Yeah but… it sat there for months.. hundreds of people went through it and there are pics and video of every mm of it. It sat there like a horrifying reminder for the students and family..

Agreed! Anyone that’s done a deep dive on this case knows it was a very unusual layout & takes some real concentration to kind of mentally put together. As a juror I’d definitely need to understand the house & the path he took, how he’d know where to go, how he could’ve missed D, how he got in & out so quickly. A little over confident if you ask me, should have given them a walk through!

@@jessdeeES Unusual layout indeed. It has been referred to as a party house. If so, where did the partying take place...in the bedrooms? The perp, I should think, had to have some knowledge of the floor plan. Pictures and so forth are a poor substitute for a walk through. The case is totally bizarre, and BK fills the bill. I sense that he has prepared himself for the long haul and the case will go on forever and a day.

The guy with the hair glossed over/ignored the salient feature you are highlighting: prosecution is required by law to hand over 100% of everything they find that could be exculpatory or that could help to convict. Prosecution is currently holding back lots of that 5% that was used to arrest BK in the first place. Rather than giving to the defense info they could use and are requesting, the prosecution is instead giving them a mountain of unimportant/irrelevant information, all of which has to be combed through by one or more members of the defense team. I'm still on the fence.

@tarico4436- how do you know that he "evidence" that is supposedly held back is what was used in arrest warrant? I hear its documents that FBI has, prosecution can't provide what they don't have. Info is not necessarily info on arrest warrant.

The bottom line is that he is innocent until proven guilty. What they have turned over doesn't matter when the stuff they haven't turned over is what they are using to say it was him and is the evidence they used to get a search warrant. The state needs to do better for the victims.

There is no crime scene because it’s been mapped many times, there’s pictures, videos, maps and 3D walk throughs made with the photos, those are part of the 50tb I’d assume, so that’s why it doesn’t exist anymore, everyone was fine with that choice or they wouldn’t have been able to do it.

I'm so sympathetic to the families and their desire for this to move forward, but for the sake of true justice, the process needs to take however long it takes. Better to take appropriate steps and vet everything out than to rush it and have the case overturned on a technicality or in appeals.

The murder required a lot of planning. So your telling me these times his phone pinged at that favorite park, he wasn’t planning to do that so there was a history as part of his alibi? He could have totally done that. I mean he was even researching BTK and playing investigator, applying for a job at the department. I hope it comes out why they wouldn’t hire him. Lets get this trial started. The evidence needs to come out.

Pings don't tell you where a cellphone is. They tell you what towers the cellphone connected to which, in rural areas, might not mean much because towers have to service larger areas.

The prosecution is asking for closed trials while the defense is asking for open trials. What is the prosecution trying to hide from the public? The prosecution is to blame for the delay and misinformation.

It’s not unusual in a quadruple homicide case for multiple requests for discovery. Also, just because they request it, doesn’t mean they’re entitled to it.

He is innocent until he is proven guilty. Sadly the media immediately sold him as guilty. But It looks really bad that evidence was contaminated, the house knocked down, and prosecution claiming they don't know why it is missing or. where evidence has gone to that was in their possession. The police officer that testified on this same day seems really amature as well, relying on others to accomplish his job. It looks Really bad for prosecution. I Can't say I am sold he is guilty when so much has been botched in the handling of this case. They need something more than the guy is weird to prove he is a killer. I'm not saying I'm sold he's innocent either. In saying this case lacks the proof and has too many holes and mishandling of important information.

Unless you have that kind of knowledge your not being fair in what is every Americans right.... the right to be perceived as innocent until he is proven and that means with evidence not your so called expertise. He is not guilty till he is proven guilty. That's just the way it is in America and we all have that right. If you predetermine he is guilty now and don't have any proof that's just false speculation... So unless you produce proof to back it up, all you just said to me was you just WANT him to be guilty. That is sad. No American should ever just want to take rights from another because we would not want that done to us. If you ever have to face a judge I hope you have the right to be innocent till proven guilty because it's sure crappy to have your rights taken away because some one else thinks they know it all but do not have proof.

If I was really innocent, i would want to go to trial asap - i could tell the jury where i was and why i turned off my phone in the middle of of the night. I could also tell them why i drove around their complex for months. If i was guilty, i would drag it out for any reason i could.

It is both frightening and saddening to see how many Americans want to throw due process out the window to satisfy some mob mentality emotions. This country needs to do better at educating its citizens on their rights and the processes of the legal system. Look at the de-evolution we get when people choose ignorance.

It really doesn’t matter that they turned over “15,000 pages of this or that,” the prosecution’s argument on that is very weak. It matters that they turn it ALL over. Our process grants defendants rights and those are important to make sure people are not convicted accidentally, which does happen in about 10% of jury trials. It’s important to stay accurate here as we’re talking about human lives here, of both the victims and the accused.

Guilt or innocence aside, I think it’s pretty sketchy the government doesn’t want to turn over info on how the DNA was investigated. Like they potentially don’t want the information on how they did it to be public because it may cause backlash due to privacy concerns, not backlash about this case of course, but the investigative process of the DNA in general.

I think the fact that the prosecution named ALL THAT EVIDENCE they’ve given the defense (basically a data dump to overwhelm the defense in my opinion) will only prove that the defense needs ALOTTT of time to go thru it efficiently. Thus dragging out the case

The knife sheath left behind seems like he wanted a challenge to be caught. A quadruple homicide seems to be pretty calculated and lengthy. it seems like a sheath would be key evidence he would NOT want to leave behind

It doesn't matter what you've given defense if it's not what they need and if around 82% of the geo data ( or whatever it's called that Sy Ray needs to verify BK`s phone's location) has still not been given. Also the picture widely shown of the vehicle passing the gas station appears to be staged and taken through the window with a phone as reflected in the window.

It isn't uncommon for trials to occur 3-4 years after the crime occurred. The delays are ridiculous, but that is the norm of most cases. This case is high profile, so it is imperative that everything goes smoothly to avoid BK filing for a mistrial.

It is very common to have multiple pretrial hearings. It is not as common to have so many that are dedicated to trying to make the prosecutors turn over discovery.

He set a deadline for the discovery to be turned over in September. Prosecution has already missed deadlines but hopefully they honor this one.

I don't know what state you practise law in, but this case *isn't* more complicated than other *multiple murder* cases. Ever watch 20/20 or Dateline?

Because the defense is going to try to muddy the case with all sorts of information about cell towers and pinging etc. They are hoping to confuse the jury into granting reasonable doubt. It will be interesting to see how the defense handles the DNA evidence.

It really shouldn't be, but a lot of the evidence has been edited or not turned over to the defense at all. It makes it a lot harder when it comes in pieces. Overall, this doesn't seem too complicated compared to other cases though, it just might seem that way because we're actually seeing more of the pretrial hearings (despite them being common in pretty much every case).

The entire way the police handled this case is nothing new. They were pressured to find a suspect; they are willing to take and do whatever necessary to get someone in custody. The college was losing students until they found someone responsible and the fallout from these murders was destroying the community. Therefore, the police are notorious for taking the first one that comes along that fits their narrative and whatever circumstantial evidence they have. If this guy is guilty I hope he ends up on death row, however, it should be done in the right way to make sure they do not have the wrong guy or the guy gets away because they violated every rule in the book.

18:46 defense doesn’t want said files. It’s against the law for prosecution to not turn over any exculpatory evidence. If you’d like to read up on it for futures I believe it’s Brady v Maryland or key words Brady violation.

This defense is wasting state money. That’s what their specialty is now. They cannot dispute the evidence they already are facing. Who cares if there is more proof of his guilt. There are all these unnecessary Professionals being paid to testify. Some getting $10-$15 thousand to speak for 15 minutes. It’s all bs and it doesn’t change any of the facts. He will challenge to decision or verdict anyway. Let’s go. Stop the bleeding of the Tax Payer.

NEWS FLASH: I found 3 videos right here on KZbin where the police were summoned to the house where these murders occurred because of wild parties and loud noise. During one encounter in which the police went to the home - none, yes NONE of the girls who lived there were even in the house. It's going to be a cake walk for the defense to show a jury that anyone and everyone was in that house and the residents had no idea who came and went. The prosecutor better start looking at a deal or they are going to be very, very sorry. This isn't an open and shut case - not by a long shot.
