If you own a lease in a building with a number of units in the UK, customarily you will have a management company - either internal or external, who deal with repairs, repainting exterior, quotes for works to roof, exterior landscaping / gardening etc. etc. Some of them can be an absolute nightmare. Best to keep the management 'in house' if you possibly can - but even then you can end up with the neighbours from Twitchy Curtainsville, who might set out to make your life hell. You have to be careful where you buy. And never, ever buy where the freeholder is the local council. Your life - sooner or later, will be plagued by bureaucracy and repairs bills gone completely out of control. Beware. Really, beware.

an HOA popped up around my parents home and a developer was ultimately behind it. Because my parents home was smack in the middle of their kingdom that was built all around my parent's home they started giving my parents edicts such as 'take down your fence' which was professionally installed and permitted. It quickly escalated to the wrong type of grass in the lawn, no cars in the driveway and pay fees for all the HOA projects. This was my parent's retirement home (they retired young) and they were not going to succumb to the threats and harassment. At one point the developer hired 'off duty' deputies (in uniform) to be part of the plot. Instead of spending their golden years enjoying life that spent a good part of it in court. The developer and HOA never had a leg to stand on their only hope was intimidation and deceit. The HOA is long gone now, the developer went to prison for other crimes. After that the rest of the community that had been harassed, robbed and intimidated found his friends and former board members.....It wasn't pretty. There were causalities.

If you live in a neighborhood that has an overwhelmingly aggressive homeowners association here's a few pointers or tips on how to protect yourself. 1. Literally have every single document from the homeowners association on file every receipt every email every text message everything has to be paper. Now here's the reasoning behind this so you can understand or better understand this and the point that I'm trying to make. At some point someone from the homeowners association will send you an email or a letter and they will be aggressive in their language which can in the court of law be considered a threat to your property or yourself. 2. You have to understand that the homeowners association will keep tabs on you that means they will invade your privacy they will spy on you they will take pictures of you they will record you either audio or video. They will trespass on your property to look and see what bylaws you are violating so they can supposedly legally fine you. fortunately you may have to do the very same thing that they do accept you cannot trespass on property or violate their privacy however you can take pictures of them from the main street or road you can video them or audio record them if they call you. Keep all that very well documented somewhere safe in a safe. Even if that particular homeowners association seems to be kind or respectful always consider them your enemy they are not your friend. 3. Make sure you have a list of all the board members, their names and their addresses. And any other legally obtained information regarding the board members. 4. The number one thing that people truly confused regarding the homeowners association or do not understand is that the bylaws are merely a suggestion they are not mandatory under any law. This means that if they send you a fine it is null and void it is not a legal tender anything and you don't have to pay a fine that the HOA sends you. Unless you're quite literally violating state or local laws they have no authority of any kind. 5. Understand that the homeowners association has money they have board members and friends and they will find or look for literal local and state laws that they can exploit or bend to go after you and you must do the same. You quite literally need to familiarize yourself with all the local and state laws to the point of knowing them better than your homeowners association so you can use those laws and exploit those laws against them. Here's the difference if you pay state taxes local taxes and federal taxes those are the people that you answer to the homeowners association isn't merely a suggestion and they can honestly kiss your ass. 6. Make sure you have audio and video recording surveillance around your house and I'm not saying just at your front door but all around your house. Also make sure that if you do not want anyone to trespass on your property that you have a sign that states that in that you get a legal document from an attorney that allows you to legally say that you rather not have anyone trespassing on your property unless of course it's the mailman or the delivery guys of any sort. 7. Here's a perfect example of how the bylaws are merely a suggestion. I live under a homeowners association and one of their provisions is that the David for trash pickup before 5 in the afternoon I have to have my garbage can and recycling bin and yard waste put out at the curb. This is merely a suggestion, to make things look more orderly and kind of to basically make it look nice that everyone stuff is out at the same time. What if they were to happen to consider finding you for something like that you can tell them good luck. And the reason why is because they don't pay your property taxes they don't pay your mortgage or your rent if they did however then they can tell you to do that and you would have to listen but because they don't pay any of those things they can kiss your ass. also I only once have been asked if I could do that and I said I prefer not because I have food waste in my garbage and I don't want the raccoons to knock it over because then I have to spend half an hour in the morning cleaning that out and that will make me late to work. So I would much rather and consider putting the trash can and recycling than and yard waste out in the morning where it's most convenient for me not for you it's never about the convenience for them it's about your convenience. Like I said if they try to find you for something like that very are really stupid. The only time that I could understand them wanting to ask you not to do something but they can't find you for it they can call law enforcement or they can ask you kindly not to do certain things things such as having a bonfire in your backyard that could be hazardous to people they can kindly asked you not to do that. Or something such as if your kids have airsoft guns or BB guns for them not to shoot those because it could lead to some sort of injury of other people in the area. but they still can't find you for that they can call law enforcement and have law enforcement take care of it because at that point you are actually breaking laws. A prime example regarding the whole bonfire thing is that the township that I live in has rules that there are times during the year for several weeks where they kindly asked people not to burn anything because it could start a small forest fire or lighthouses on foyer or grass etc. But that's the township and the homeowners association can't tell you really anything because they have no legal permission to do anything except merely suggest things that may make the neighborhood a bit better looking. 8. Now obviously if you pay your homeowner's association dues you are paying for things like snow removal and occasionally then fixing the roads things such as that. Sometimes they ask for more require more when it comes to fixing roads etc that is the time where you can say well don't patch my part of the roadand that's when they can legally involve the township which then will force you to make a payment so the roads can be paved because if you have a giant pothole in front of your house and someone destroys their car going through that you could possibly be liable especially if you had an opportunity to pay a little bit of money from yourself to overall have the roads in the area fixed that's the only time where they have anything to say because it benefits everyone that includes yourself. Other than that there might be other local laws or state laws regarding the height of a fence or a privacy fence or the type of trees bushes excetera that you can grow in the area there might be local provisions for that but those are local or state laws and they have nothing at all to do with the homeowners association and again they can't tell you to do anything unless they are from the township the homeowners association can kiss your ass. 9. If your homeowners association requires you to pay homeowners association dues then they are clearly a profit organization and they must be registered properly as a type of business because they are collecting money and providing a type of service. If they are not properly registered and are not properly licensed you can technically refuse to pay those dues that also goes into you telling them to kiss your ass regarding them fineing you over stupid bylaws. Everything that the homeowners association does has to be done according to local and state law usually if it's a big homeowners association they need to have a place of business or headquarters if they are a smaller one and the headquarter technically could be one of the board members house it still needs to be legally registered under state and federal and local laws. They also need to have a proper management way to have individuals reach out to them whether that would be through telephone which is required email and some things like letters and other means of getting ahold of a board member or staff of the homeowners association. 10. Do not be afraid to go to board meetings or try to get on the board, do not be afraid to speak freely and exercise your constitutional rights because your rights supersede the homeowners association. And remember those are just suggestions nothing more and nothing less.

Thank God my parents don't live in an HOA. There is a "suggested" neighborhood dues of $50 a year, but it's not required. That money pays for landscaping of the crepe myrtle trees and general maintenance of the entrances. But nothing like these people put up with. In the 25 years they've been there, the neighborhood only threatened to put a lien on one home that had fallen into such disrepair, it needed about $400,000 in fixes. The yard, siding, windows, shutters, three porches, driveway, roof - everything was rotting and falling apart. That neighbor finally made the repairs and all has been well ever since.

This is exactly why I would never own a condo. When I buy a house... IT'S MINE! Why would I want to essentially pay rent on a property I already own and have them tell me what I can and can't do with it?!? That's a sucker's purchase!

Time to go to the HOA's principle and ask them if he/she knows what the term, "Pushing up Daisies" means. You people only get what you allow to happen to you. YOU CAN PUT A STOP TO THIS AUTHORITATIVE BULLYING. I'll leave it up to you to figure out how to proceed !

That woman said they pay 150 bucks a month for HOA like it's a good thing. Oh yeah I want to move to an area that has Nazis running the place and I have to pay them 150 a month to enforce bullshit rules? Lmao not in a million years. HOA does absolutely nothing. I have never lived in an HOA neighborhood but have friends that have and they said literally there is no difference at all except A. You have to pay HOA fees and B. You have stupid rules to follow. Neither of those are benefits so I guess I really don't understand why anyone would want to live in an HOA neighborhood

Now i dont actually know what an HOA is, but by my understanding it's similar to something we have where i live, and it works as a democracy. Residents vote for changes and maintenance to be made. And only on public spaces like our park, road verge(?), security, events and the like. They also don't charge us, they make money for these things renting out an event salon in the neighborhood. While some changes I could do without, they don't tell us how to live. Then again, i hear the USA has a thing where they.. fine you for not keeping up your yard?

My HOA in Aldea de Santa Fe were great! landscaping, crime watch, neighbor dispute, newsletter, special events, yoga classes, lounge with 80" 4K with kitchen and gym, basketball and tennis courts, timely snow removal, gentle enforcement of rules, a team of handymen, one time they changed my flat tire and gave me a battery jump, friendly, quick, maintenance of open space and roads, dealt with utility and construction companies, everyone waved to each other, they created a real sense of community, we all knew each other, looked out for each other, felt safe, they were very awesome.

OK... Now, I want to know what advantages do you actually get when you buy into HOA? Because all I hear about are horror stories about them... It totally looks like you are not really owners if HOA puts a rule on everything you do...
@mikegirard98652 жыл бұрын
Actually it's safer to back into a parking space. When you arrive you're aware of the surroundings and when you leave you can see everything. There are more accidents with people backing out of a space than pulling out of a space.

To American West homeowners: I suggest you move out and NEVER return. They should understand that they do NOT deserve to rent out any property that is under their name to anyone because they are doing illegal stuff to you.

When they HOA raises the dues to thousands per year and there may be fraud and embezzlement, why doesn't law enforcement get involved? This seems like a matter for state attorney generals, but instead residents are expected to spend tens of thousands to wage a civil lawsuit that many can't afford. We already pay property taxes -- HOAs are double taxation and are prone to criminal activity. Why isn't anything being done about this???

I agree some homeowner associations are horrible. I was the president of my HOA. Each resident has a two car garage and one space next to the garage. Many of the residents filled their garages with junk couldn't Park in them. So they Park the two or three vehicles they had in the guest spaces. There was nowhere for anyone visiting to park. I tried to get people to clean out their garages and park their cars where they should be. Everybody went crazy, hateful, spiteful, revengeful, stupid! I tried for two years, notices, flyers on windshields. Next election I got voted out of office because, I am a jerk, a******, vengeful, hateful, brain dead, stupid. It's not always the HOA!

This should be as simple as downloading an App that allows you to register you plate on first use so that you can simply opt to activate the vehicle as parked on a daily basis. Essentially what's done by major cities with using current parking slips you print yourself which you en place onto your dashboard - made easy to view by Enforcement officers

why did you move into an HOA?
@aliciamelendez5476 Жыл бұрын
Certain HOA members who discriminate against law-abiding citizens by ordering them to pay them are continuously losing money and homes because a lot of law-abiding citizens are moving away and staying away from HOA guard-gated communities in droves. Even potential law-abiding homeowners refuse to move into the HOA guard-gated communities and living outside of the HOA guard-gated communities.
