This is why I think John Walker was justified with the Nico situation. 1. Flag Smasher are terrorist with a super-soldier serum they would be always armed, as they could easily kill anyone who’s not superhuman. 2. Nico didn't surrender, he said it wasn't him who killed Battlestar. Nico kept his hands raised in a defensive position, if you want to surrender put them over or behind your head. This was also just after Nico appemptet 2 times trying to get up to fight John. 3. Nico just partook in an attempted murder on John Walker. Nico was holding John while Karli was trying to kill John. 4. All in the flag smahers partook in the murder of Lemar, legaly they would all be held responsible for it as a group. 5. Nico was endangering civilians, that concrete he threw at Walker while running would have hit those 2 ladies walking in the background if Walker hadn't stopped the concrete.

6. "Good becomes great, bad becomes worse” John is a man with some serious trauma, that trauma was exaggerated by the super soldier serum. Making his worst traits the dominant ones. The fact that John did the right thing in the end spoke to his character.

The guy John killed was the same guy who had him in a rear double armlock so that John could get stabbed to death by Karli. Lamar prevented this at the cost of his life. How many decent people would have reacted differently? I think more decent people than not would’ve smashed this guy too. Regardless of the moral dilemma, we definitely got a winning performance acting-wise!

Not only that, but heat of the moment aside, John was still justified in acting the way he did. Nico was guilty of murder, and they were in a combat situation, Nico also launched a huge concrete trash bin at John like 5 seconds before he decapitated him, literally putting him and innocent bystanders lives in danger. And Nico didn't surrender, which is the key thing here. He put up his hands and said "it wasn't me, it wasn't me". That is NOT surrendering. That's stalling. Dude was trying to get John to hesitate so he could create an opening and either fight back or run.

I definitely believe marvel should grow up with their audience. Seriously, imagine a Dark Avengers or Thunderbolt film/series in the style of the Boys. Him thinking his powers gave him the right to decide where when and how to deploy the avengers is abusing them with good intentions. Him thinking he should have complete atonomy from the world goverments was the direct cause of those deaths in that the civl war movie, and guess what in the comics he even comes to relieze he had become the villian in it and surrenedered.
