The fact that cops can just call for a k9 unit just because you're "acting nervous" is just ridiculous. Edit: OBVIOUSLY I know it's unconstitutional (I'm watching the same video you are). The officer even said "If you would have given us consent to search, you would have already been halfway home by now", A classic example of "If you don't let us violate your constitutional rights, we're going to keep you here and inconvenience you as long as possible."

Basically punishing you for using your rights. If this is what cops are trained to do then we don’t have a 4th amendment right anymore. Also, every cop in the world knows about the court cases Terry v Ohio and Pennsylvania v Mimms. But when it comes to every other situation they have no clue what a court case is. The Supreme Court has already ruled on this. They cannot extend the stop without probable cause of crime longer then to finish the stop for the original offense. They clearly went on a fishing expedition and violated this mans rights. He made a mistake though by answering the question they peppered him with.

Yup... although they will claim it was because of his nervousness (they set that up right from the start "we'll have you jump out because you're acting nervous") then the questions about travel. Remember a well written report can make a innocent person look guilty.

This was infuriating to watch. They wanted to arrest him so badly. The officer told Brandon that he was free to walk away at any time, I feel like if he exercised that right he they would’ve chased him. The vibe was we are saying you’re free to leave but the impression of force was there the whole time

I had an officer that had a dog do a walk around sniff of my car. The officer said the dog made a hit on my car. They searched it and found nothing. I then left and went straight to the police station and made a complaint against the officer and a separate complaint against the dog for making a false hit. It went on both of their records. 😂

Sadly the Fourth Amendment has been so destroyed that an Air Force officer was detained for over 2 hours at a suspicionless checkpoint and the courts upheld it as reasonable. So while you and I look at this and say that it's a violation of this guy's rights... The courts probably won't have any issue with it. Classic case of back the blue until it happens to you... The judges who make these decisions have probably never been on the receiving end of such police action so they don't really know the impact it actually has.

They have body cams, they are trained to build a narrative for the camera. It's like all the cops got the same training when the get issued the cams. When they cuff you they say "stop resisting" even when you are not. They hate when you say "I'm not resisting" as they cuff you. It stops the false narrative. "Why are you being difficult" is also a go to.

I had a cop once pull me for a headlight, then ask me to step out in the rain when it was 40 degrees out and accuse me of “acting nervous” because I was shaking from literally being cold. That’s what they do.

There are many ways to help remedy the public perceptions of law enforcement. We need to change the general culture. We need to hire better officers, who fully comprehend their sworn pledge to protect and defend the Constitution... Law enforcement is a tough job. Had the same thing happen to me. Cop asked if he could search, I said 'no'. He said it was suspicious that I said 'no' because most people say 'yes' and searched anyhow.

​@joshuagary2745 that sounds like retaliation. I got pulled over by a cop, that gave me a bogus ticket, I went to court to fight it and won. He then pulled me over again, crazy part is I had a new car and when he walked up he addressed me by my name so clearly he knew who I was before even getting to the window. Again I fought that ticket and won, when we left court he asked me what was the evidence you had to support your claim... I told him I guess we'll never know, he didn't like that one bit. The reason I got out of it was because he "magically" lost his notes on the stop so when the judge asked him for his side of the incident he said he had lost his notes for that stop and the judge dismissed it. Well guess what he pulled me over a 3rd time, this time it was for running a red light coming off the freeway. Again I went to court, this time he was not going to loose, literally lied to the judge. I did not expect him to lie, definitely was not prepared for that one bit. There was no way he could have seen that I ran the red light, it literally was not visibly possible for him to see it. When we got to court he says to me, today isn't going to go like the last ones(odd thing to say to someone) he lied and said he was parked watching the lights in a gas station parking lot. This simply was not true, I told the judge this and the judge said okay do you have evidence, I did not except for what I saw with my own eyes and my friend worked at that gas station, saw the cop pull me over, told me where the cop came from and it was the complete opposite direction about a half mile down, came ripping between cars cutting lanes(motorcycle cop) to pull me over. The cop didn't have evidence that he was where he said and his body cam magically stopped working but then started working again right when he got behind me. Unfortunately the judge took his word over mine and I got the ticket. On the way out of court I called him out and said you're a lier you literally lied to the judge and I can prove it and the cop responded with we'll the benefit of being a cop is the judge will believe whatever I tell them. Yeah he's a POS, now I constantly have a dash camera rolling. The same dude pulled me over tried to say I was speeding, I let him dig a hole then said officer block I forgot to tell you, I have a dashcam and it records my speed, I can't wait for the judge to see this one... he looked at me like he was just caught and gave me my license and said your free to go. So yeah I've dealt with retaliation, it's horrible, especially when it's a cop because they have the power to really screw you over

The main reason I wouldn’t want my car searched is because police destroy your stuff. Firstly, the dog jumps all over your car scratching it up. Then they cut into your seats and rip up carpet all in the name of looking for drugs. Let alone some disgusting cops will plant drugs in your car just to make an arrest. Then they send you on your way and won’t pay for the damage done to your vehicle. That’s reason enough for me to say no every single time.

It was about an hour and a half. I made it clear that I didn't consent to any type of search. Idiot didn't Terry frisk me, because I said no (I was out of the vehicle, he had the right to pat me down), but he did search the vehicle without consent. This just happened to my son. He called me right away after they left. He stayed quiet and refused to give permission to search. Even though they asked him 5 times and ran the dogs around his car. I asked him why they stopped him. He said they went pass him then did a u turn. He said he got no ticket… but ridiculed by several of them for being anti police by not cooperating. Funny thing is he was pro police… but not anymore.

He's got a target on him now. A few years back some cop pulled me over in my 52hp red is the fastest color race car, and about a week later he pulled me over like 40mins from the first spot to tell me he's keeping an eye on me. I flipped him off and never saw him again, but I know I've got a note next to my name cause I've gotten pulled over 2x since then and got tickets.

I was so terrified of the cops the first time I was pulled over, they lied about the infraction and knowing enough about how dirty cops act I was having a panic attack from the start.. I had a dashcam and the cop asked way too many invasive questions I just shut it down by answering extremely vaguely, not exercising my 5th as I was late for work. He questioned me about my nervousness and wanted me to open my trunk and asked consent to search, I told him I wouldn't consent as it was my Constitutional Right not to and he let me go with a warning for the false infraction.. I literally had nothing illegal on me, never had an issues with the Law and he grilled me on everything after asking me to step out of the car.. It was beyond terrifying, an armed thug who has legal authority to drop you at the slightest sign of "Officer Safety" being in peril.. What normal Citizen wouldn't be afraid of an ACTUAL SOVEREIGN CITIZEN who the Law doesn't apply to equally?!?!

(there's no way to prepare for psychos like this except a dash cam and an app that will call a contact when you're getting pulled over) They didn't get "justice" until they went to the FBI (after he recognized keywords that he knew cops put in reports to cover their ass) and even then the guy was only sentenced to four years, which of course with good time was only two years.

I would love to see the case law on this if there is any. I'm sure it fall under unreasonable search and seizure. As many have stated, courts have ruled an officer cannot delay a traffic stop to wait for a dog to show up. Here they waited an hour and during that time they prevent Brandon from taken his property and leave.

The police will say things just to have it on their body camera audio and video recording whether it’s true or not it doesn’t matter to them. There is always one spewing "End Qualified Immunity". Take a moment and research what QI is, what it does and how it works. QI isn't the issue here. QI, working as it should work would have no affect here. IF the LEO violates his civil rights or breaks a law, QI is revoked anyway. The REAL issue isn't QI, instead the issue is corruption, cover-ups and NOT holding LEOs accountable to their actions. If you end QI, you still have cover-ups, back covering and no accountability.

He asked the perfect questions. Making the cop admit to all the violations. Especially when the ticket is already visibly done on camera, and they still didn't call for the dog yet. Literally incriminating themselves for a lawsuit.

There have been court cases thrown out because of holding a driver too long and not to this extent. SCOTUS has said that the traffic stops have to be short and precise. This is an illegal attempt to search his car.

He needed to point this out to the pig. He needed to verbally let him know that the ticket is done and you can't hold me longer while waiting on the dog. I believe voicing that to the cop may have helped him leave. Maybe not but if they understand you know its against the law they may be less likely to detain you for any longer.

Its impressive the way that 5 months in a police "academy" makes someone an expert in human behavior, neurology, psychology, and magically gives them the expertise to recognize, WITHIN SECONDS OF MEETING THEM, that a total stranger seated in a car is abnormally nervous.

I have NEVER seen an officer lie to someone as much as this one did. At one point he tells the driver, "We aren't violating any of your rights", when he should have said "We aren't violating all of you rights, yet But if you give us enough time, we will".

For those of you not familiar with New Mexico their Cops are the worst. They Illegally raided a Family's Trailer from Upstate New York who were Traveling Across Country making a KZbin Documentary. They made the Father come out of the Shower and made him stand Naked while they searched the Trailer while they had No Probable Cause to do so. Then in another Instance one of their Police Departments was raided by the State Police on account their head Chief had illegal materials from Cases on his Phone and was bullying people into voting for the Local Mayor. Stay as far away from New Mexico Law Enforcement as you can!

Taking the word of a dog is ripe for corruption.. this all goes down to pre crime prevention.. the police are supposed to be reactionary they're not supposed to be going in and searching everybody's everything to find crimes that have no victim.. but they are incentivized by raises hours overtime etc to try to find crimes and charges when there is no victim.

I was young and dumb. Got pulled over and he found my weed. After he had all my weed he searched my car abd proceeded to dump out all my groceries on the driver floorboards. They're pricks for the sake of being pricks. There is no reason to open a plastic sealed box of cereal and dump it out.

I think this is the first time I have seen them get a search warrant for a vehicle at a traffic stop. The judge/magistrate who approved that search warrant needs to be help accountable by the electorate.

Ahh, but when it comes to the big, bad, boogeyman of "drugs", the public will allow any transgression against their rights...drug prohibition has LITERALLY given the poluce more power and eroded our civil rights more than any other policy since arguably the anti-free speech laws of World War One....since Nixon launched the War on Drugs in 1971, the Supreme Court has made.mpre decisions eroding the 4th amendment on drug cases than any other type of case, the majority of warrantless vehicle searches cite "drug related evidence" as their probable cause, 96% of all no-knock warrants are drug related, and at least half of all arrests every year are drug realted....just take a minute to imagine what would happen to the power of the police, and their budgets, if drug laws didn't exist.....just think about it... ....well, half or more of their arrest numbers would evaporate....so that would mean the justification for half their budget would evaporate....let's see....do you see the cops going on all these fishing expeditions during traffic stops for guns and bombs? Do you see them threatening nearly everyone they pull over with the drug dog for anything besides drugS? Of course not....without drug laws, policing would become rather boring....and they might be forced to solve REAL crimes with victims, like murder and sexual assault (BTW, the average sentence for a drug offender is longer than that of a sex offender in America). It's been predicted that if drug prohibition was ended, upwards of ONE MILLION positions in law enforcement would be made redundant....could you imagine how much better things would be with that many fewer cops? Buy the cops know this, and this is why Police Unions have spent more money than any other entity on opposing legislation and ballot initiatives aimed at drug law reform, because they know that without drug laws they'd lose most of their money and power.

@@Stayjolly33 pre-signed court order? As in it was signed before the stop even took place? I doubt that as it would be clear violation of the 4th amendment. There are anticipatory search warrants, but those at least are more specific. To get a search warrant there still needs to be probable cause.

@@foible2085 it’s totally a violation of rights, but they do it, depending on where you are “reasonable suspicion” can really just mean the cop wants to search and atleast in TN I know that they can “get a warrant” in under 5 minutes at 2:30 in the morning, with no reasonable suspicion because I’ve had it happen to me

Whenever being questioned about looking nervous I say this... "I'm always nervous around people when they have guns and I do not. Wouldn't it be reasonable to say IF I were carrying a gun and you were not, you would be nervous as well?" Gets them every time

The "You're pretty nervous" act they pull has to stop. Me not liking conversation can be enough to make me nervous on a stop where I'm forced to converse for you. Social anxieties aren't a crime or reasonable as a means to establish suspicion of a crime you have no reason to be investigating/creating in your head actively.

For those who don't live in New Mexico law enforcement no longer has qualified immunity to hide behind in this state. Officer can be held liable in court for their actions while on duty.

I was born and raised there but I moved away permanently about 24 years ago because I could no longer accept living in a state where the primary goal of the entire legal system was to make the lives of poor people as miserable as possible while making money off of their misery. I have many good memories of New Mexico but I don't miss it and I will never go back. It is nice to know about them losing qualified immunity, maybe now future generations stand a chance. I know this is getting long but I just want to add that when you turn a class of citizens into criminals you have a class of criminals to worry about.
