bahaha, that almost literally happened to me. Buds and I were teens back in 200#? and got ticketed for trespassing a public spot at some reservoir. There were public benches. We had a little pontoon dingy and we stopped to rest and view. Game warden came over and told us this was off limits due to 9-11 and terrorism. Well, clearly we're 16 and I dont have a bomb so... He got our lifejackets we bought to be compliant and, being cheap teens, we bought the cheapest which we were all over-weight for and ticketed us for being unsafe. He had us, after confirming the lifejackets were insufficient, get back in our boat and row the 1/2 mile back to our cars/landing spot to get our IDs and ticket us... because terrorism, at a rural reservoir that he was protecting, from destruction, from Al-Qaida. Maxim of Law: No right is held more sacred, or is more carefully guarded by the common law, than the right of every individual to the possession and control of his own person, free from all restraint or inference of others, unless by clear or unquestionable authority of law. Union Pac. Ry. V. Botsford, 141 U.S. 250, 251. Kent vs. Dulles, 357 US 116 (1958) Whatever the motives of the arresting officer, they do not cause or bring about a change in the legality of the arrest, as was asserted by the Supreme Court of Missouri: A lawful imprisonment does not become unlawful because of malicious motives nor does an unlawful detention become lawful because actuated by a laudable purpose or in good faith. See: Thompson v. Farmers’ Exchange bank, 333 Mo. 437, 46 S.W. (2d) 803, 811 (Mo. 1933). False imprisonment is treated as a tort, and also a crime. * * * If the conduct is unlawful, neither good faith, nor provocation, nor ignorance of the law is a defense to the person committing the wrong. See: Kroeger v. Passmore, 36 Mont. 504, 93 Pac. 805, 807 (1908) “The courts are not bound by an officer’s interpretation of the law under which he presumes to act”. See: Hoffsomer v. Hayes, 92 Okla 32, 227 F. 417. “… An officer who acts in violation of the constitution ceases to represent the government”. See: Brookfield const.co v. Stewart, 284F. Supp. 94: "Officers of the court have no immunity, when violating a Constitutional right, from liability for they are deemed to know the law". See: Owens v. Independence 100 S.C.T. 1398 The Government of the United States has been emphatically termed a government of laws, and not of men. εIt will certainly cease to deserve this high appellation if the laws furnish no remedy for the violation of a vested legal right. - Marbury v. Madison, 5 U.S. (1 Cranch) 137, 163 (Marshall, C.J., 1803) *Law is a sacred sanction, commanding that which is right and prohibiting the contrary. *The Law cannot be deficient in allowing justice. *The Law always gives a remedy. *(Precedents) have value in the law to the extent that they represent justice.

He wasn't even breaking the law, he wasn't parked. The definition of parking in Texas is leaving the vehicle unattended. I used to argue with security guards at a mall in Cedar Hill, TX about this very issue. I used to pick up my wife from work and wait for her out front for no more than 5 min. I was not blocking any traffic or anything. The security guards would come up to me all pissed off and tell me that I can't park there. I told them that I wasn't parked and I was picking up my wife. They didn't comprehend what I was saying and threatened to call the police every time. I finally printed out the law to show them. The law states the definition of parking is leaving a vehicle unattended and that a vehicle can be located in a fire lane or no parking zone for the purpose of loading or unloading passengers and/or cargo. Just the fact that he was still at the vehicle was enough for the parking ticket to be invalid. Plus, a parking ticket isn't a crime, therefore no need for ID. Parking tickets are written to the registered owner and left on the window.
@jamesbeecher4431
@jamesbeecher4431 8 ай бұрын
It depends on how the local code has the fire lane law written. I tried to google this city's parking law and only got the fine list but I got 3 or 4 other cities in TX's codes and all of the ones I read were similar to the Tylar, TX code which reads, ""It is unlawful to stop, park or stand any non-emergency motor vehicle in an area properly marked as a fire lane as designated by the Fire Marshal, so as to obstruct the same, in whole or in part." So, the violation is like a handicap space violation. You don't need to be 'parked' but just occupying the space to be in violation.

Unfortunately it's by design. Humans do not have the psychology to deal with oppression, enough of it and we become a type of feral. This kid is already part way there. Who knows what he went through before, maybe the judge will be a jerk over this and it will be the last straw for this kid. If he is pushed over the edge and does something that lands him in prison, more of the public will focus on what landed him there than the number of people who see this vid, exacerbating his psychological stress. Piggies literally create criminals, for the elites agenda.

Back around 1977 my rolling wreck ran out of gas, at night, on a curvy stretch of road. Being young and somewhat fit, I ran back home and grabbed the gas used for the lawn equipment. When I got back to my wreck there was a deputy sitting behind my car. He looked at the gas can, gave a knowing nod, and assisted putting gas in my wreck by keeping his flashlight on the operation. I delivered a sincere thank you. He hung out to make sure my 1972 Oldsmobile "Fuel Eliminator" cleared the road and we both went on our way.... End of story. I never felt threatened. He didn't blast his flashlight in my face and scream about me being on drugs because my pupils constricted. He didn't scream at me about incriminating aromas. Nothing of the sort. He just cared about getting a risky situation eliminated. I'd never felt any obligation to fear law enforcement. Today I would have to prepare myself to be face down on the road, handcuffed, and struggling to breathe with the cops entire weight resting between my shoulder blades. I think today's law enforcement wants you to believe you are obligated to fear them. I've come to despise the sight of a cop...

While I was in HS I was a pizza delivery driver near Fort Bragg. Last run of the night as I pull into an intersection my 20 year old car just died on me in the middle of an intersection on a military base. Within a minute of me getting out of my car to try pushing 3 young army men including one MP dropped whatever they were doing and pushed my car up hill into a nearby parking lot. I felt so bad cause 2 of the army guys just got back from the gym and were screaming out “f**k leg day” while pushing my car uphill. I thanked everyone for their help and they asked if I wanted them to hang around while I wait for my ride. No request for ID, no explanation, they just saw someone in need and jumped into action without a single thought. Compassion is a choice and clearly these officers decided to have none

@@activemanishere or is the difference that I looked more like the MP than this kid looked like the officer? He’s a kid who’s freaking out cause this is more than likely the first time his car has ever been completely out of gas and just his luck it died in a fire lane. Now with the added stress of multiple police cars all demanding his ID best believe I’d have panicked as a kid too. Sometimes you’ve gotta put yourself in someone else’s shoes. How different do you think this interaction would have been if the officer hopped out of his patrol unit and told the kid to steer while he pushed him out of the fire lane? The kid would have walked away thinking wow how great to live in a town with such kind helpful police. Instead he walked away thinking cops are A holes that will make a bad situation worse.
@activemanishere
@activemanishere 8 ай бұрын
@@colepauley8235 it's a little insulting that you brought up race. His race played no role in this interaction. The problem is the kid didn't give the officer the opportunity to be helpful. He immediately started freaking out and spouting conspiracy theories. He was acting suspicious from go. I am absolutely the guy that gets out and starts removing recovery gear before even asking when I come across a stranded car. I would have reacted the same as these officers had the kid acted that way to me. I'll bet they were thinking potential criminal activity based on location of the car and the kid's behavior. But I gotta stress again, you insult the kid and the officers when you assume that because of the color of his skin, he must be a victim of racism. Unless race actually played a role, don't assume it did. That's just ignorant.
@colepauley8235
@colepauley8235 8 ай бұрын
@@activemanishere I can’t speak for what was going through the officers head. But I do think the fact that their minds go straight to suspicious/criminal activity is entirely relative to race. Last time I checked suspicion wasn’t a crime and being nervous as a young driver is a universal norm. I applaud you for doing the right thing before asking for ID but that didn’t happen in this situation. And due to the officer’s demeanor you can bet that kid will grow up to resent police because in his mind they clearly aren’t out there to help him.
