This trial has really shown the difference between actual expert witnesses and people who think they are expert witnesses. Edit :) my opinion has become that they reflect poorly on the lawyers, who lets face it are not good. Presumably these are experts they chose, specifically because of their unethical and unprofessional 'flexible' approach to the truth.

He has 42 years of expertise in the digital sector and has shot videos from helicopters for 14,700 hours. Depp’s team got the single most experienced certified forensic expert in the World to testify that Heard’s team sent him screen grabs and not pictures that came from the camera on her iPhone. She didn’t want an expert to be able to prove just how many edited photos she had on her phone. ( BTW the screen grab pics came from the phone that Depp supposedly threw off their balcony and destroyed and she said in her deposition that her photos weren’t available as she’d run out of space on her cloud. Yet she was able to provide old screen grabs to Neumeister.) She underestimated this expert. He is incredibly skilled at what he does. 😊

As someone with a masters in computer science with a focus on computer graphics, that line of questioning was absolutely infuriating. The expert was 100% correct in that the lawyer was NOT asking as yes or no question. It was malformed, for starters, and secondly, because there is no way to verify which, if any, photo is undoctored, you cannot verify the authenticity of any of them. You cannot say one way or the other, the answer is literally in the middle of yes and no.
@TheArrowedKnee2 жыл бұрын
I don't have a masters, but just about to complete my Bacheror's this semester, and likewise i was growing increasingly frustrated about the line of questioning. It was clear the lawyer had no idea what he was even asking. @@cerebrosalphanite5146 Well, i'm not gonna pretend i'm a computer forensics expert, but from what i gather, that would mean could say with a larger *likelyhood* whether something was authetic or not, but i believe it could still be *technically* possible to alter something. Of course, it'd probably be much more involved and difficult since you'd likely need to alter the logs of the operating system itself etc, but as i said, *technically* possible. It's just the nature of anything digital really. But then of course, you come in to the realm of reasonable certainty. If the client doesn’t tell the truth, then legally they can spin any story that will help the client win. Heck some people tell all to their lawyer. There job isn’t to tell on the person they are defending, it’s to create their clients defense to win. Unless they have concrete evidence a lawyer can spin a story to make their client look like a saint. Nearly all guilty people go in to court with a made up story. This is one of the reasons lawyers advise the guilty not to testify, because if they find you guilty they can then charge you with perjury. Not to mention it’s not easy to remember exactly details of a fraudulent story and a good lawyer will dig in to small details just to prove the story isn’t true.

AH's lawyer made a mistake when he changed his question from "you found no evidence ..... did you ?" (29:43) to "you found no evidence .... correct ?" (30:06) And the witness is sharp enough to notice that difference at the end, which allows him to confidently say "that is incorrect" rather than "yes"/"no" ... The difference in implications between "correct/incorrect" VS "yes/no" are huge... "Incorrect" means its incorrect to assume there is no evidence that someone edited the photos, because thats still a likely reason why the exif datas are different. Which is precisely what he is trying to tell the jury ...

@@mdb45424 I was shocked. His expert opinion matters. Forcing him to choose an answer going against his opinion was wrong. I think the judge was awesome but it doesn't mean infallible. There were so many cases of various witnesses trying to get in extra information or their own narrative, maybe this seemed like yet another. But I still think it is wrong to try to force someone under oath to choose an inaccurate answer. Later it could be seen as a lie. Not perjury but enough to make the jury think he lied or wasn't a good expert . "You said 'No' to this question, now you are saying you won't answer?" "Now you are saying you can't answer".

As someone who is currently studying computer science I’ve really enjoyed hearing this guys testimony and was actually waiting for this to happen. It’s so frustrating to hear this lawyer try to manipulate his answers. CS is a very complex topic and any proper answer to a question requires a certain amount of extra explanation, especially if the person you are talking to has no background in the field. Also in regards to his questions regarding his degrees or lack of degrees, a large number of people working in the field of CS don’t actually have a formal degree but still have the same or at least comparable level of knowledge as someone who does

I've done criminal digital forensic work before, and it's so satisfying being able to look at the finest details of files and see how they reveal so much. A *lot* of people think you can hide things in the digital world, and the truth is you can't. At least, not easily. When you submit files to a team for a court case, there's virtually nothing that can't be found with enough scrutiny.

The jury is going to completely disregard Amber’s attorneys examination of the photo witness. It’s totally obvious that he’s trying too desperately, and is clearly in a total panic. He thought he could frame a question in a way which would cause the expert to say “no, I didn’t find issues in the pics”, but they weren’t pics, they were screenshots - which were probably taken after they had finished altering them in photoshop. I truly believe they did that on purpose - in attempt to block the rabbit trail.

So, in conclusion, Amber and her lawyers are: 1. using evidently and demonstrably forged evidence. 2. taking evidence out of context to make it appear supportive of Amber's case. 3. calling in paid expert witnesses who are misrepresenting correlation as causation. 4. calling in paid expert witnesses whose work is evidently and demonstrably not meeting ethical and professional standards. 5. deliberately attempting to misrepresent statements and shut down attempts at elaboration from witnesses during cross-examination because the truth doesn't benefit them. 6. repeatedly asking leading questions and, following an objection, rewording their question with the witness now having been prompted with what answer they should give. 7. trying to discredit witnesses who say something they don't like, not by pointing out the flaws in their arguments or methodology (because they generally can't find any), but by smearing their character. (Thanks GhostofPaulWalker for pointing that out). 8. trying to frame all of the above as indisputable evidence in favor of Amber when all of it falls apart under the slightest scrutiny. Meanwhile, Johnny's team is providing dozens of independent and unchallenged testimonies as well as demonstrably true evidence in support of his case. With only 1 hour left, the only way I see Amber's team proving she was abused is if they've got a slew of video recordings of Johnny violently assaulting Amber on several occasions up their sleeve.

If you are an abuse victim you have no need to edit photos of your injuries. While I am all for justice for Johnny I must note that the only reason he has this chance is because he has the platform to do it. Many victims go unheard because they are silenced and cannot afford a good legal team. The system is broken and needs to be changed for good. It’s more about money than it is about justice which helps nobody but those with power. Legal teams get lazy and do whatever is going to get them more money with less work. The first witness concerning the pictures has no degree because he literally wrote the book and trains the DOJ, DOD, etc. The last witness was the TSA agent from the airport that arrested AH in the airport. That's how she remembered who she was. She was held overnight in jail and Tasya refused to press charges. So, at her arraignment, the judge let her go on the condition that if she was arrested again for the same charge, that incident would be enforced. AH claimed she was homophobic, but she was head of the LGBTQ rights division in her area at that time. She used her phone to testify. I've been binge watching the trial after the Cannes film festival and Jeff Beck tribute concert. Johnny looked so healthy, better than I've seen for a long time. ❤😊
