Policing data xfer on the internet (esp outside of the web) can be problematic with regard to copyright protection through piracy. This is more a practical than legal issue (as it interfaces with privacy, encryption, steganography etc) That saying, legally, there are robust - many younger thinkers find overly robust - protections with regard to copyright term length for example. With something like youtube there is, of course, the raw amt of data and YT itself isn't a law enforcement agency - still, they have instituted a copyright infringement notice and takedown system (based on DMCA safe harbor law around indirect infringement ) unfortunately, this system can also be misused and even abused. Often in cases of abuse, which may even escalate to tortious interference through unfounded takedown requests., SLAP suits, and the like. We have seen a problem therein where de minimis, incidental, or even transformative use cases either through automated agents or bad faith actors are unduly constrained.

I understand you are still upset at the verdict, but to be frank, purposive transformation - yes even without mechanical transformation - has significant presence in the caselaw. Especially in parodic commentary where evoking the specific entity/source being commented upon, the use of source without modification has special impact (which is why parody vs satire are treated differently) This really isn't a case of _the oldsters don't understand_ as your allusion suggests. In litigation at least half the litigants are going to decry that there was a travesty of justice. You were just on the losing end and there was a body of law supporting that. You made a legal and tactical blunder; embarrassing to be sure, but I think admitting the mistake or at least disagreeing with the judgement WHILE recognizing there was basis is the more mature option in moving forward.

So...I'm an ancient nerd and just met Akilah through her book on the library app. I'm in A's mom's demographic. Her stories about Neopets triggered happy memories of playing Neopets and writing fantasy adventures online with my daughter. Those communities of sweet, adolescent millennials gave me so much hope for the future. I was sure they could solve the world's problems with intelligent, respectful discussion online.
