It’s interesting that other indie makeup brands (I.E. Give Me Glow, JD Cosmetics, Sydney Grace, etc.) are killing it even during Covid and releasing products pretty consistently. However, Makeup Geek is closing. Marlena was able to get her products in Target but I guess it wasn’t enough.

The Australian Therapeutic Goods Administration is like the FDA. Sunscreens are considered drugs. The Aust government has very strict rules about sunscreens and therefore have some of the most protective sunscreens in the world. Australia even provides free sunscreen and "sunscreen breaks" in some public schools depending on state/area. Most kids wear sunhats at school. It's a different culture.

Sunscreen is very heavily regulated here in Australia. There’s a reason why our sunscreens are so revered and are of excellent quality at a very reasonable price. It is a drug and we have shockingly high rates of skin cancer unfortunately. I don’t think anyone other than a chemist or doctor should be commenting on the efficacy of sunscreen.

JEN! I really love the new progression and new implementations of your makeup news (what's up in makeup) videos. For example, I love the PR or purchased segment, as well as the artist shout out at the end. I also love that you (as well as many others) seem to be only buying the items you truly have an interest in rather than the mad rush to buy every new launch like in years past. This makes me feel so much more relatable to you, as well as other content creators. And lastly, I love how your news-style videos feel a lot more personal now. I know you implemented these changes a while ago but, because of makeup burnout over the past 3 years, I've just now started to jump back into makeup content. Thank you for being such a cozy "coffee shop" place for me to chill and easily digest makeup news.

I agree with the new Australian law. You never know if an influencers’ opinion is genuine or not, and the script can always be changed to work with the law. Jen’s example of white cast could be changed from ‘I didn’t experience any white cast’ to simply no white cast in the list of benefits. I’ve never personally liked seeing promotions for necessities; we should be pressuring the pharmaceutical companies to meet our needs instead of looking to luxury brands.

The Australian regulations seems to be specifically targeting unscientific medical claims, which makes sense in terms of not allowing personal or anecdotal experience to be shared that makes products sound like miracles when not everyone will experience those same results. Proven scientific facts like SPF preventing skin cancer are probably still going to be fair to share.

On influencers in Australia, I think it is good because they might influence other consumers to purchase sunscreens that are not necessarily good just because they are paid to promote them. And because it is a crucial product to protect your skin, I see it as a good thing that viewers won't potentially get misleading reviews from potentially dishonest influencers.

In Australia, therapeutic goods are strictly regulated (much more so than in the US) - that regulation extends to their promotion and advertising. The TGA Advertising Code is a legal instrument and has the force of law. The Advertising Code referred to by Jen has already been in place on a voluntary basis since 1 July 2021, while a 12 month transition period takes place from the previous Advertising Code. It should be noted that the previous Code also applied to influencers and brand / product ambassadors - the updated Code makes it clearer what they can and can’t do in relation to the promotion of therapeutic goods. There is also a clear legal definition of therapeutic goods in Australia (which as a category of products is more broadly defined than in the US from what I can tell) - I know Jen was a bit puzzled by the summary in what looked to be a media release.

Wow just yesterday I was thinking how oversaturated the makeup and skincare market has become, everyone is launching a brand and wondering when the mass closures of these brands would begin as its not sustainable for most. Makeup Geek actually came to mind first even though the idea was sparked by newer brands, simply you don't hear about them anymore and at least where I live they don't exist in stores. Sad, I wish her well.

Just adding my two cents about influencers doing paid promotions. To your point about the importance of having consumer reviews on sunscreen, i absolutely agree! But influencers aren't being told they can't review sunscreens, just that they can't give paid reviews. Meaning the incentive to gloss over negatives has been removed. Also, Australia has some of the highest skin cancer rates in the world so they probably want to be sure that bad products aren't getting recommended because the company paid enough influencers.

The fact that John Dempsey was making $10 million a year at Estée Lauder tells us everything we need to know about cosmetic industry markup. They are paying all their C-suite execs like that. Think about it. That’s an incredible top tier payroll and then all of the company’s other expenses and then turning a profit year after year. I will miss MakeUp Geek Cosmetics. I’ve been watching Marlena pretty much since day one when she was living in Michigan married to her first hubby and doing makeup videos in front of a window. She was the first self made brand to come out of this space. She’s been very transparent with her life and has taken us on her journey. I look forward to watching her next adventure. 😍🤗

To understand the TGA, it is important to look at it in the context of advertising laws in Australia. Essentially, if an item is governed by the TGA, I imagine it will be a part of these revised laws. It isn't new, it just legislates to include an area of advertising that wasn't conceived of when the original laws were written. For instance, it has always been illegal to advertise some medications directly to the public or to price promote S3's. This just brings influencers into line with the rest of the advertising community. I suspect that if you want to know what is included, it will be anything regulated by the TGA. The consequences are probably large fines at this stage; which is also the consequence for other industries. However, as these fines will be borne by individuals, as opposed to companies, they may be quite onerous.

Australia has much stronger laws on SPFs because the UV rays are stronger there and there is a very present threat from sun damage, heat stroke, melanoma, etc. I understand they don’t want influencers giving opinions on how well SPF works because they might be misleading about how well they work or even how to use SPF as instructed on the bottle. It is consumer health protection

I think for Australia *sunscreens* are exactly the type of products at issue. That country knows it is at added risk and unlike USA has a very updated, while inclusive, regulation database. The recent benzene catastrophe had to have been a real blow to many there. Think of how any influencer who said one of those worked for them really impacted their citizenry's trust in the entire product group. Not good. Especially when people of color and first peoples are especially targeted and susceptible to being preyed upon in that genre. For many reasons you yourself noted. Also they are the least represented in safety testing. I personally know what a struggle that continues to be. I can't tell you how irritated I get, and irresponsible I find it, when I see claims that anything above SPF 35 is fake. Or that more melinated skins do not need sunscreen. Some people will take that as gospel without finding out the truth in regards to their individualized needs. This channel is different but you do not reach everyone unfortunately. Best wishes always. 💚ive 🤗

Minis/travels are excluded, as are many standard brands (Aveeno, CeraVe, C&C, Curel, Gold Bond, Jergens, J&J, Neutrogena, Ulta brands, and clearance). Haircare is included at 20% with few exclusions, and Suncare is 15% off with few exclusions.

About Australian regulations: it's the opposite, it's so there are no cases when an influencer says something like "I didn't like this one because makes my makeup move, or feels heavy on my skin" so that someone who is not familiar with sunscreen would not have a bad impression and prejudice againt using it

I was stunned and saddened by Marlena's announcement. I've been following her since the very beginning, and have loved her eye shadows and blushes. Her new mascara is very good too. I think that the issue of brands raising prices ($1 each for the elf ones...not that much), is very much related to the fallout of Covid. The shutdowns stopped production, and since then, supplies have been hard to come by I'm sure, what with the shipping container issues, personnel, etc. And, my brain just stopped. I think the new australian regulations are great. Especially because there is no way we can attest to the efficacy of said products in a controlled environment, removing the placebo effects in discourse.

Everything is going to be so expensive no one is going to buy anything unless it's a necessity.... Gas is crazy and I'm honestly thinking about walking to work... It will add hours to my day I don't have but the money insanity on top of everything.....ugh!

So long as the Australian government specifies which products fall under their laws, I think it’s probably a good thing. Paid promotion is basically a commercial regardless of an influencer’s personal opinion or experience. So for products that are classified as medicines or otherwise more stringently regulated, it makes sense to me to treat the influencers like commercial actors. I guess we’ll see how it’s implemented and whether it works in practice rather than just theory 🤷🏻‍♀️

you might not be aware but re the nails Coca Cola collab, a lot of people are boycotting Coca Cola products as they refused to pull out of trading in Russia. There seems to be a question over whether they eventually pulled out due to overwhelming pressure (i.e. once this was publicised) but obviously that's shameful, and many are still stopping buying or promoting their products.

I'm sad about MUG. They were always a "brand I wanna try some day" and I never got around to it, so when I saw Marlena's video, I did my first order. I usually don't order from a brand that is closing down (out of fear of loving a product I'll never get to repurchase) but since I had been wanting to try it for so long, I went for it. I ended up getting the Matrix palettes and some of the foiled shadows. I felt a bit clueless on the site and had no idea what to get lol The shipping to Australia was pretty steep though...

I don't get the concealer shaded colour correctors. Then again, I use pale green and Lavender correctors when I have to do correction, so I guess this is more a conceal correction?

I get the price increase but elf has already raised prices ...camo concealer was 5 at launch. It is now 6. Drugstores we're always more expensive. The primer balms we're 6 at launch now 8 and the new one is 9. The brow pencil was 2 now 3 but they say they aren't upping the price.

Correct me if I'm wrong, i thought any chemical sunscreen doesn't leave a white cast. Only mineral sunscreens leave a white cast, or a sunscreen with a mix of chemical/mineral. Soooooo if that's correct there are/were hundreds of only chemical sunscreens that she could have used to avoid sunburn.

Jen, correct me if I have it wrong, but it sounds like Australian influencers are welcome to talk about their experience with products all they want, as long as they’re not being paid for it. It sounds to me like Australia is just trying to draw a dividing line between influencing and advertising.

Pat McGrath cares so much about the name Divine that I thought her Barbie would call Divine Barbie 🤣🤣🤣 But that’s really upsetting because more and more it’s hard to find a brand that really mind their own business and let people alone. I’m really her fan and love her pallet and blushes, but if she keeps doing that I will stop to purchase from her.
