U.S. Customs and Border Protection (CBP) currently claims extraordinary authority to stop and question people at interior immigration checkponts in the 100-mile border zone, which runs along our southern border with Mexico, our northern border with Canada, and our maritime boundaries on the Pacific and Atlantic oceans. If you find yourself at an interior immigration checkpoint, know that you have rights. Although CBP likes to act like its authority is unlimited, it is not. Understanding what Border Patrol agents can and cannot do will help you to better protect yourself.

ACLU where have you been? I live in New Jersey, I’m a us citizen that’s constantly being harassed at the border crossings, I’ve been trying to contact the aclu in area for the longest time now

You know, I lived in one city right on the border, and on the local news, weekly they would report the value of drug bust they made at checkpoints, as well as at the port of entry. Agree.

Try looking up a first amendment audit of a checkpoint. Then ask yourself where were our rights for those people.

I've always lived within 100 miles, in 3 different states. I've never had any problems, but that doesnt make it right. Besides, im white, so just a disclaimer.

Repeal 8 U.S.C. § 1357(a)(3) it affects many more than the 100 mile Constitution Free Zone. Anyone who travels across the 100 mile zone for work, transport, commerce, school, etc is also affected which makes the number substantially higher than 2/3 of the population.

They treat people brutally, they look like gangs. If I can file a complaint against them, he threw them into a room like a prison. When I knocked on the door to ask someone, he said to me, shut up.

We are obsessed with freedoms and gun ownership, and "less government" expect now some states are dictating morality, by limiting or eliminating abortion, and eventually eliminating the availability of birth control, even though we want "smaller, less intrusive government". We are a country about to become the Gideon of "Handsmaids tale"...

Americans didn't "let" these exist. They were challenged in our judicial system. Unfortunately, in a 7-2 decision in 1976, the Supreme Court decided that these checkpoints did not violate the 4th Amendment's prohibition against unreasonable search and seizure. Many people disagree, and we still have a 5th Amendment right to refuse to answer any questions, but there's very little the average American can do to get rid of the checkpoints when SCOTUS says they're legal. SCOTUS has quite a few questionable rulings in the 1970's, and it's going to be difficult to get the court to take all of them up again and overturn those that need to be changed.

State laws almost certainly require you to stop at a stop sign or flashing red light. If you don't, you can expect a local cop to stop you down the road.

@ ACLU; I thought you where for (support) of the LAW...... Please explain this and how it relates to these unconstitutional checkpoints...... US. SUPREME COURT DECISION - "…every man is independent of all laws, except those prescribed by nature. He is not bound by any institutions formed by his fellowman without his consent." Cruden v. Neale, 2 N.C. 338 (1796) 2 S.E. I doubt, I'll get a response.............

No, as many airports can be designated as a port of entry.

It depends. If you are coming directly from a foreign country, it's the same as an actual border crossing. They can ask you just about anything, detain you, search you and your baggage, confiscate your stuff, steal your money. You can be required to show proof of U.S. residency or citizenship.

@@harveywallbanger1738 Why don't the same rules apply at ports of entry? I understand that questions can broaden from just being about immigration and citizenship to questions about purpose of entry, whether any illegal or controlled objects are being taken into the country, but I and others have been asked invasive, irrelevant questions that have nothing to do with where we were, why we're entering the country, what we are bringing with us, etc. They don't it make clear whether there are any questions they aren't allowed to ask you, and whether you are within your rights to refuse to answer some questions. I think there are signs that also say it is illegal to record your interactions with them, even though they have you on camera. That's very one sided: they gather evidence they can use against you, but the rules are set so you cannot gather evidence to use against them. There is more level a playing field when dealing with the cops than the 'Border Services' staff.

WTF........ If you are already in the US......Probable cause ; The police officer must have articulable probable cause before detaining of anyone !!! Understanding of probable cause: The police officer must have and be able to articulate probable cause that, A) You have harmed/damaged a person or property and or. B) The police officer has a witness, of you committing a crime and or. C) The police officer witnessed you committing or about to commit a crime and or. D) Has a warrant for your arrest. Without probable cause before the stop, the ticket/citation is unconstitutional. Reasonable suspicion must be linked to (see above probable cause). If you are told that your being detained, you are under custodial arrest and Miranda rights must be sighted to you before any questioning (Detained = Arrest). They can not search anything without warrant or your consent or a crime has been or about to be committed. You have the right to record your servants!!!!! A dog has a hit (detect) on your vehicle, then demand them to go tell the judge and get a warrant to search, because a dog is not 100% accurate let alone can speak in any language on what he has found. Have some fun by putting a little peanut butter inside the inner rim of your wheel, see what happens...... a very long day! ALL CHECKPOINTS INLAND ARE UNCONSTITUTIONAL...............

I am a red-blooded conservative. I voted for Donald Trump. I believe the US CBP and ICE should be well equipped, well trained, paid fairly, and held to a high standard of American excellence. I believe the CBP, ICE, the Coast Guard, and the rest of Homeland security should be working with CBSA and the Mexican Navy/Military to ensure the integrity and security of our nations and national borders. I also believe that once you’re in this country legally you should have the right to move freely without impediment. You should have a right to keep your privacy, your property and frankly your time. Although I don’t always agree with the ACLU, this issue is incredibly important and they raise important points here. The ACLU is correct that you should never lie. If you lie, you’ve just robbed yourself of your integrity. You have a right to your integrity. At this point, I’m not convinced these checkpoints are constitutional. Good on you for talking about this ACLU.

I should have seen this videos before today I had a very bd experience the checkpoint, I was ask questions that weren’t related to my legal status I am. Woman that travels alone most of the time to see my dad in Mexico in my way back at checkpoint at freer the agent that saw my green card let me go and then another agent said to wait and he started to ask me questions but when I travel with my husband they never ask anything is like being a Mexican woman traveling alone it’s a crime.

Now "abusing their power" just because they feel like it, totally wrong and you should report that. Well let's say you have a right to report that - we know nothing's gonna change, but still I refuse to just do nothing and complain. I refuse to roll over and let them do whatever they want.

I WAS DETAINED AT A CHECKPOINT WITHOUT REASON. I was driving alone from South Padre Island, Texas. I can to the permanent checkpoint, and was asked where I was going. I told the agent I was heading to Denver. He has me get out of my car, I asked why, he said "Because I said so". He was aggressive, rude, and intrusive. I'm made to sit on a bench under an awning while the agent goes through my car. He dumps the contents if the glove box on the ground, throws my belongings on the ground, ransacked the car, has his dog sniff around inside. O get my cellphone to take a picture to post on Facebook. Another agent yells at me to "Put that f--king phone away!". He takes the phone and erases all my pictures. Finally, the first agent tells me I can go. I had to pick up everything. And sort it again. Later, I find the locked armrest compartment on my car had been pried open. The leather was torn, the latch broken.

These check points are a complete joke. I have been through about 20 ( maybe a few more) times. I am not a citizen but a permanent resident. When they ask me if im a citizen I say yes and they wave me through. I wonder if its my blonde hair and blue eyes ?

Ankles neither. It’s because the K9 didn’t alert. It’s the whole reason for the checkpoint. They have to conceal a drug trafficking checkpoint as an immigration checkpoint.

@@bpdp379 not true. I've driven through the Freer checkpoint twice and there was no dog either time. I show my passport, they take a quick look in my trunk and send me on my way. At the one outside of Eagle Pass yesterday was the first time I had ever seen a dog at an interior checkpoint.

Greg Thompson apologies. Never say always right? I understand that the CBP cannot fund all of the checkpoints 100% to be always staffed by a K9 team. Do you honestly feel they are an effective immigration tool? The CBP officers I’ve talked to don’t think so.

So the US has no rule on carrying proof of citizenship, nor do we have a "cedula" or some form of national ID, but we have to answer the question "Are you a US citizen?"...that makes no sense at all to me. Furthermore, some are getting away with not answering that very question at the checkpoints. There are conflicting recommendations, what to do?

Not true. Using your rights is not the same as not complying. They need reasonable suspicion that you committed a crime.

Yes they do have a right to set up these check points and if you do not want to answer there questions they can pull you off to the side and hold you until they find out your name and citizenship. You will not slow anybody down except you

Agents here can only detain for 'brief questioning of the vehicle's occupants" and "any further detention or search must be based on [the greater showing of] consent or probable cause." Once a driver indicates that he will not answer questions or consent to extend the detention or a search, then the only real option available to the agents is to quickly check for evidence of crime, such as contraband in plain view, and let him go if no evidence of crime is found.
