One feels most honoured to even get an opportunity to listen to the likes of Hon'ble Shri Karpaga Vinayagam M. The way he speaks and the way he starts his address has just no parallel. He must speak on why Uttar Pradesh which is the most populated state of India and also owes for the maximum number of pending cases and still has just one Bench only and that too so near to Allahabad at Lucknow only and nowhere else? Why is it that West UP owes for more than half of the total number of pending cases and still has not even a single HC Bench and lawless Bihar too has not even a single HC Bench and peaceful States like Maharashtra which is the home state of the incumbent CJI Dr Dhananjay Yashwant Chandrachud has maximum number of Benches and so also Karnataka? Why when Justice Jaswant Singh Commission headed by former Supreme Court Judge recommended three HC Benches for UP not a single created even though on its recommendations HC Benches were created in other States like Maharashtra which already had multiple HC Benches and also in West Bengal but for UP whom former UN Secretary General Ban ki Moon termed as the rape and crime capital of India not a single HC Bench approved? Why the 230th Report of the Law Commission of India is still gathering dust even after 14 years of its historic recommendations? Why Telangana with just about 3 crore population can be given High Court and so also many other such small states but for more than 10 crores people of 30 districts of West UP Centre is not ready to create even a single HC Bench? This despite the irrefutable fact that the lawyers of West UP have gone on strike for 42 years every Saturday and many times even on Wednesday and so also for one month hunger strike in 1978 and for 6 months strike in 2001 and one or two months strike in 2009 and 2010 and five and a half months strikes in 2014-15 when Dr Dhananjay Yashwant Chandrachud was the Chief Justice of Allahabad High Court? Why Maharashtra which tops in the Justice Index Ranking List has maximum number of Benches and UP which tops in having maximum number of pending cases and comes in the bottom of Justice Index Ranking List has just one Bench and that too just 200 km away from Allahabad at Lucknow and why West UP districts are attached not with Lucknow but with Allahabad which is more than 200 km far away from Lucknow? Why no one in Supreme Court ever thinks on this? It must be debated, discussed and deliberated upon! My best wishes and best regards, Sanjeev Sirohi, Advocate

Mr Justice Karpaga Vinayagam M must speak on why Uttar Pradesh has maximum number of pending cases and still has just one Bench and that too so near to Allahabad at Lucknow only and nowhere else? Why lawyers of West UP have gone on strike so many times some times even for 6 months as in 2001 and so also for five and a half months as in 2014-15 and even hunger strike as in 1978 and so also every Saturday since last 42 years from May 1981 till now? Why for just four and eight districts of Karnataka at Dharwad and Gulbarga High Court Bench was created in 2008 but for 30 districts of West UP Centre is not ready to create even a single HC Bench? Why such reprehensible, retrograde discrimination is continuing even after more than 75 years of independence? An honest introspection is needed on this! Which one is greater offence, offence u/s Pocso Act or I. P. C? It needs clarification. The way of explanation yet requires more clarity by the Senior Advocate.

Sec42 of posco provide for alternative punishment if any act is offence under ipc and posco both court will go for sentence which is higher
