able to sue for restitution in the amount of support obtained via fraud perpetrated by the mother. Immediately any claim of paternity should be void. That seems to be the only fair outcome, but laws are against men in this situation because government officials don’t want to be forced to use taxpayer money to support the child. The mother should be the financially responsible party, not the government until she names the biological father and there is testing. At least in births which occur outside of marriage, DNA testing should be mandated and it would be reasonable across the board.
