The fact that Nascar put a no suing for an anti- trust clause in their contract tells you everything. Nascar knows they would lose an anti-trust case.

@@skippingrhyme4386 all entities private or whatever must follow the Sherman antitrust act. Violating this law is a criminal case mind you, just no prison sentences resulting from it most likely financial penalties and/or being mandated to do certain things by the government. If NASCAR is found to have violated this law or other related business regulations in the suit it could proceed into a criminal case but we have to see. God bless this law these kinds of laws are what protects us from the greed of those who want to take for themselves at our expense. We just need a competent government to actually enforce these laws we already got.

The "strike" in 69 was nothing like this. When they showed up that year at Talladega for the first time they were running 200 mph and destroying tires in practice. The drivers just wanted to postpone the race until a tire was available that was safe to run on at those speeds. France didn't want to wait any longer than necessary to get his money back on his new crown jewel and forced them to choose and they chose safety.

@@S_Waltz used to watch nascar for over 20 years of my life since I was a little boy watching dega and Daytona back in the early 00s. After seeing through the bs the sport is involved in over the past few years I no longer watch, at least full time. I’m hoping this suit is the wake up call the sport and the industry needs for course correction.

Kenny you forgot a couple of important facts. If they win they will be entitled to 3x damages since 2016 for the years they were injured. Front Row would qualify for the full term of years. 23XI since 2021. This suit could also become a class action suit for damages if they win on the merits. Teams are being damaged due to limits to race in other stock car leagues, price fixing for cars/parts, Nascar owns most of the tracks and they are able to keep other series off of their tracks, which limits competitive series from racing against them on top tier tracks. They have control on what other tracks that host Nascar races may rent their tracks to. They control and own the rights to the car, and they can price fix the parts to any amount they choose. They also limit the amount of races a driver can enter in lower series. Drivers can no longer compete in multiple series. (Look at Kyle Busch; greatest driver in Nascar before being limited). No true bargaining process, bullying teams to sign or be kicked out of series, and making team owner sign no suing Nascar clauses. Fining owners and drivers for saying anything that Nascar feels is bad for the sport. And many other items.

Saying Kyle Busch is limited to one league, is like saying you think the New York Yankees should be able to play against High School teams to run their win statics up. Kyle Busch is an excellent driver. He is a terrible immature adult human that could have had 7 Championships if he had stayed in Hendrick equipment. But, he ran his mouth, threw his little temper tantrums, disrespected everyone around him, and got kicked to the curb same as his brother, Kurt.

The France family started this deal from scratch and built it from nothing to the billion dollar empire everybody enjoys today. Nothing they do, or have done, prevents ANYBODY from starting from scratch and building their own racing empire. There’s some other motives involved here. MJ might just want out and figures a few million in lawyers fees is a pretty cheap way get that done. Something fishy for sure. He can’t win, he must know that. What’s up??

The problem before was their income was so tied to Nascar that being out of Nascar meant being out of money. Jordan will be making money after he's dead and no more needs Nascar than he needs a 6th Ferrari.

It's going to be interesting to see how this all turns out. The driver strike in 1969 was a few years before I was around, my whole life is been their playground, their rules, if ya don't like it don't come back. It's going to be something to watch these teams stand up and challenge that mindset. ✌️🤙

Yes now we will be able to see the contracts with tracks that Nascar doesn't own to see if there is also clauses prohibiting them from allowing other Stock car type races from being used on their tracks. Margins for the fixed prices for parts, bodies and other car components. How much money Nascar makes on the tracks they own. The France family own over 1/3 of the tracks used. "13 tracks". Also personal Salaries of the France family.

Am not a lawyer, don't even play one on TV, but I think there could be a case for undue duress as it relates to this new contract. Especially in light of what some of the owners have said about it. Simplifying things here a bit, think Nascar would have to give the teams the new/better deal if 23XI & FRM, win, or face additional lawsuits.

1. Openly admitting “I’ve seen that movie” feels like an underhanded admission that the France family are bullies. 2. Out of all of teams in NASCAR, 23XI has the most famous and popular owner (by a mile), is co-owned by a future hall of fame driver who is also tremendously popular, and one of the most popular drivers on their team - the ONE SINGLE DRIVER who is still consistently pulling in multiple major consumer brands, all under one roof - who happens to have come up through the drive for diversity program. To me, that feels like leverage. NASCAR has opened up a can of worms that don’t think they fully accounted for.

I don't think people understand what an antitrust suit is lol. Sure all the other teams signed... But the suit will assuredly bring forth through that process that the other teams only signed through coercion due to Nascar having all the power and actively making moves to keep said power. This is such a bigger deal than people think lol. And tbh... Even if the suit fails... It's a pr nightmare for the Frances.

NASCAR cannot unilaterally “settle a case.” They may be able to have it dismissed, but even that would likely require them showing exactly how they haven’t been behaving anticompetitively. The France’s may have been able to tell Rick Hendrick to “go back to selling used cars in downtown Charlotte,” but Michael Jordan is a different character entirely.

@@shaynejenkins446 - You may be right about that, but I’m not sure the France family is significantly more wealthy than he is nor are they significantly more important in the sports world or the Western District of North Carolina where this suit was filed. But really, the importance, influence, or even wealth of a person stops mattering quite as much when something makes its way into Federal Court. If NASCAR has, in the eyes of the Court, broken federal laws, “being the France Family” isn’t going to matter a whit.

They don't have a monopoly on racing, there are many forms of racing on the market. NASCAR is owned and operated by the France family, they can dictate how the game is played because it is their game.

This sounds like legal posturing. For their initiation of legal action, anything negative, NASCAR does from then on, would appear to be malicious, and vindictive, and potentially get a cease and desist order, by the court.

@@rickybobby8224 my thinking is that they’re setting the situation, to prevent NASCAR from stopping their participation. Posturing, is probably not the proper term. I used it because I see this as they’re initiating a situation, where they would discourage and have recourse, to NASCAR blocking their participation. I can also imagine this card being played with regard to penalties, as being prejudice, whether actual or not.

Its gonna mean a lot for indycar and other american motorsports moving forward. I know people hate Denny, but I think they have a pretty solid point. Does that mean they're going to win? Absolutely not. But there are a lot of teams that were willing to just lay over and take this new deal so im personally glad someones not affraid to push back.

Good on the teams bold enough to do it. The sanctioning body has long forgotten where it came from and who keeps the lights on from the basement to the top floor. People getting too big for their britches need to be checked hard because that's what kills plans, vision, and progress.

Let's see, sounds a lot like the CART/USAC arguments and the split in 1980, only to have the CART/IRL Tony George arguments and split in 1996. They both fell on their faces and in 2008 had to unify just to save themselves. I think 23X1 and Front Row my want to look at Trans Am because I don't think this is going to end well. How many non-charter cars attempt to qualify for every race? I don't think they could get any of the other smaller teams to join them whether they are charter teams or not.

CART/Champ Car - forgot about them; thanks for the reminder. Champ Car did some things that sound awfully familiar these days - red sidewall “option” tire; moving away from ovals to more road and street courses, tried to “grow the sport” internationally - races in Canada, Brazil, Japan, Germany…🤔

If Michael Jordan loses and has to pull up stakes, he'll just take his millions to FI or some other racing sport. Jordan can afford to lose and that gives him power in this situation. The other teams will still have to abide by their contracts, but when their contracts are up, it's open season, if they win the suit. I think the France family is not looking out for the sport anymore. It hasn't been the same since France Jr turned it over to Brian.

If a court rules the contracts 23XI and FRM did not sign are in fact illegal, or NASCAR tried to strongarm the teams into signing, then the other teams contracts will automatically become null and void as well.

Helicopter skiing in Banff has always been on my Bucket list. I have never been there, but I have skied Whistler BC. My passport expired in 2020 as I am not Vaxxed. It's too bad that 3 or 4 other Teams didn't hold out so they could have a Class action Suit .

The charter agreement the other teams signed prohibits them from filing a lawsuit for antitrust. Not a legal eagle here but I imagine many could go back on it and file stating the agreement was signed under duress. NASCAR sprung the "final" agreement, which is a small book, on teams with a few day deadline just before a weekend. Guess we'll see.

i'm so glad Herm included me in the conversation. I still enjoy watching Kenny. Like he said, NA$$$CAR is indeed a monopoly. Isn't that illegal? The only way the monopoly can continue is if people continue to buy tickets and watch, even while knowing what a snakepit NA$$$CAR really is, and how it treats its own competitors, the guys you root for. I bailed on NA$$$CAR awhile back, even though it meant missing Larson win races. But he's a lot more fun to watch on dirt, anyway. So check it out, and screw NA$$$CAR. I'd love to see him go to Indycar or F1.

Grasp that NASCAR is attempting to control who MAY PARTICIPATE v who CAN'T. There is a difference especially because they want a monetary cut of your investment ahead of time. That model is an uncompetitive business practice (A SCAM); thus the lawsuit. Actually surprised more teams didn't join the suit but it demonstrates their fear of the organization. We'll see what a court decides unless there is a settlement. BTW - I did NASCAR many years ago... was a winner, too. Why would I sign up to lose? No "leased" team is gonna be remotely competitive... not enough money, engineering, and especially money. Very dumb concept though some drivers do it... i.e. there are several in F1 and Indy.

NASCAR screwed with the wrong dog. Michael Jordan has deep pockets and will lawyer up...and he is highly competitive. He plays to win. Gibbs is old and Hendrick is there to race, not confront NASCAR. Good for MJ. It would have been better for everyone had Gibbs, Hendrick, Legacy and RFK formed a united front with 23XI and Front Row. It was obvious that SHR was dissatisfied with the situation and just gave up rather than fight. I'm thinking if Tony had known MJ's intentions, he may have stuck it out. The Frances are used to pushing around the hicks and 'shiners from the past, not corporate leaders and billionaires. Shame on Rick Hendrick for giving in to NASCAR. He has no problem screwing over his customers when selling cars, but bends over for the France family.

If there was a finding against NASCAR, the contracts will be null and void, and new ones would be drawn up. With the lawsuit, every action NASCAR takes involving 23XI and Front Row will be under a microscope, and both teams will also have to be vigilant and not give them any reason to go after them. If NASCAR does, they better be able to prove that a) it's justified by the rules and b) they aren't treating them differently from other teams. NASCAR's desire to take every cent possible out of the sport got them. Controlling not just how much of the TV money teams get, but forcing them into one source suppliers for parts and chassis, owning the rights to marketing driver and team images as they see fit without compensation, etc? NASCAR will settle, because if this goes to trial the risk of losing is too high

Hamlin has a habit of starting feuds he can't win. He ran his mouth about Logano and ended up in the hospital with a broken back. He's instigated numerous run-ins with HMS drivers and became the most hated person in NASCAR. Then he got in a Twitter spat with Marcus Smith and pulled his family into it which led to a public apology for taking it too far. Now he thinks it's a great idea to take NASCAR to court? He better have iron-clad proof or this will be his biggest loss yet. No matter how far this goes the public will never see anybody's financial records. Neither side wants any part of that. It will all be done by lawyers behind closed doors.

The fact that NASCAR put a "no suit" clause in next year's contract speaks volumes. And yes, NASCAR has ruled with an iron fist for too long. I'm not a Hamlin, or 23XI fan, but I wish them the best in suing NASCAR ... the France family and their monopoly need to be humbled. I remember when Larry Mc said something on live TV, and not agreeing with NASCAR going to ethanol for fuel. He explained it all on national TV. We never heard or seen anything in print after that about the change. He was just explaining why all of a sudden that tires were not the reason for the pit stops. The tires were lasting more laps than the fuel.

I stopped watching nascar years ago, but I love watching your videos. It keeps me informed on what’s going on in the sport. So far, I don’t see any reason to go back and watch a race on TV. To think that years ago, I watched every lap of practice and qualifying and loved it. Nascars manipulation schemes of the championship outcome has really made it hard for me to watch. Guarantee that if Denny Hamlin lapped the field next year, nascar will throw a caution flag every lap just to get the rest of the pack back on the same lap.

Larry Mac had the most epic rant I've heard in a long time on his show with Danielle Trotta earlier.... I'm paraphrasing but he was like 23Xl has been here for a total of 3 years and think they're a big dog and FRM has a total of 4 wins in 20 years. While teams that built the sport like RCR, Hendrick, JGR, and Penske, etc all signed the charter. He also said Denny made all this money in Nascar working for an owner that signed this charter agreement.

Larry doesn't like Hamlin, not sure why. He tried to embarrass Hamlin on the radio imo after the Richmond race and he knew Dillion wouldn't make the playoffs. Which got him upset imo. So then he says I feel bad for Hamlins daughter who had to hear all the boos for her dad at his home track. I was there was near like he made it out to be. I thought that was low going after Denny like that when he didn't get his way with Dillion going to the playoffs.

Let's see how MJ feels about having all his business affairs being exposed, because I'm sure that he is transparent with all his business dealings. He also needs an attorney who understands what antitrust is. Nascar is not saying they can't start their own series. That would be antitrust. Basically, Nascar's position is that if you are going to run our series, you have to run by our rules. They have the right to do that. It's no different than the NFL, MBA, NBA.

If he and his team and frm are using antitrust litigation against nascar, they're more than willing to fall on the sword themselves if it means nascar gets it legally speaking.

I'm glad that they are suing them I have been watching Nascar a long time and it has done nothing but go down hill I hope things get changed to better the sport or maybe somebody start a new racing series

Jeremy Mayfield lost his case against Nascar in court. The court said Nascar is a private company and they can do as they want. If you do not like the way Nascar runs go race somewhere else. Is Hamlin and Jordan going to have the same results as Mayfield?

Have any of you ever seen some of these drivers multimillion dollar homes and there 2-3 million dollar buses. I hope nascar tells these two teams to leave.

If NASCAR were to eliminate the charter system and go back to the old way of building cars by letting the teams supply their own, then that would take away a lot of the 23XI's claims of anti-trust. Everybody becomes an independent contractor - sort of speak and not held to a collective contract, as the way it was before charters. If they were to build their own cars then they are not forced to buy cars and parts from NASCAR. And the racing will become much better! Of course that's not what Denny and MJ want - they want to force themselves into owning a share of NASCAR, to turn NASCAR into the business model of the ball sports.
