I am a recent military retiree, and i noticed a couple of things. 1. They said his retiree ID had been "expired for a minute". Retiree IDs are good for 15 years at a time, and this guy didnt sound that old. 2. They made an joke about him only being a corporal, and being retired. Most low ranking retirees I've ever encountered were "medically retired". Someone who was hurt in their service.... This shit infuriates me...

Maybe I'm the idiot here, but just because his ID is expired, does not mean it is suddenly invalid or the guy is a liar. It might need to be updated for paperwork, or some other reasons, but they just wanted to know if he was a vet. Expired or not, it was proof.

That must have changed. As far as I know, dependent ID's to retirees expire, but my father's retired ID is good for literally forever. Maybe it's because he's a retired officer vs enlisted? I dunno. Also, it's not just "most low ranking retirees." I'm pretty sure the only way to retire early (besides attaining the rank of Major (they can retire after 10 years after attaining said rank, though it's HARD to get promoted to Major. In the Marine Corps, an officer is considered to have had a successful career if he makes it to the rank of Major)), one HAS to be medically retired. And the injury has to be sustained in the line of duty.

The V.A. is ultimately responsible for being a welcoming facility that provides services to veterans. Not anything like what these guys did. Just because it’s federal property doesn’t mean anyone can go to the VA and do what you want. If you are asked for ID you must provide it at the VA. Military bases are federal properties too but you can’t just go on base without proper ID.

Military bases are clearly marked as restricted access, and VAs are public facilities, not private. Any property owned by the government is public(meaning the people are all partial owners) and is accessible to the public unless clearly marked. Learn things before spouting off stupidity.

Qualified immunity shouldn't protect these tyrants. It is intended to protect well-intentioned officers who can't know the correct action in a situation that has not yet been challenged in court. This situation is well trodden ground. It is a clear violation of the fourth amendment and has been so under clear case law for decades. If we actually had a system that used valid qualified immunity, it wouldn't apply. When they are granted protection in these situations, it is a mockery of qualified immunity and what it is supposed to mean.

it doesnt matter, the VA as a whole is worse than any police dept. no matter who, or what you file a complaint about at the VA, they do nothing to resolve it. the best is to call senators, and congressmen to complain about the VA. still accomplishes nothing, but it doesnt look good for the director of the VA facility.

As a point of clarification: If someone has a Retiree/Retired ID, and they’re of low or mid rank, that means they got hurt in the line of duty generally through no-fault of their own, and they were medically discharged. Their rank is completely irrelevant to the fact that they honorably serve to get an ID card. I know lots of people who retired as PFCs corporals and sergeants they didn’t even do 10 years and some less than 3 years but got hurt and had to get out. Even if this gentleman were a “shit bag“ while he served he still EARNED the privilege to be treated and seen at the VA facility.

I have witnessed police officers in my former city and state disrespect and abuse veterans, many of them homeless. The really sad thing about it is that some of these officers were in the military themselves. Unfortunately, we live in a country in which our government would rather support law enforcement officers who abuse their authority on veterans and innocent citizens on a daily basis. Our government loves to control its citizens with fear, the conquer and divide theory and law enforcement pretty much believes in treating us in the same fashion. The problem that this young man’s claims have is not an immunity issue but rather a cause of action issue. The caselaw is against him on this. See _Oliva v. Nivar,_ 5th Circuit Court of Appeals 2020 (No _Bivens_ Acause of action against VA police officers for excessive force). See _Egbert v. Boule,_ Supreme Court 2022 (No _Bivens_ First Amendment cause of action against _any_ federal actor). The FTCA (Federal Tort Claims Act) isn’t for constitutional torts and the individual officers _and the agency_ cannot be properly named defendants…only the United States can be proper defendants under the FTCA.

Old lady disrespect but also for the violations of his rights. Not only was my father in the service, Navy but so was my husband. I grew up in Norfolk Virginia where there are basis for the military and I worked as a civil servant for the Navy for Betty years. Yeah, and the victim in this video was obviously a hero. Notice he was Retired. The cops say he must have been a bad Marine to be retired as a corporal. That's not how it works. The only way to retire as a corporal is medically, and the only way to qualify for medical retirement is if the injury was in the line of duty. This guy was most likely injured in combat.

So I caught four 4th amendment violations (Demanding ID, opening the door, searching the person, illegal detainment) and conduct that likely violates department policy with the disparaging comments and threat of arrest after finding out they were wrong. If the Vet sues I think the court is likely to offer minimal compensation for these violations because courts don't seem to care if our rights are violated as long as the violation is brief enough.
