I think foundationally the evidence is corrupted. There is no denying it. She may well even be guilty but I dont believe anyone can be convicted with such a botched investigation from the outset. Judge Canone has shown time & time again throughout this case she is overtly biased in favour of the prosecution. She is unprofessional in her tone towards the defence. She is, at least, borderline corrupt if not out and out corrupt. How many times did she remind Lally in the 1st trial & Brennan in the Daubert hearing to object! That is not her job. She has been putting her thumb heavily on the scale throughout.

@@moey.10 No. They're not doing it for two reasons. First because he's a member of the government's investigative team that is assigned to a position in an accident reconstruction unit. He's automatically going to be qualified as an expert by the court regardless of how incompetent he actually is at doing that job. Secondly Daubert motions in general are a desperation move and good attorneys generally don't bother with them unless it's absolutely necessary, because their trial prep time is far too valuable to waste on arguing motions and having hearings on things you have no real expectation that you're possibly going to prevail on. The average layperson understands the concepts at hand better than Trooper Paul does, and it's clear that he's an idiot. His testimony in the first trial was relatively brief in comparison to the other witnesses and there isn't really much else they could get into with him. Whatever stories he wants to conjure up in his direct are easily dealt with on cross. Having said that I wouldn't count on Trooper Paul even being a witness in the new trial. The new prosecutor is just as slimy as Lally was, but he's not nearly as stupid. If he wants any chance of actually getting a guilty verdict in the case he's going to want to replace all the "experts" they used in the first trial with actual experts.

I’ve never seen a judge do this. She says it’s a 5-part test (good so far). She then explains how the witness meets all 5 parts of the test (okay). She does not explain why any of the 5 parts is a close call. But the motion as a whole somehow still is. Then she says the CW has “demonstrated” several things, all of which are in dispute and all of which are properly questions for the jury. WTH?

Infuriating. Why mention that she didn’t look at the dog’s dental records? She never claimed to be an expert at matching dogs to dog bites. It’s doesn’t matter what dog may have bitten her. The point is there’s doubt about the wounds being made by a vehicle. I used to think prosecutors wanted justice. I can’t understand the logic of getting a mold of Chloe. Also, the swabs of JOK shirt are pointless IMO. They should have swabbed his arm lacerations. Not fabric. Makes zero sense.

@ yes it is. It’s the role of the judge to decide what is and isn’t allowed in court, as stated by law. The prosecution brought the case, but she allowed it despite it being against the constitution to try someone twice for the same crime once they have been found not guilty. Which kr clearly was. And that’s without including the fact that Bev was responsible for designing and allowing such a jury form in the first place.

Unfortunately you’re not alone in the USA, we in England have our fair share of- look how we treated Johnny Depp. At least you have properly open trials, often televised or on KZbin, ours are much more private with you having to be physically present - please protect that you don’t know how lucky you are. At this point I think the only thing to have done is to poll the jury and find her not guilty of the first two charges and drop the last due to a bungled investigation and tamperered evidence. Karen Read could have done it, but the investigation so corrupt and witnesses and events surrounding it so shady the prosecution team and police might better spend their time evaluating what went wrong and retraining their staff.

This expert can diagnose and treat a dog bite for any person who visits the E.R. Why should it differ in a court, as far as I know, there is no suggestion that the doctor here is going to attempt to match the bite wound, to the dog?

Prior to the first trial- they did file a motion to recuse. She denied it of course. She has been rotated out of this court but continues to remain in charge of this case. She has transferred all of her other cases except this one. Her excuse as to one of the money transfers from Julie Nagel to someone (memo said Beverly and Frank beach house) she said that it could not have been her because that person spelled her name wrong. BTW- her husband’s name IS Frank and they do own a house at the cape! If you go back and watch the pretrial hearings(Melanie Little has them on her channel) you can see all of the “issues” or appearance of bias the defense brought up to her including the one I mentioned.

If I remember correctly in the first trial in pretrial when the defense asked her to recuse herself and she said no the defense stated they were not going appeal at that time. Well Auntie Bev loves to point out this is a new trial. The defense could ask again and WHEN she says no they could appeal. All of that takes money and she is allowing the cw to bleed Karen Read dry with frivolous motions that they have to defend. It also take focus off of the defense being able to prepare for actual trial.

In my humble opinion, this witness, this expert witness, is also qualified to say, whether or not the injuries are consistent with the act of a car hitting the deceased. Her experience clearly makes her an expert in several deals of interest.😊

That final paragraph makes me think Bev was leaning towards granting the prosecution's motion until Alessi did such a good job arguing against it. There was no lawful order to exclude it, but Bev still had these doubts Brennan raised, so she didn't want to let it go. At best, it was highly unprofessional as a judge, and biased against Karen Read's case at worse. She's obligated to be neutral, she's not supposed to state her opinions

Bev ain't having no doubts- she knows damn well Dr Russel is overqualified to testify. The only thing raised is fear- fear that Karen will be acquitted and the state will look like the foolish clowns they are-And there will never be justice because this is just like the Steven Avery case in Wisconsin- TOO many evil, narcissistic, egotistical investigators, prosecutors and judges.

Great commentary as always! As an aside, one point that keeps being missed is that in the first trial, it was drawn out that while there was no dog DNA on the tested sample, there were three mechanisms in the testing process that would have inhibited the presence of dog DNA. Plainly, there might still be dog DNA but because of the chemical reagents, it might have given a false negative.

TV shows make people think there's always dna when it would be logical for dna to be there, but thats unfortunately just not the case.

I disagree. As a critical care RN she is a doc i would never wanna work with. She's arrogant, and pig headed, refusing to admit other views as being legit. She is no expert, and the Judge is allowing her to testify, and mentioning the shortcomings of Russell she was in fact sending the defense a warning about her testimony. An expert would consider any other scenario when presented with it, not Russell, she is so arrogant and is unable to consider other possibilities.

Her brother got Chris Albert (pros witness) off charges of a fatal hit and run and her mother worked with the DA under investigation by the FBI for this case for over a decade.

@@4MAGAyou are mixing up two separate cases. Paul O'Keefe was involved in a DUI leaving an elderly man with disabilities. Judge not involved in this case. The judge's brother represented Chris Albert (brother of Brian and father of Colin) in a DUI resulting in a man's death. He only served 6 months

I was so worried she wouldn't be let in! Thank goodness! It seems like complete shade thrown to me, but laying out the weaker points is a good heads up for the defense, I would imagine. They can shore up the weak areas and also address, as you mentioned, the fact that sample collection was corrupted every step of the way in the chain of protocol.

Dr. Russell had to be able to identify hundreds or thousands of dog bites BEFORE she could treat them. Cononne’s write up in the Motion misses the obvious. As far as dog DNA on John’s clothing, it was pig DNA probably transmitted by a dog who had eaten a chew possibly containing pig product and leaving some particles in the dog’s saliva. However, Dr. Russell stipulated that the round tears in the sleeve were caused by dog’s teeth. Two plus two equals four. Also at the Dauber hearing, Brennan indicated the sweater holes could have come from “shattered glass. A) I believe there was no shattered glass and B) this required a side bar to clarify there could only be plastic from the broken tail light. This too is false as the police had not had the time to break the light cover and plant the plastic in the snow. Slim to zero chance this is what caused the holes. I often sense that Judge Connone likes to pat her boys on the head so they don’t feel bad while on the stand. She did this countless of times with the Canton residents brought in to testify. Either she’s trying to win a popularity contest so she can keep her job or she’s influencing the jury with the hope they will vote against Karen Read. Possibly both. In either case, her behavior regularly reflects her lack of understanding of how to conduct a fair trial. She’s been on the bench working with the same cast of characters for way too long. She and Lally can finish each other’s sentences. In the meantime, the truth needs to come out and she needs to stop the coddling. I was very irritated they did not put another judge on the bench to replace her.

I think this was a way for State to see what Dr. Russell Is going to say at the trial. The State knew that she would be allowed in but this was there tactic for see her testimony. They are doing the same for the other pretrial motions for other defence witnesses. Slippery move!

She's helping Brennan like she helped Lally, "Do you have an objection, Mr. Lally?" Cannone is invested in Karen Read being found guilty. Brennan, who is usually a defense lawyer, knows he's got a steep hill to climb eliminating reasonable doubt.

I think the reason why the dog bites are important to the defense is not because they think the dog killed John, but it lends credence to the idea that John was inside the house and therefore Karen couldn't have hit John with her car when she drove off. This also means that if the prosecution can show it's not Chloe, and not any GS, the defense can no longer use this to claim John was inside.
