"Now go yell at somebody else." Arraignment judges are the best on this show. Another judge in a different episode, upon hearing a claim that a drug dealer/murder suspect was "roughed up" by the police in custody the judge said "I'm hearing violins counselor. Remanded."

There was an early episode where a daughter received a kidney and the donor lived. The daughter asked McCoy: "What's the harm?". McCoy said "Do you think your father would have behaved differently if you needed a heart?" Stunned silence.

Ben Stone actually. Doctor stole a perfect match from an unwilling patient. Man said he felt raped and violated, and showed off his scar. The Daughter said he was paid enough where he could essentially retire... But he did not ask for that and had no choice in the matter. He felt that the only way he could get true justice was to get back his kidney.

There was a similar case in 1976 (People v Stewart) where a guy stabbed another guy and he died in the hospital but not from the stab wound. The guy who stabbed him was convicted of manslaughter but not murder.

In emergency circumstances, you do the best with what you have but that doesn't mean the standard is universal. In certain situations (particularly in high-stress scenarios), a layman will not be able to accurately determine if someone is breathing or even if they are alive.

I have a question. If you steal someone's organ, and the victim survived but needs the organ back to survive. Can they demand it back? Legally? It would in theory cause the death of the recipient but could they let the victim die so the perpetrator lives?

also successful organ retransplantation....very rare like happened less than 10 times worldwide. The reuse of transplanted organs is not really suggested because it is risky - it is new and the possibility of rejection of the organ is greater, something about scar tissue and healing and rehealing.

if it were possible for the operation to be reversed, then likely yes. there's precedent that a person cannot be compelled to donate an organ to save another's life even if they *can* survive without it, they certainly wouldn't be compelled to forfeit their own life to allow someone to steal their organs.

The guy had to ask for directions because this was before cell phones and mainstream automobile GPS devices were common. it wasn't until this episode was made (and was likely written a year or more earlier) that Garmin released the first reasonably affordable (still pricey) GPS device - the Street Pilot. And it wouldn't be until several years later before they were good and common.

Muscle spasms. Right. No anesthetic b/c of "brain death". If you administered anesthesia, the brain death is hard to sell. But give paralytics ... to a dead person. Because most corpses need to be chemically restrained when you start to cut, spread and cauterize them. Do they give paralytics before an autopsy? Never.

Patients with no brainstem activity can still have spinal reflexes and they will also still have tone in their abdominal muscles making it very difficult to get the exposure necessary to recover organs without giving a paralytic agent.

Yes, and they recently found out there is more brain function than they previously had thought in the “brain dead.” Also it’s not uncommon for “brain dead” donors to wake up before donating, even minutes before. Seems better to be more cautious and rely on the former definition of death, dead was the cessation of respiratory, circulatory And brain function, not just brain function.

The Doctor said she was brain dead, but he took out a medication that, but her to sleep and he took her Heart and lungs so he could get a better job at another hospital. Jack McCoy asked the doctor if she was brain dead why did you use the medication. So she didn't wake up when he took her organs.

There were two paths for organ donation (now three, but the third is not relevant here). In one the patient is pronounce dead by neurological criteria. Most state laws say this should be done in accordance with medical criteria, which usually means the hospitals procedures. In this case, once the patient is pronounced dead, the OPO (organ procurement organization) assumes management of the donor. Once they have evaluated the donor and placed the organs, the patient is taken to the OR, the organs recovered and everything shut off. In the second, called donation after cardiac death (DCD), the family has decided to remove the patient from life support and has agreed to organ donation. The patient is taken to the operating room and all support is withdrawn. Once the patient is dead by cardiac criteria, the organs are recovered. Usually, the organs are only recovered is the heart stops within 30 minutes of removal of support. Occasionally, these patients do not die after removal of support. Interestingly, New York is the only state in which you cannot be pronounced dead by neurological criteria (brain death) if someone close to the patient says that the patient did not accept the concept of brain death. In any case, donors are never "technically alive" when the organs are recovered.

One of the scariest movies I ever saw was “Turistas” where they have this tourists visit this country all from western countries and they drug them and harvest their organs, operating on them and taking all their organs out. They were all hot waiting on a broke down bus somewhere in South America when they see these 2 girls with exotic drinks from the beach. The girls were sent to lure them. So they all go down to the beach to get a cool drink. The brother that’s looking after his sister and her friend, doesn’t want an alcoholic drink, you can see his intuition and gut kicking in so he has a coke, and they all end up the next day passed out near the waves, and robbed. It just gets worse from there.

That’s awful, but also really unlikely. The last people a crime organization is going to steal organs from is a bus full of tourists with people back home who will look for them. Maybe a car full if they did something wrong, but not a random bus full. Cartels aren’t really into organs anyway, that’s a Chinese organized crime thing. It’s also NEVER a good idea to wander off in an unfamiliar country and area, because getting robbed is SUPER likely.

In the tv series The Closer, the cops apprehended a doctor who harvested a group of teens' organs and send them to patients who needs them. The doctor targeted a certain group of teens who did bad things to... (a girl perhaps (?) and raped her (I don't recall exactly but I think it's the only explanation))... so he murdered them by extracting those organs. The cops watched the whole thing (last teen on the list to have his organs harvested) through bullet resistant glass windows since they can't get through the barricaded doors. Before opening the doors to be willingly arrested, he told the cops to bring the "donated organs" to the respective hospitals asap and not waste them.

He isn't killing anyone by refusing to allow himself to be butchered. The disease killed them. Organ transplants don't work all the time, and there are still side effects. Let him decide what he wants done with his own corpse. We don't shame people for wanting to be buried instead of cremated; you shouldn't shame people for not wanting their organs harvested. It can happen while he is still alive the same way people still wake up at their own funeral or in the morgue in this day and age. People mess up. People get greedy.

Sexual harassment was never cool for the people who had to deal with it. She developed survival instincts but she shouldn't have had to. Harassment was a crime then just like it is now. It just gets called out and reported more

omg totally right!!! I love it when people are harassed! It's so funny when people don't take no for an answer!!! okay seriously tho, that man not taking no for an answer was really gross, and normalizing that kind of behavior is also really gross. god i mean it isn't rocket science

I like the episode where they talk about if a guy shoots a dead body, but they thought they were alive, then they are still guilty of attempted murder. Im curious, some lawyer tell me if that is true.

i do agree that man on trial that hiss speaking his wife yes I believe and I agree with him I do believe that she’s alive the whole courtroom knows it the peopleInCourtroom knows it and the jury knows it or the man on trial knows it or the judge knows it cause they don’t care what they think and every inch of all of those in the room they all know that his wife is seriously alive and they know it

i feel that just looking at a person, can grant you the skills to notice their chest rising and falling. ergo they are breathing. this is a basic observation that even children of 6 or even less years of age can determine. it's kinda a basic human understanding. such as, is this person blinking? i feel most folks can tell the difference between sleeping and being dead. cause one of them, you are not breathing.... i may not be a medical dr, but i am a functioning human being. i feel that everyone who is alive is also able to determine these factors via basic observation. even if they are blind, they probably can tell if someone is breathing....

There are spinal reflexes that can occur during an apnea test that may appear to be breathing to an untrained observer, but are not inconsistent with a diagnosis of brain death.
