And assuming the fans support her, which they seem to be doing, there's the added benefit that the masters these people paid $300 million for will become effectively worthless. If no one's buying or streaming the old versions and Taylor's only agreeing to licence the songs to TV/film/whatever on the condition that they use the new version, then the income stream from the old masters vanishes. The current owners will make no money from the rights and no one else is going to buy the rights from the current owners if there's no money coming in.

It's also an incentive for people to actually listen to the rerecordings instead. Not only that, but it's hi-stereo as well, which is a good incentive for audiophiles.

T-Swift might be one of the few artists who could actually pull the re-recording move off. Because her fanbase is fiercely loyal and might very well make a point of only streaming the versions she owns.

I love that Taylor Swift’s fans are valuing the person over the art. They are getting behind the new recordings because it supports HER. They may love the originals but they recognize that by listening to those it undermines what she is trying to do. I always get excited when women are valued as whole people, rather than simply for what they give us 🥰

Russell sued her because she wouldn't listen to his music. She has a no unsolicited submissions policy, but he was mad that her team upheld that. He also harassed her mother and brother to send her his song, and was literally on camera saying that he was only suing her so that she would have to come to Utah and have dinner with him. Full on creep.

Her testimony in that assault case was really powerful, he and his lawyers were determined to play dirty but I was so impressed at how she stood her ground (plus, the decision she and her attorney seemingly made to consistently say that he grabbed her ass rather than dance around the act with polite niceties like his lawyers wanted to was very smart). Also, big news on the re-recording front, her re-recording of The Other Side of the Door on Fearless (TV) recently was the first of her songs to surpass its original in total streams on Spotify! Great news for her and hopefully will give other artists in similar positions hope that it can work.

I never used to be a Taylor fan but she has really grown and perfected her skills over the years, her guitar playing in particular. I'm thinking it would actually be beneficial in this case to re-record. I love how Chris Brown can be such an asshole publicly but she's just existing and getting sued.

Yeah, most of the guitars on folklore and evermore are probably her collaborators, but those two records alone show how much she’s grown as a singer and a songwriter as well. (I don’t know enough about her live guitar playing to comment on that.)

@@defordtunes I'm not well-versed in guitar but it was so amazing for me when she increased the intensity of strumming after the second chorus, as well as the transition from the aggressive strumming to the plucking after the bridge. I really loved the breakdown of the first case and I also love how people sees this as a big deal because it is!! Because of this entire masters fiasco, Olivia Rodrigo actually owns all the masters and rights to her debut album SOUR. A lot of people really paid attention to what was happening and I'm so glad people are being inspired by it and taking action. Love her or hate her, Taylor is shaping the future of the music industry.

I think a big part of both the $1 lawsuit and her decision to rerecord has to do with precedence. She's making sure small/up and coming artists know how valuable their work is so they'll be more confident when negotiating their own contracts. And she's made a point about both our judicial system and just.. she's absolutely destroyed that abuser in the classiest way. She didn't want his money, she didn't need it, she wanted the whole world to know that she was right and he got what he deserved. She didn't even publicize it until he sued her. She addressed HR through the proper channels and his company made the decision per their internal process that his behavior was a liability. 🤷

And the great thing is that it’s working. She’s such a massive star that her fights for her masters are headlines and that influences those looking to join the industry. Like how Olivia Rodrigo, who recently signed to a record label, has complete ownership of all of her masters (if i remember correctly)

There are noticeable differences in the new recordings of Fearless, but I refuse to stream the old versions to not give Big Machine any money. Since I have a physical copy that i had bought years ago, I still listen to the old recordings from time to times, but I honestly do prefer the new versions, it also feels like I'm working against Scooter Braum (or however it is written the name) and I feel like a badass lol :)

Taylor also picked a fight with a streaming service over payment rates to small artists (I *believe* it was Apple Music, might’ve been Spotify) and pulled all her songs from the platform until they changed their monetization practices. Her music has always been hit or miss for me from era to era, but I always thought that was a really good thing to do - as much as it’s not ideal to rely on the Glitterati to hold people and companies accountable for screwing over the little guy, at least she’s getting results.

It was both Spotify and apple but apple changed their policy within 24 hours after Taylor wrote them an open letter. It took Spotify years to change.

You should look into her UMG contract too, she negotiated into it that if they sell of any of their Spotify shares a percentage of profits need to be distributed to all their artists too, I would love to understand more about how that can work

Which makes total sense since people can easily make countless email accounts to get unlimited free trials and if artists weren’t paid during that trial and people abuse it then when would they ever get compensated for it?

Taylor Swift is a prime example of what it's like for women in the music industry. She was ruthlessly "pummeled" by the media for every little thing she did. People would be made fun of if they liked her music. She was ridiculed for only making songs about her ex's, she was scared to post her political opinions online because of the media, etc. etc. And as much as I hate to say it. This never happened to any male in the music industry. And if it did, it would happen because the fan base of the singer was mostly female populated. Her decision to record all of her albums again, in my opinion, is brilliant and a great legal move. She owns those songs, she wrote them and they're about her life. Signing a contract doesn't change the actual owner of the songs, only the legal owner.

This same problem has happened to plenty of guys in the industry... More than women. Look up that ahole Saul and what he did to CCR and Fogerty. There are lots more. Spector was a producer. Read about him. That old Ahole even killed someone. You have only scratched the surface.

I'm not a T-Swift fan musically, but this first case with ownership is actually a really important case for future young artists trying to sign with record producers etc! Because obviously when you're new "to the scene", not used to how things work, even legal guardians can be so starstruck by the idea of a contract for their child that they are willing to sign away a lot more. Because obviously starting out, you don't know whether or not you will have success... so everything seems like a victory... then reality sets in as you get more into this whole world, and you become aware of how you don't even own your own work basically... luckily in this case it's "just" the masters, but many are not that "lucky"... and if no one does these things, speaks out about it, especially someone like T Swift with her platform and wide audience, people will keep signing terrible deals because in that moment it seems worth it... I remember Paramore having some issues with their old record label because the label wanted to have them marked as "emo rock", but they didn't actually want that? But then they managed to get out the contract and signed with another label. But ofc many fans were mad at their change in sound because they wanted the emo-music-ish to continue... but idk, imo it fit perfectly when it was released but the newer music is like "growing" with me lmao. So perfect in middle school with emo "me against society" type music, but now? Meh I love Hard Times so much lmao. And omg YES DO KESHA PLEASE!! I am so curious about that case, because media did such a weird job when covering it, it felt like it was basically slutshaming Kesha, so gave up trying to figure out what was happening... Also that photo is disgusting, but sadly the "well you smiled in the photo" comment is all way too common... like in Norway amnesty Norway is trying to change the consent/rape laws atm, because according to the Norwegian criminal laws, rape is only eligible if the person fights back or shows signs of "being held down/physically abused with bruises or scratches" etc... and that is horrible, because you don't even have to have studied psychology to know that in many cases with S assault (especially if you know the person), people will freeze. But according to the law it's only fight or flight.... but that's not reality in the slightest... like maybe if you get assaulted in the streets you'll get an urge to fight or flight, but if you see no way of escaping or you withdraw your consent etc, you will freeze if not respected.... funny thing is, they always say if someone attempts to rob you on the streets, just give them what they want... what happened then to fight or flight? Fucking hate the criminal justice system tbh

@@pugdad2555 yeah sadly that is the reality of it... but as Leeja says here, it's not jist fight or flight. The most common response is freeze. And if you know the assailant, you're also more likely to be in denial about what happens - which means any DNA etc evidence that can be found after, is now gone. And then you will be accused of the "you just regret sleeping with them, don't ruin their lives because you regret what YOU did".... it's horrible tbh... but sadly one of the harsh realities of society. Even when people finally manage to speak out about incest by a family member or similar, a lot of family members tend to victim blame, or even just flat out say you're making it up because x, y, z.... it's horrible... like yeah accusations can ruin a person's image... but assault ruins the survivor's psyche... so being accused of it, if not true is ofc not okay... but what if it is true? Like my sister's dad was accused of molesting his ex wife's son as a kid... my sister did not believe it what so ever, spoke poorly about the kid etc... but then like... 8yrs later when she got her first kid, a boy... ever since if he visits, she doesn't let him sleep over without having her two sons sleep in her bed.... but she still won't admit that it potentially happened - but ofc, it's her father... but even she has doubts... because if it IS true, then she basically sets her kids up to become his victims.. and he is a severe alcoholic, so he might not even recall doing anything because he is usually black-out drunk from noon... so yeah... interesting society we live in...

@@KrisHe1 but that is all due to parents teaching their kids to hide their pain because parents don't actually want to parent. We freeze because we are never taught what to do in those situation because we are always told to listen to your elders and/or you have to listen to your parents because of religion (which is proof of the cycle). But how many parents actually follow up with unless they are doing this something bad (describe rape/assault/harassment to a child). Not many. And it is just a cycle that we think it is part of society but it is not. It is a cycle that men in power want to continue. And if there is physical scarring that the survivor made while being attacked, they will have better memory and proof that they didn't want it. But we don't teach any of that.

@@pugdad2555 actually it's just flawed teachings in school when learning about evolution. Because in case of "survival of the fittest" darwinism, it is only fight or flight. But that has been disproven ages ago, and the brain actually has three reaction modes. Because it is controlled by the autonomic nervous system, which we as individuals cannot control in most parts. The smaller part of it (you divide into two parts), is stuff that can be controlled somewhat through breathing exercises etc, but reality is it is not possible to fight the autonomic nervous system. I have a bachelor in psychology, and currently studying to become a psychiatric nurse, so yeah that is one of the major flaws in basic science you learn in school - outdated science that no longer even relates to us, and the missed fact that we cannot control all parts of stress responses no matter how much we prepare or practice. Some yes, but more as you feel it coming on, once the nervous system is in full swing, you cannot choose to fight or flight, or freeze. Because it's a bodily response that can neither be controlled or stopped. Hence why many feel ashamed for not "fighting back" etc, because when telling about stuff like this happening, people ask well why didn't you fight... you can't when your body completely freezes. Like in the picture of that jackass full on grabbing TS' ass, my first thought is to push him away in disgust, not pose for a photo. But that's easy for me to say, a whole different thing if it was me in that moment. Afterwards you might realize that was NOT okay, but in the moment your whole body freezes up, many even start dissociating. Because the mind is being traumatized as well as the body, so it "shuts off".... ofc you can teach children right or wrong, what they COULD DO if able etc, but never shame them for not being able to react. It's a state of shock...

6:14 They weren't a big label, Big Machine was a very small label, owned by Scott Borchetta, and they owe the fact that they are known and big now, TO Taylor's success. So this is a huge part of it, a huge part of the reason why Scott did not want to let her go in any way he could, was because Taylor made his label, and was the biggest appeal to investors, etc, to the credibility of the label. That's why when she still decided to leave, despite all the ties he tried to put on her, his ego was so hurt that he refused to sell the masters to her AND sold them to someone whom he knew she despised, and that despised her, to get back at her for leaving his label, and "diminishing" its value.

I HATE when people try to say someone's reaction or lack of one means that they weren't upset or it wasn't that bad. Or even worse, a way to try and say someone actually enjoyed it. When I was assaulted (I was passed out drunk from a night out with friends) I woke up part way through and pretended to still be asleep because I panicked and froze and not reacting/pretending it wasn't happening was the only thing I felt like I could do to get through it. I didn't tell anyone for YEARS because I was convinced my lack of fighting back and that he was a friend meant no one would believe me. It was traumatizing and I didn't even realize how damaging pretending like it never happened was until I just broke down bawling in front of a friend after several depressive episodes. Freezing and pretending nothing is wrong is definitely a defense mechanism and shouldn't be used against a victim. So gross.

Im a huge taylor swift fan and I haven't touched the old version of fearless since she announced fearless Taylor's version. And she also added more songs to the new version (vault tracks) so it's not just the old songs, it gives more of an incentive to people to actually stream the re-recordings.

Me, knowing everything about Taylor and still watching this video. Her story is full of men thinking they can own and silence women, steal their art, their dignity and joy and get away with it. And she said "NO", and her fanbase rallied behind her. What Scott Borchetta did is inconceivable to me, and she had the balls to record "reputation", break touring records, leave his label, sing "better man" right to his face and go on to still be incredibly successful 15 years into her career. POWER MOVES!

He told her he would only record the song if he was given ownership of the song. She refused and he then refused to record the song. She recorded the song herself and it became a big hit for her. 20 years later Whitney Houston recorded the song with Dolly's permission. She actually used the latest audio technology and improved the songs in Taylor's version and included more songs (from the vault) which will devalue the original masters. I just received Fearless and Red (Taylor's Version) and they sound awesome. The most discouraging thing about sexual assault that's "just being touched inappropriately" is that so many men will never understand how invasive it feels, the shame, the humiliation and the anger that a single, short grab like that can induce. I learned it the hard way and it showed me how little empathy and understanding men are, generally, taught regarding sexual assault. Not having to worry about it at all is an issue in the way society treats that and it just makes me sad. Anyway. Good thing Taylor won that lawsuit and great video, as always

I fully stand on Tay on this one. The fact I can't even use her songs on my dance fitness videos only to be blocked by KZbin because of copyright issues baffles me. The fact multiple times i uploaded my dance fitness video to 'Style' back in 2015, it keeps getting blocked by YT. Now i understand the culprit is Big Machine who screwed this up. So in any case, i can't wait to hear Taylor's version of '1989'. Looking forward!

Honestly I felt for Taylor when she sued that DJ. It seems like nothing at first glance but once it happened to me, I understood it. One of my partner’s relatives grabbed me like that in front of an entire room of people & it was humiliating.

I read the whole book. He mentions another lawsuit against prostitutes who overcharged him so he makes himself sound litigious. I agree with the conclusion that others have made; he thought Taylor was going to have to be present in court if he sued her. He thought he would meet her. The whole book is him playing the victim. He thinks no one likes him because of facial paralysis but it's really because he's a jerk.

JoJo re-recorded her 2 albums too & couple singles. Because they weren't out on iTunes or Spotify for fans unless bought CD back in the day. She wasn't able to release music for a decade bc her old label Blackground sucks. They wouldn't let her out of her contract so she took them to court. Blackground is making a comeback too sadly so if anyone is wanting to listen to JoJos listen to her 2018 re records as she gets $ from that. Even Aaliyah her family or estate won't be getting $ from the music either.

So my birthdad used to own a local recording studio, and an interesting thing one of his friends commented on regarding re-recordings of masters is that when Roy Orbison was trying to re-record his masters in the 80's during a legal dispute over their ownership, they were matching 1:1 the musicians, the instruments, the sound engineers, even the same recording spaces in the re-records and the songs didn't sound the same. Why? Because the actual technology of the recording instruments had changed so much in the intervening years, it was impossible to capture the exact same sound without digging up those microphones and soundboards from the 60's! It's an interesting thing to think that technology improves by leaps and bounds in such a short time that even just the span of a couple of years can completely change the sound of a recording, all based on what instruments you use to capture it.

Synchronization rights! As I understand it the point of the re-recordings are the sych rights. Wiki puts it nicely "When an audio/visual project producer wants to use a recording in their work, they must contact both the owner of the sound recording (record label of the performer), and the owner of the composition (publishing company of the songwriter)" She controls her own publishing and by re-recording she can deny the owners of her masters the possibility to use her recordings in any audiovisual project and still be able to offer the same work herself. They own her masters but can't really do anything with them(except re-release them but which one would you buy, the Swift approved one or the other?).

The fans are all on board for the re-recording because we have always thought Taylor "performs live better than studio" and over time whenever grown up Taylor sings older songs, we ALWAYS love them. This case With Taylor is unique . But I've always been fascinated by the most unique situation in Music History . It's the most bizaar Situation with Metallica and Dave Mustaine . Dave joined Metallica in 1981. He brought in Two Original Songs he wrote Completely from his other Band . But the Songs were Lyrically Re-written by James Hetfield of Metallica . The Melody of the Song Jump In the Fire was kept the same but the Lyrics were Re-written . The other Song Mechanix was then Lyrically Re-written and Riff parts were added to the melody to make a new Song called Four Horsemen .Dave was booted out of Metallica before either song was Recorded . Dave then Started his new Band Megadeth in 1983 , and took his original Mechanix Song , and put it on his debut Album . Metallica never sued Dave for Copy Right Infringement Since Dave was a Key Composer / Contributor of the Mechanix and Four Horsemen songs . So in essence Dave gets Music Royalties for Both songs even as similar as they are . I mean if a Composer Writes a Song for a band as a Member of the Band , does this mean that the Composer can leave that band with the Composition and just add a Different Tempo and new Lyrics to it then release it as a New original Song without getting sued ? I mean it would be like if Don Felder wrote the Guitar Composition For Hotel California then went out and wrote some new Lyrics to that Song with a new Song Title and then put it on his own Solo Album.

Her re-recordings sound 10x better anyway. I’m glad she’s taking her power back and gaining control of what was her’s in the first place. I’m so curious to see what she will do with the next four records. I have since removed the original Fearless and Red from my Spotify.

What you should watch is her teach others (young men and young women) after the dust settles to not be fleeced by these bandits. I have a sneaking suspicion that she will start producing and steering young artists away from these less than honest and reputable crooks in the entertainment business. She is far from done with them. The cries, The wails, The nashing of teeth. LOL

A lot of bands and artists are "covering" their own songs, and only having to pay the "owners" of the songs a licensing fee.

To me the counter Sue for $1 said I don’t need this money I just need justice. Because I know that the media would twist it into saying she just is doing it for the money. They do a lot of shit to her and as a Swiftie I back her up.

Taylor has always been exceptionally kind to her fans. Sending her own version of stimulus checks, sending christmas presents with handwritten personal notes, inviting fans to her home and baking them cookies, even the backstage parties that you dont have to pay extra for. Its no wonder fans have her back

I don't live in the US, I'm not a lawyer and most of you videos are about people/things I don't even know, but even though, I love to watch them! It's such a pleasure to see someone, nowadays, showing intelligence and excellence in the content and talking with the confidence of someone who knows what they are talking about! Till I watched the documentary "Americana" (about Taylor Swift) I did not listen to Taylor Swift as she was past my time of pop music. Watching Americana I immediately developed a respect for her genuiness in creating, the song only the young speaks to the heart (although I have passed that stage) the expression of "Me" being another amoung others I noticed to speak beyond the video! Thank you for sharing this info it was very informative and intresting.... The abuse law suit being amoung a noteworthy victory (no one should go through that and anyone should not let a masogenist get away with bullying and intimidating)

Correction: they sold the label (Big Machine Records) to Ithaca Holdings for 300 million. Because BMR owned the masters and BMR was sold to Ithaca Holdings, Ithaca Holdings became the owner of ALL of the masters that BMR owned (for all artists signed to their label).

I know it's technically under british law and not american, but you should do a video on the Jonnhy Deep x The SUn libel trial (and maybe on libel & defamation in general). Also, more Law & Order reviews would be amazing! It's one of my favorite shows but god, it is bad at times lol

I watched this once before and avoided looking at the picture, but this time I gave it a peek. Good lord, how I wish I hadn't done that! Her expression is not happy; it's frozen in that "I can't believe this is happening to me, now what do I do" look! What a scumbag! That poor girl! She should have pressed charges against him for sexual assault.

So Big Machine doesn't give Taylor the opportunity to buy her rights to try to force her into a no-win indentured servitude agreement. That's messed up! Did they even giver her the option to come up with 300 million or did they shut her out of the opportunity to strong-arm her into servitude? And then there's Scooter Braun... I'm gonna keep those opinions to myself!

The guy that SA'd her was also sanctioned for destroying evidence because there was a 2 hour phone call with his boss that was saved on 3 separate devices that all just happened to get damaged (example: he spilled his coffee on his laptop). He was, however, able to offer snippets of that conversation that helped his case :)

There's Fogerty v. Fantasy, where Fantasy Records sued John Fogerty, claiming his solo song "The Old Man Down the Road" (published through WB I think?) is the same song as Creedence Clearwater Revival's "Run Through the Jungle," both of which he wrote. I am pretty sure the lawsuit has to do with payment of lawyer's fees and I know the suit involves John Fogerty played both songs for the court, which is hilarious, but still.

@@LeejaMiller The Supreme Court ruled in favor of Fogerty 9-0, so I mean, it’s worth researching. I know you’re doing the Ke$ha/Dr. Luke video but there’s also the Marvin Gaye/Robin Thicke one (I think you’ve talked about that) and Vanilla Ice/Queen and David Bowie (please dear god play Vanilla Ice’s MTV response because it’s so funny).
