That's why I'm not rushing to mail all the applications too quickly even though I already have my marriage certificate. I thought I had to submit documents before my wife's J1 visa expires but I learned that I can still submit everything if she overstays her visa. So now I'm building a strong portfolio of bona fide marriage evidence to support my petition and feel that will take a few months having to show both of our matching names and address on license/passports, converting banks to joint accounts, and our domestic traveling with family/friends to have as more solid proof.

We been legal residents for a year now. We have a son that is attending college here in the US for the past year, and we would like to know how could we help him to become a resident himself? He is 23 years old and unmarried. What are the forms that we need to fill out? We are both retired and our only income comes from our home country. I have a question: You mentioned that if my husband and I have been married for more than 2 years when I apply for Green Cards, there's a Hugh possibility I'll receive a 10-year green card. If I apply before we've been married for 2 years, but USCIS receives my application after we've passed the 2-year mark, will they count the 2 years from our wedding date, or does the clock start once I submit my application? @@SharleenDoroteo it’s not when you apply for a green card it’s 2 years when you get your green card. So they’ll count from marriage start date to approval date.

The Evidence of Financial Report requirements differ from INSIDE the US (Adjustment of Status) vs NVC to foreign Consulate. Yes, if Inside US they only care about last couple yrs tax returns (and will usually avg them.) If a Native country consulate however, the tend to care more about current Income (but you still need to provide tax returns. TIP: BE SURE to check the CURRENT YEAR 125% Poverty Level and BE SURE to be a min of 135%. If too close to 125%, they will assume you manipulated the numbers.

You need a co-sponsor for that, which means another US citizen or PR. You will then file the "Affidavit of Support" form.

They won’t ask you why you overstayed, that’s up to you, there will be some yes and no questions where you’ll be asked on the form, there you can put overstay and make sure to attached your waiver with your evidence!!!

If you don't file taxes you need to get a sponsor somebody that makes money that is willing to say that if your mother ever ask for financial aid from the government they will be the ones providing it for her not the government.

@brendaprater656 that happened to me. Kseniya has a video explaining how to save the PDF. Sometimes the PDF is too big or the system doesn’t read it well. Another option was to open the PDF and click on “Print”, then instead of sending it to the printer, click “Save as a PDF” give it a different name and save it in a different folder. Make sure you review your PDFs before you load them into the website.

Visa overstay is forgiven for immediate relatives of US citizens. But each case is different. For example, consider the 90-day rule.

I did all my application with my maiden name, I am about to go to my biometrics today. Does anybody know if I can go in there and give my new name (my husbands) of did I have to do that since the beginning. I havent been able to change it yet because I don't have a valid ID. You only NEED to upload the MOST RECENT 1 year tax information. If you make enough last year, then you're fine.
