On March 13, 2020, a customer needed an oil change. He took his Jeep to the dealership and waited. During that wait, a 19-year-old employee got behind the wheel and released the clutch, killing a 40-year-old mechanic. Now, the Jeep owner is being sued.

My car just got repaired by a licensed mechanic shop, according to this lawsuit if one of the shop’s employees got hurt fixing my car - I’d be responsible? In what crazy upside-down world does this make sense? What legal theory supports this insanity? I feel bad for the guy that died, but this lawsuit is the very definition of frivolous.

It makes no sense at all, does that mean if someone steals your car and hits someone, that your responsible for what someone else did or didn't do? The family of the one that was killed needs to go after the dealership not some innocent customer. I could understand if the customer was driving, but dealerships don't allow customers in the garage for insurance purposes

@@willielarimer7170 No, the legal precedent the lawyer is trying to follow is that if you willingly hand your keys over to someone, you are responsible for any incidents involving your vehicle. The fact is, I don't think ANY jury will side with the plaintiff here, so the lawyer is trying to pitch it as the dealership will indemnify the customer if he is found liable. And if the dealership doesn't pay, there will be a lawsuit of epic proportions against that dealership brought by the Jeep's owner. This lawsuit shouldn't even exist, the insurance company should just pay up, and the kid who killed the guy should be the only one named on the lawsuit. There is no way on this planet any jury is going to think it is reasonable for EVERY person who ever goes to a car dealership to identify every mechanic who will work on their vehicle, see their valid driver's license, view their entire driving record, and past criminal record... before handing the dealership the keys.

@@tsuvtom7668 Does that really matter though? Jeep is the one that messed up here. They hired an inexperienced worker who negligently ran over a co-worker. Now, the JEEP dealership is trying to have a customer of theirs pay for damages. JEEP did nothing wrong in their own eyes. It's a workplace hazard apparently at Jeep dealerships to be randomly run-over by your teenage co-workers that management hired to cut costs. Saved a bunch on this one Jeep! What a special way to treat customers! Watch out, im sure it's in the fine print that they aren't liable for killing their customers either!

According to the lawyer, Jeep is protected and he couldn't go after them. Perhaps the owner of the Jeep has a lot of money and the lawyer is trying to throw mud to see if it sticks.

The first mistake is the dealership had no business hiring a kid without a license, as on occasion this employee would have to drive cars around the business lot, and inside the oil change area. The 19 year old had no knowledge of how to operate a manual transmission, caused a fatality and should be charged with manslaughter, and should have been taken into custody on scene. At this point, the 19 year old should have no defense at all, except a plea bargain for sentencing time. The idea that this spawned a law suit on the owner of the Jeep is ridiculous! The owner dropped his Jeep off at a legitimate dealership, and when the keys were given to the dealership, it's their responsibility!

@@tsuvtom7668 he has to operate under a law technicality that was probably written by car dealers lobby with big bucks to a lot of politicians. Fortunately there will be at least two more insurance company lawyer groups in this situation to determine final accountability. It actually should become a jury trial that places liability on the source of the event, and it's not the vehicle owner.

Must be the millions and millions of lobby dollars spent at state and national level by various vehicle dealers associations. Another big business group obviously writing the laws and representatives concurring to please their donors. If this went up to current SCOTUS they would probably rule against the car owner also since a mega-corporation is involved.

Dealership's fault for hiring someone who doesn't understand manual transmissions. I feel for the guy, and I want to say he didn't know what he was dong, but he knew enough to push the clutch in to start a manual transmission. He could have put it in neutral with the parking brake on. I think he just made a bad decision.

I knew that much. (And later learned to drive “stick.”) At 12-13, we engaged the clutch to back the truck down the driveway to play basketball all the time.

I just read up on the outcome. That lawyer sued the Jeep owner for $15 million. Later, the dealership agreed to settle for an undisclosed amount. Nothing ended up happening to the Jeep owner. Case closed.

Did the owner have to hire an attorney? I’m guessing the insurance company will only cover up to the limits of the policy and the insured must represent themselves for the remainder of the amount sued. Who paid for that? Unbelievable.

I mean its literally in the Bill of Rights of the Constitution to be able to sue anyone you want for anything. For cases like this, the attorney himself who filed the absurd lawsuit should have to pay the defendant's legal fees. Just seems crazy to me that the Jeep owner here has to pay out of his own pocket for legal representation, when EVERYONE knows that no jury in the world will find the Jeep owner liable for negligence. So stupid.

The lawyer says, "If you hand your keys over to anyone, you'd better be able to trust that person." So if you can't take your car to a dealer and trust them with it, what are you supposed to do? The car owner needs to sue the car company since the dealers they sell vehicles through apparently can't be trusted.

These days and with the absurd way our legal system works, it isn't about anything but the mere possibility that a suit CAN be filed regardless of actual culpability. The lawyers are nasty enough to try just because of a potential payday. Reform is unlikely because the entire judicial system is comprised of the legal profession. A profession, like any other, to make money. Lots of legislators are also lawyers, part of the same club, so the odds of creating a more equitable system are stacked against you and me.

I hope the courts see right through this fraud case. Customers are not allowed on the mechanic shop for insurance reasons. When the shop hires someone they are supposedly hiring a competent person. I hope the owner sues them for the stress and attorney fees. When you leave your vehicle with a trained mechanic there is a responsibility of responsibility with the shop. If the shop damages the vehicle then the shop is responsible. The family of the man killed should be getting workers comp for life.

Well the kid knew SOMETHING about driving a stick since he knew how to crank it up. If you've "never" driven one before then you likely wont know that you have to push the clutch in for it to start.

years ago, a friend of mine had a stock jeep that would start as well if the transmission was in neutral. So maybe he didn't have to, or yes, maybe the vehicle was already running.

i read he had to push the clutch to start it, but what he missed was it was in gear, likely as a brake. not like the owner drove it onto the lift and left it in gear...this type of lawsuit pisses me off a lot and im 6 hours drive away

You are one disgraceful lawyer going after a totally innocent owner of the vehicle. You should be ashamed of yourself. Any attorney that goes after the owner of a vehicle if the mechanic gets hurt should be disbarred from law altogether. The owners of the shop or dealership should be held responsible. I'm curious to what are they're suing the owner for? Like bringing the car in 100miles over the scheduled oil change or for buying a stick shift instead of a standard automatic? And they should be able to sue the dealership insurance company if not the dealership. The dealership hired a guy to operate a vehicle that he was not allowed to operate.

This is happening because of Michigan's no-fault insurance laws. Because of how automobile insurance works in MI, it;s a way easier win for them to sue the owner of the car than the people who are actually resposible for this tradgedy.

@@Saiko8096 They are suing the owner because in MI automobile insurance is "no fault". So that means when there is an accident, even if you are NOT at fault, you are liable. So YOUR insurance pays, even if the accident is caused by someone else. In this case, the slimy lawyer is simply suing the owner of the car (and by extension his insurance company) because he sees it as an easier win. This lawsuit is a direct result of Michigan auto insurance laws.

Their choice was greed over health of consumers. This case is blatant hiring practice failures, training failures, and complete nonsense not being able to sue an employer for negligence.

Couple of comments. 1)The lawyer trying to get sympathy because a kid will grow up without his dad. Dude. YOU'RE SUING THE WRONG PERSON. So yeah, your attempt at sympathy was in poor taste. 2)The law involved here isn't workers comp or the fact that it was workers at a dealership. the law that's causing this travesty is Michigans "no fault" automobile insureance laws. The lawyer COULD sue the dealership. The REASON he's suing the owner? Because he expects the insurance company to pay, and feels it's an easier win. Guess the moral of the story is to cancel your insurance in Michigan when you have your oil changed.

Typical stealership and shady lawyers. I had a buddy who brought his car in for repairs at a Chevy dealer and left it overnight. The next day he gets a call telling him that the dealership has lost his car and they’re not responsible for anything that happens to it. Luckily the GM saw police was getting involved and immediately compensated him with a market value check. We had no doubt the GM was somehow involved.

thats interesting the police got involved instead of saying its a civil matter. a business stole my pc and ignored my calls. i had a girl call up there to set an appointment since company wouldn't take my calls. i show up and the company calls police and police come trespass me. told me he doesnt want me here, i said what about my pc he stole. cop says thats a civil matter, take it to court

So an employee that the dealership hired ran someone over because they didn't know how to drive a manual transmission jeep, and that somehow makes the owner liable? That's insane they shouldn't be letting people work there that don't know how to drive. If they can't sue the dealership the employee that fatally struck the other employee because of his incompetence should be sued for negligence.

Had the same group of people to work with that didn't know how to drive a stick. I was only 1 of 4 that could. The dealership is responsible not the owner of the vehicle. The vehicle owner should be compensated for the emotional distress caused by the a hole attorney. What a fd up country we live in.

Massachusetts has an excellent law!! When you go for any type of service,you can remove your license plates,and the dealer has to use Repair plates after you do this. This protects the car owner from any liability and puts the liability on the repair facility.

The 19 year old couldn't drive a stick shift? The dealership should have known better since most dealerships have a hard time finding a manual transmission is almost impossible and most of them don't even sell them anymore.

I honestly hope that the owner of the car doesn’t lose this battle because it’s not his fault. This is absolutely absurd. This kid killed somebody and he should be in jail. This kid should not have been behind the wheel. He should not have even been around cars and now he kill somebody in the law saved and protects him?! This is absolutely disgusting I hope and pray that the jury sees beyond a reasonable doubt that the owner had nothing to do with this doesn’t get sued and somehow I pray they find a way to put this kid that did all this in jail for life

there is no way the jeep owner is responsible for anything. its was a accident but the dealer shouldn't have let him even start the jeep if he cant drive one. next they will sue the man that died because he was standing in front of the jeep. or sue jeep for building something with a strong enough front end that it could kill someone. or sue the person who put the front bumper one. then sue the company that made the tool to put the front bumper one. then sue the people that made the bumper. then sue the people that made the metal to make the bumper.
