This truly saddens me as someone who has always looked up to the hallowed ideals of the American nation. America is a broken country. It is the Rome of this age...
@AtandraAnwesh9 жыл бұрын
David n I never said my country was any better or worse. There is no need for you to take what i said personally. All i was trying to say was that the US is supposed to be an ideal, the shining city on the hill, that we all look up and aspire to be a part of, if not emulate. It is meant to be a symbol of what an nation is meant to be, what a nation can aspire to achieve. And you did make a lot of progress in that regard. You have come so far since your forefathers courageously dreamt a dream of liberty and the pursuit of happiness when most men were content to wallow in their wretchedness. But today the reality seems further than ever from the lofty goal that your founding fathers set for your nation. And that makes me sad. You had the opportunity but let it slip by, unwittingly, unlike some who never really had a chance, let alone a choice in the matter. I wish the US had done better. That is all... Hope it is still not too late.

"Personally I'm in favor of democracy, which means that the central institutions in the society have to be under popular control. Now, under capitalism we can't have democracy by definition. Capitalism is a system in which the central institutions of society are in principle under autocratic control. Thus, a corporation or an industry is, if we were to think of it in political terms, fascist; that is, it has tight control at the top and strict obedience has to be established at every level -- there's a little bargaining, a little give and take, but the line of authority is perfectly straightforward. Just as I'm opposed to political fascism, I'm opposed to economic fascism. I think that until major institutions of society are under the popular control of participants and communities, it's pointless to talk about democracy." --NOAM CHOMSKY

DootDoot That's one quote to remember. The people have shown their ability to break the power of corporations before. But the American people either don't know they have that power or they don't realise the urgency to take action. As a european, I can only hope that changes in time, because there are matters in this world we can't take on on our own, and corporations surely won't want to.

That's only a problem if those judges had to run their own campaigns to get elected, because they might get donations from interest groups and corporations, but if those judges are being selected in a similar way to how the Supreme Court Justices are, then it should probably remain the same.
@CarmenRosaMarisolZoila9 жыл бұрын
But why run a campaign? Why should anyone get elected? It should be the exact same regime as it is for attorneys. You take an exam ( granted, this one's for a judgeship so it must have multiple stages and be basically excruciating) than only reflects how much u know about the law and how well you understand the position you will be in. This way you scrape out shitty jurists who have no clue on what planet they live on and eliminate the chance for them to get or give money for the job.

I see a lot of comments about how stupid America is for electing judges (and I'm not denying it) but many of these laws were made right after the Revolution. At the time, elections were the best route because they were the most "fair" as in they couldn't be rigged yet. But it's 2016, we need to go back and look at many of the laws passed and revise/remove them. Maybe if we actually looked around, we would see the successful changes other countries have made and adopt them.

Kristian Kumpula There are two ways to become a judge. One is to be elected and one is due to partisan politics. There are very few judges, especially the Supreme Court judges that follow the law or Constitution as written. "Chief Justice Allen Loughry was removed as chief justice, suspended from the court, impeached on seven charges, convicted of 11 charges, resigned before being tried for removal from office and sentenced to 24 months in prison. " en.wikipedia.org/wiki/Impeachment_of_the_Supreme_Court_of_Appeals_of_West_Virginia "The impeachment charges come on top of earlier federal criminal charges against Loughry and Justice Menis E. Ketchum II, who retired from the court in late July, just days before he was charged with federal wire fraud. Loughry is accused of taking a historically significant desk, called the Cass Gilbert desk, to his private home for personal use. He also is accused of using a government vehicle and submitting mileage claims for reimbursement, as well as using a state vehicle and credit card on personal trips. Loughry was also indicted on an obstruction of justice charge related to a pending federal grand jury investigation. Loughry pleaded not guilty to the charges and was released on bond, according to court documents. He is suspended without pay and prohibited from hearing cases during judicial disciplinary proceedings, according to the court’s website." www.cnn.com/2018/08/14/politics/west-virginia-supreme-court-impeach-trnd

Here in Canada, our judges are appointed which is often criticized, however it makes sense when you consider that judges should be the last people who should be worried about having enough votes to keep their jobs. They would be less likely to come to controversial but just decisions, such as removing the ban on gay marriage in Alabama out of fear of being ousted the next year.
@Graysonn19 жыл бұрын
The idea is that the judiciary appoints its own judges with oversight from the legislative branch of government. That way neither the people or politicians get to interfere unless the judges are breaking the law. Its the same here in Ireland.

My ex girlfriend made up allegations against me and filed for a restraining order. When talking to my lawyer he said that there was bassicly no point fighting the protection order and that the best thing to do was just agree to comply. When I asked why he said because the judge will grant a protection order because if he doesn't then i went and hurt her it would look bad on him. So bassicly there was nothing to lose for him by granting it, but it was an election risk if he denied it. I have to commend John and his writers and researchers etc. For being on point with criminal justice issues. I've personally dealt with many of the issues he's talked about and want to say thank you for bringing attention to them.

Our entire government works this way. It's not just judges. Our commander in chief is also elected, and much of the campaigns even for this position have nothing to do with the candidate's qualifications to assume such a role. I've seen judge's campaigns, and the ratio of meaningless ads to relevant ads is not any different than any other electoral process in local, state, or federal government. This is the price of getting popular vote, and having a representative democracy. If you agree with this video, you area also ready to rip up the entire fabric of how the USA government operates. If you're prepared to do that, you sure as heck better have a plan for how you'd put it back together... and that's the challenge. Super easy to ridicule all sorts of systems. Pretty darn hard to put your mind to work to think of a truly wholistic solution.
@birdn4t0r74 жыл бұрын
except the judiciary is designed to be a check and balance on the elected system, and were supposed to be appointed because they would be less subject to election pressures. that's the whole purpose of them.

I realise you wrote this five years ago so it might be unfair to pick on you, but most other countries get on fine without electing judges. Not every role in society needs to involve the whole populace, most of them don't have the experience or time to make an informed choice in that regard.

Connecticut created a criminal justice commission back in 1984 that appoints state attorneys (prosecutors), which is made up of two judges and five attorneys. Judges are evaluated and recommended by a judicial selection commission, which is made up of of attorneys and lay people appointed by the Governor and top members of both parties in the state legislature for a three year term.
