पिता के जीवित रहते बेटी की मृत्यु (2018) हो जाने पर बेटी का उत्तराधिकारी क्या बेटी के पिता या भाई से संपत्ति से ले सकता है ? जबकि बेटी के मृत्यु के बाद बेटी के पिता की भी मृत्यु (2020) हो जाती है तो बेटी का उत्तराधिकारी का अपने नाना के संपति में क्या अधिकार होगा , hindu , and muslim law

At 16:34 the daughter who takes consideration in lieu of her inheritance rights can still claim her share because muslim law doesn't recognise spes succesionis. But she will have to account for the consideration recieved by her . I think you missed this point or skipped this to make the video brief. Thanks !!

Suleman Khan, a Khoja Muslim inherited a farm house from his father Salem Khan and started living in his newly constructed bunglow with his friend Suneel Kapur, who was working with him in a Tyme Cinema MNC at West Mumbai. Suleman was relocated to Italy, by his organization and decided to migrate there. In the farewell that was organized at that farm house for him where after consuming alcohol he declared before his friends that he was gifting the farm house he inherited from his father to Suneel Kapur, who smiled and gave him a hug with tears in his eyes. After that farewell party Suneel Kapur stayed back at the farm house with Suleman Khan till early morning and from there directly went to the airport for his shooting assignment scheduled in Switzerland. Giving instruction to a lawyer for mutation regarding farm house, Suleman boarded the flight to Italy but died in the air crash. His brother Raheel Khan sues for the possession of the farm house on the ground that the gift was not completed as per the provisions of Muslim law. Questions???? 1. Whether Suleman Khan was competent to Gift that property ? 2. Whether Gift was complete as per the provisions of Muslim Law ? 3. Whether Raheel Khan is entitled to possess the farm house and inherit it ? Sir please explain this

मेरे दादा जी के दो पुत्र थे दोनों ही दादा जी के जीवन काल में ही मृत्यु हो गई। और दादा जी ने अपनी मृत्यु से पहले ही अपनी वसीयत 2002 अपने दोनो पुत्रों के बच्चो के नाम कर दी थी जिसमे दादा जी के एक मकान था उसके दो हिस्से करके दोनो पुत्रों में बांट दिया स्व छोटे पुत्र की पत्नी ने अपना घर बेच दिया था। तथा दो दुकानें भी है जो नगरपालिका के अंतर्गत आती है जिसके किराए दार स्व बड़े पुत्र के बच्चे हैं और दादा जी ने अपनी रजिस्टर्ड वसीयत में ये साफ साफ लिखा है कि मेरा स्व छोटे पुत्र की पत्नी वा बच्चे जिस मकान में रहते हैं उसके ही स्वामी होंगे अन्य किसी भी समत्ति में उनका की दख़ल नही होगा। तथा दादा जी का एक छोटा सा खेत भी है वसीयत के आधार अनुसार उसका दाखिल खारिज स्व बड़े पुत्र के बच्चो के नाम दाखिल खारिज हो चुका है।अतः अब 20 साल बाद स्व छोटे पुत्र की पत्नीकी नियत बिगड़ गई और उसने कोर्ट में केस पूरी प्रॉपर्टी पर कर दिया और उन दुकानों पर जो नगरपालिका की है अतः मैं ये पूछना चाहता हूं की दुकानें तो निजी संपत्ति में नही आती और जो घर स्व छोटे पुत्र की पत्नी ने बेचा है बड़े पुत्र के बच्चों को उसकी भी नोटरी है।इस पर आपकी राय क्या है।

(All Sunni Muslim) Through former husband Mrs. A has 2 sons R and I. Mrs. A remarries Mr. B. Out of this marriage no sons / daughters were born. Mr. B dies intestate. So should we consider that Mrs. A is a CHILDLESS WIDOW. Mr. B through his earlier marriage had 3 sons, wherein 2 sons died before Mr. B. Only one son is alive. How the shares will be divided between deceased 2 sons legal heirs, living Son and living Widow in the property of Mr. B? Will the legal heirs of the deceased son gets any share in B's property? If we consider her CHILDLESS WIDOW then as per Shariat Law, a Childless Widow will inherit 1/4th share in the deceased’s property. Will the step-sons R and I can get any share in Mr. B's property as per Shariat Law? Please help.

सर मेरे दादा जी ने आबादी क्षेत्र की अपनी पुश्तैनी जमीन *(जिसके खेसरा में अभी भी दादाजी के पिता का नाम दर्ज है) का बंटवारा अपने भाई की आपसी सहमति से 41 वर्ष पूर्व ही कर लिये था किंतु कोई लिखा-पढ़ी नही करवाये थे।अपने हिस्से के 1/2 भाग पर दादाजी ने 40 वर्ष पूर्व स्वयं के खर्च से बिना किसी विवाद के मकान बनवा लिए थे,जिसका 40 वर्ष से गृहकर,जलकर,बिजली बिल,राशन कार्ड सब दादाजी का नाम से है। क्या दादाजी की मृत्यु के पश्चात केवल उस मकान की जमीन के खेसरे का नामांतरण करवाया जा सकता है? एवं क्या खेसरे में मेरे दादाजी के वारिसों का ही नाम केवल दर्ज होगा या दादाजी के भाई के वारिसों का नाम भी दर्ज होगा?

The same girl tortured me and harassed my husband to get us out of house owned by father in law. Now we are living in a rented house and the only purpose of my in laws to get us out was that they didn't like me before marriage. Good Morning sir,Am attaching my Query Clearly note down the points, 1)My Grandfather aquires the property (16 acres of Land),In that 8 acres he got from his father, Remaining 8 acres (his self acquired Property),My Grandfather died in 1995-1996,He has not written any will,he died intestate .My Grand father has Four Daughters,One Son.After that Village revenue officer without informing us mutated the land in the name of (half in the name of My uncle only Son and Remaining half in the name of My Grand Mother).My grand mother died in 2002,the property which was there in the Name of my grand mother was transferred to my uncle name with the help of Village revenue officer.Now My mother has any right to claim for her share. 2)Is Andhra Pradesh state succession act 1986 is still applicable in the state of Andhra Pradesh and Telangana.

I am the only daughter of my father. He left my mother & me without giving anything & got married to another woman but he had no sons/daughter from my step-mother so they adopted a girl from relatives. My grand father had a ancestral property so I asked my father for that property as he has no sons/daughters except me. But he refused to give it to me & planning to sell the property without knowing me. So please advice me regarding this according to both Indian law and muslim law. Thank you
