Really clear and concise explanation! In the circumstances where deceased has 2 daughters, wife, 2 deceased brothers (with sons) and 2 living brother and one sister, how will the property be divided. After wife and daughters share, will the brothers be residuaries or sharer? And by how much? Thanks.

Suleman Khan, a Khoja Muslim inherited a farm house from his father Salem Khan and started living in his newly constructed bunglow with his friend Suneel Kapur, who was working with him in a Tyme Cinema MNC at West Mumbai. Suleman was relocated to Italy, by his organization and decided to migrate there. In the farewell that was organized at that farm house for him where after consuming alcohol he declared before his friends that he was gifting the farm house he inherited from his father to Suneel Kapur, who smiled and gave him a hug with tears in his eyes. After that farewell party Suneel Kapur stayed back at the farm house with Suleman Khan till early morning and from there directly went to the airport for his shooting assignment scheduled in Switzerland. Giving instruction to a lawyer for mutation regarding farm house, Suleman boarded the flight to Italy but died in the air crash. His brother Raheel Khan sues for the possession of the farm house on the ground that the gift was not completed as per the provisions of Muslim law. Questions???? 1. Whether Suleman Khan was competent to Gift that property ? 2. Whether Gift was complete as per the provisions of Muslim Law ? 3. Whether Raheel Khan is entitled to possess the farm house and inherit it ? Sir please explain this

If son's son is present then father gets only 1/6 and son's son gets residue If sons's daughter two of them are present then daughters get 2/3 and father gets residue Hope that's clear

Now, sisters deceased are claiming their rights while my father told us by oral will that sisters have no claim in property as property was released from mortgage and long litigation. Case 1: A dead man left 2 daughters but no son (2/3), father (1/6), mother (1/6) and wife (1/8). Adding the proportions the total property (27/24) becomes more than 100% ! Case 2: A dead man left 1 daughter but no son (1/2), father (1/6), mother (1/6) and wife (1/8). Adding the proportions the the total property (23/24) becomes less 100% ! I will be glad if someone knowledgable can correct me if the proportions are wrong. If not, how can they be explained? I am more interested to know about case 1 as I think for case 2 it is understandable that the leftover property may be distributed as residues (if the proportions are correct). Thanks.
