I'm very upset the charges against Alec Baldwin were dropped! I'll walk through the main reasons why I think this is an outrage, and what we can do about it.

Still good to shed light on the hypocrisies. I would like to see new accidental shooting cases use the Baldwin case as a Defense and a precedence. See how the court reacts to that.

The same day Alec Baldwin walked free after killing someone, Matt Hoover was put in jail for advertising business cards with pictures of lightning links on them. This system is broken

@@bigtimepimpin666 A lightning link a a device that can be added to an AR platform to make it fire in full-auto (full auto only). Normally, a select-fire (semi-auto and full-auto or burst) requires machining of the lower receiver and specialized parts. Mr. Hoover is accused of conspiracy to sell machine guns because he _advertised_ an artwork that depicted the shape of a lightning link on a metallic card. Anyone with enough skill to turn the artwork into a working lighting link and heat treat (harden) it, could do so with any metal and probably could manufacturer the parts needed to make a proper select-fire action. Not only does this case raise 1st Amendment issues, it violates the APA and exceeds the statutory authority granted to the ATF by Congress. It is an egregious abuse of power.

I was taught as a kid to never point a gun at someone unless you are going to shoot them You are supposed to treat all gus as if they are loaded, even if they are props. or toys or BB guns.

No doubt! I have an adult son that I took to play Airsoft one summer. The blasters look real, and operate as though the real thing. I impressed upon him to treat them as if they were real at all times, no exceptions. I gave him the three basic rules: ALWAYS treat it as if it was loaded, even if it has no mag and is “cleared.” Never point it at anything you don’t intend to do away with. And of all things, NEVER put your finger on the trigger unless you intend to fire!

You forgot the 1st rule: always know the condition/state of your firearm. That's usually the first one listed, then immediately after is the one about assuming it is loaded even though you know the condition

I was always taught that as the person holding the gun, I have the ultimate responsibility to insure my weapon is safe while interacting with another person. I agree, he should be held accountable for the death.

Agreed. Whenever someone shows me their gun, the first step is to clear it. Did Alec even ask if it was "cold"?

Yes. 1) Treat all guns as loaded. 2) Never point a gun at something unless you intend to shoot it. 3) Never put your finger on the trigger unless you intend to shoot it. Baldwin violated all three of these basic principles of gun safety. This was a slam dunk case against him, if it were anyone else they would have already been serving at least a year into their sentence.

The DA would bury anyone for a similar event involving a firearm death, regardless of what lead up to it. They wouldn’t think twice about it, either. Especially if someone who wasn’t a firearm expert and was playing with a gun. Alec was playing with a loaded firearm and someone died from it. Rules for thee, I suppose.

How many people out there would have an armorer and a film set and fire a fatal shot? Even before the previous set of reforms it was an extraordinarily rare occurrence. Under normal circumstances the DA would bury them because under normal circumstances, you wouldn't have an armorer and a bunch of people whose job it is to mitigate the risk of handling a firearm in a way that's not normally appropriate.

The person who has the gun in had is 1000% responsible for its discharge. Four rules of the firearm: 1. Treat every gun as if it is loaded. 2. Always keep the mussel pointed in a safe direction. 3. Keep the booger picker off the trigger until you are ready to shoot. 4. Know your target and what is behind the target. Baldwin violated all four of those rules and committed murder.

I have been on site in two different construction projects where a fatality occurred, and a third one where I had known as friends all who where involved. The owner of the construction contracting company after 2 years of arbitration in court went to federal prison for six months as an OSHA minimum requirement even though he was not present or in charge of operations at the time of incident. My question regarding the Baldwin case is : since he was/is the executive producer of movie/project why is he not liable under department of labor laws/standards? It doesn't matter that he was holding the firearm or the arms expert negligence, he hired her. All on set are below him, Alec had responsibility on site he should be held responsible in court.

EPs aren’t the decision makers. They provide funding mainly, but don’t get to call the shots. The producer is the decision maker and would be the one liable in that case.

I had a friend that was occasionally employed as a firearms safety advisor on several film/TV sets. He was former SF, former big city cop/trainer and licensed PI. He related that he was appalled at the general sloppiness on most sets and called a stop to production more than once. After several incidents, he stopped taking that work due to lack of safety protocols enforced. He did not want to be related in any way to a situation like the Baldwin debacle.

Every time someone hands me a firearm, I check to see if it's loaded even if they've checked it before handing to me. I've never had anybody get offended. After that double check, I still treat it as if it's loaded.

Justice is about WHO you know, How much power you have, How rich you are and IF you can be of service to the Dark Side..... regular folks don't stand a chance. In the interview that Alex did and said he didn't pull the trigger was a lie for sure even the FBI released that was the only way that the gun would/could be fired. I am 59 years old and have shot guns a LOT for most of my life. The rule that I was taught while quite young is that when someone hands you a gun it is YOUR RESPONSIBILITY to verify that it is not hot. It does not matter how qualified the person was that handed you the gun. When I am in a gun store looking at a NEW and unfired rifle or pistol, when the man behind the counter hands me the gun the first thing I do is check to see if the chamber is empty and that is on a NEW firearm. Alec Baldwin had a responsibility to check that firearm.

I don't have much experience shooting guns but my favorite Uncle owned guns. By the time I was 7, I had learned that every gun is loaded and that you never point a gun at someone. Later that was amended to only if you are potentially justified in using it.

@@HitechProductions Sounds like he needs to check his ego. If I'm dealing with a gun for any reason, I check behind myself multiple times. If I put it down to do something else for even just a second or two, I check it immediately after picking it back up. It probably looks silly to someone who isn't a gun owner and very safety oriented, but hey, they'll get over it.

I am dealing with land legal issues against a former state representative, and I can for sure tell you that there are two sets of rules. I have an air tight case (signed contract), but political clout make the wheels hard to turn. Political clout is hard to beat.

You are correct about 2 justice system. And the fact that you could not get away with what Alec Baldwin did. It's a sad testimony about the state of our union. But I had no doubt all along that Alec would get away with it. It is predictable in our country today.

I don't understand why the charges were dropped. Alec admitted to the police that he didn't check the gun because he didn't want to offend the armorer. That is an admission to negligence...and had it been anyone else besides a member of the ruling class...they would have been prosecuted.

From the first moment I heard about this incident, I asked this question: WHY WAS LIVE AMMO ON-SITE OF A MOVIE SET? That question has NEVER been asked by ANYONE; including Andrew Flusche. By default, never having been asked, it has never been answered.

The scene had not started so Baldwin should have treated the gun as loaded, regardless of what someone told him. When handed the gun he should have checked himself but obviously did not.

There was an officer in my town convicted of murder last year and he was then sent to his home to await sentencing all while still on paid administrative leave with the department. You can bet if he was not an officer he would have been awaiting sentencing in a jail cell.

I can honestly say that I have watched literally dozens of Mr Flusche's videos, and that I learned important things from every one. But even by his ordinarily high standards, this one is stellar. Thank you, Mr Flusche, for saying what none of the talking heads have been saying, and desperately needs to be said.

You really should have bought that cop car. It would have been worth it in the long run. I used to have a H-D police bike for quite a few years. It had everything except the lights and radio as from the factory. I loved that bike.

Andrew, you are absolutely correct!!! There are several aspects to this case which point to Baldwin's negligence as (1) the operator of the pistol and (2) the producer of the production and his responsibility as "the captain of the ship". I am infuriated as well, but I believe that new charges will be filed. There is not enough time or space here to lay out all of the details, but there is no question that HE was negligent. I hope they bring charges back on him soon. But couple BIG questions are: Why did he pull that trigger? Why did he point that gun at people? Bigger question is, Why was there LIVE ammo on the set of a movie?

There's ONE person who is in charge of screening the ammo to make sure they're ALL blanks, and it's NOT the Star, Producer, or director's job, that being said EVERYBODY is responsible for ensuring their conduct is SAFE. ONE person is in charge of ALL weapons handling and ammo, they're called "Armorers". THEY are the ones to ensure weapons on a set are safe to handle. That being said, as a Soldier, it is the responsibility of the person holding the weapon to double-check the weapon's safe status before using it in whatever scene is being enacted. I've never been on a movie set, but as a Soldier I worked on the firing range for 3 years, with no accidents worse than a pinched finger.

​@@djs12007agreed, as a former security officer that was licensed to carry I can attest that regardless of the safety protocols in place, every person who holds a firearm is responsible for it period. No one should be carrying a firearm they have not inspected first.

Well, they were using the guns for filming as well as plinking (shooting stuff) in between filming scenes. There are still too many unanswered questions about this entire incident/movie set that I don’t believe will ever be answered.

I like the framing of thinking of guns as in the same category as any other tool or machinery. There are operators, certified mechanics, and manufacturers and we can and should ask accountability questions of any / all of them.

In some states if a gun goes off in your hand, no one gets hurt, and cops find out about it it's mandatory jail time. It went off in his hand and killed some one and he gets to walk. That's not justice.

The thing that surprises me is the husband. He didn't go after Alec in court. He settled with him as long as he got his damn name on the movie Alec was making. This entire situation has disgusting.

You left out David Halls, the role he may have played and that he got a sweetheart plea deal from the prosecutors. Halls has essentially pleaded guilty to "unsafe handling of a firearm" via a no contest and he is the one who handed Baldwin the gun. It's not so much having a real gun on set but having real ammo and a real gun on set that deserves investigation.

I was confused on why Alec talked to the police at length without a lawyer. You'd think a guy of his status would have a team of lawyers telling him to shut up. I just couldn't believe it when he talked without council. At the time I thought maybe he had been given immunity

Pretty simple: If you have a weapon in your hand, you are responsible for what it does. If I were an actor, I would clear that thing the minute it hit my palm. If you don't know how to safely handle a weapon, you should not put one in your hand, period. What Baldwin did is commonly known as a negligent discharge and will get you in all kinds of trouble if you're a cop, soldier or mercenary.

I agree with you 100% ... Any real gun is a loaded gun ... And I was taught never point a gun at someone unless you intend to shoot them... The other thing that's super important about guns is never take someone else's word that it's unloaded ... check it yourself when they hand it to you ... And of course there are two sets of laws for two sets of people we all know that...

@@jonsworld5307 I believe that some crew members had used movie set guns for off-hours target shooting. This had to be a serious breach of safety protocols, and the armorer should have taken that to the top for handling. She should never have let any weapon under her charge to leave her custody except to outfit actors on a set for a scene, and she should have retrieved them and secured them immediately after the scene was filmed.

@@paulcrumley9756 : Actually, the prop pistols should have been retrieved, inspected, any live rounds removed from them, and then secured. With that said, even that may not have prevented the death and the injury. After all, we have no clue who was using, or in possession of live ammunition on the set!

I served almost three decades in the Army and am a retired Paratrooper and combat veteran. Thanks, in part, to the behind the curtain things I saw about our government, when I retired I immediately moved to Panamá 🇵🇦. Friends didn’t understand then why I would do that but thanks to this two tiered system (and cops are in the protected category thanks to qualified immunity) (don’t even get me started on civil asset forfeiture) are starting to get it now. I cannot think of anything that would make me want to ever move back.

I personally think that Alec Baldwin should have faced the music (the charges, instead of having the charges dropped), and should have faced jail time, and the armorer also should have faced charges for failing to make sure that the weapon was "cold" or a dud weapon, and you're right about there being laws for us and them (Hollywood and politicians as well). Under California law, involuntary manslaughter requires that you commit the act with criminal intent. The prosecutors probably thought they couldn't prove criminal intent. But that doesn't mean he's totally off the hook for other charges later. They also said they have to do additional forensic testing and could refile charges. I don't think this is about "who you know in Hollywood" but more about what kind of lawyers you can afford, and apparently, Baldwin can afford really good ones.

The shooting happened in NM, not CA. NM manslaughter is what you need to look at, they’re the ones that brought charges and dropped them.

The problem is that they couldn't meet the legal standard in place in New Mexico at the time of the accident. There also was little to no effort made to figure out how the live rounds wound up in the gun and there's experts on both sides of the issues as to whether or not he was irresponsible himself. Without more information, I don't see how this is really any different from the actor that shot and killed Brandon Lee during the shooting of The Crow. Holding somebody accountable is good, holding the actor accountable when it likely wasn't his fault is a big problem that won't solve anything in the future.

@@SmallSpoonBrigade I agree, this is eerily similar to Brandon Lee. Although that shooting was a confluence of tragic events, that gun had a blank round loaded, but the bullet from a dummy round had lodged in the barrel, basically making it a live round. Even if the actor who pulled the trigger had checked to see that blanks were loaded, there was a good chance he would have missed the projectile in the barrel. He was not charged in Brandon Lee's death, however the movie studio payed a lot of money to Brandon's family.

@@SmallSpoonBrigade As far as the live rounds go, my theory (which is not provable unless someone comes forward) is that cast, or set crew were playing around after hours and shooting live rounds with the replica firearms. Someone probably left one in the cylinder by mistake. Unloading those guns is tedious, one chamber at time. The cylinders don't swing out like modern revolvers.

It’s not just that it’s the sentencing too. Just in my local community. I’ve seen people arrested on alcohol and drug charges either getting rehab or jail time depending on their money and influence. I’m sure a good lawyer helped as well as opposed to a public defender.

I teach hunter education classes, and I can attest that every 12-year-old in my classes is more responsible with firearms than Mr. "I-bear-no-responsibility" Baldwin. Here's the thing -- firearm safety requires something the Hollywood elites don't have - a culture of accountability. It would literally take about three seconds to prevent this tragedy. Pull the hammer back one click, open the gate, rotate the cylinder. Nothing harder than that. But even those simple steps aren't worthy of Baldwin's time and effort. He's above that kind of triviality. And then there's his claim that he didn't pull the trigger - the gun just "went off". Show me any normal person in court that could successfully offer that as a defense.

This was bound to happen someday. I used to love Vic Morrow on Combat when I was younger. When he and those poor kids died on that movie set and not one got convicted of anything, that told me all I needed to know.

Agree with you completely... you just forgot to mention the bias of some judges.... but wait you might not be allowed to do that in some states, or the state bar will sanction you for casting a negative view of the legal system to the public

I have zero faith in our politicians, judges, police, and prosecutors. I would have more faith in Common Law run by the People where a jury of 12 peers judge both fact and law and the corporate judge acts only as magistrate. Kind of like the Constitution intended but was wiped out by the rules enabling act of 1933 in which we were taken out of just common law and placed into unjust man's law or civil law. The current system is unredeemable, perhaps some of those in the current "injustice sytsem" can be re-trained towards justice and restitution instead of incarceration and monetization without restitution to victims.

You gave me something to think about that I hadn't considered. I wanted to say it was just a tragic accident. But yeah, you're right. If he knew they were filming with real guns, it would have been his responsibility to to make sure it was safe, personally. I am a hand gun user, and I always personally inspect what is in any gun handed to me. I have been trained to do this even when I watched the person unload it before handing it to me.

And you're right to do so. If there are illusionists capable of pulling "magic" tricks on us with mere sleight of hand, it's not far-fetched to consider the possibility that the person only pretended to unload it. There's also the possibility of them unintentionally doing it improperly and you not noticing.

This is what happens when a few autographs, and other trinkets are given to the lower pay grades of law enforcement, BUT with the supervisory personnel in the various law enforcement agencies that were involved, as well as those in the District Attorney's office being promised a role in baldwin's next movie, or having the 'honor" of being invited to some of Hollywood's parties or other entertainment events.

If it's handed to you, you ALWAYS treat it as a live, loaded weapon, and you IMMEDIATELY clear it yourself before you do ANYTHING else with it. The armoror is absolutely at fault here. She was negligent in her duties to teach & ensure all on set were following proper safety protocol, which is the entire point of her presence on that set. However, Baldwin ultimately is the one who failed to follow basic firearms safety protocol, and ultimately, he's the one who chose to point that weapon, and he's the one who chose to pull the trigger.

His experience with firearms has zero bearing on the issues. If I have zero experience with firearms and someone hands me a gun and says "It's empty", regardless of how much experience THEY do or don't have, I can't just point that gun at someone and pull the trigger.

Great video as usual. I wonder what motivated them to drop the charges. I think it as you said, he was handed a gun and he believed it was safe. He was wrong. Who should ultimately decide guilt? We will never know because he is not being prosecuted. I totally do not think he killed her on purpose. I totally think he is a whiny virtue-signaling crybaby. But I also do not believe he should go to prison for that. Double standard? I do not know. The Hunt for Red October was his best role. Please keep up the great work.

Guilty of manslaughter ! I would not be surprised if he paid a sizable amount to her estate and charges dropped. However , I also think he lacks compassion. He was negligent at the least.

I absolutely agree with you. I actually felt bad for AB when this thing first happened, because he obviously didn’t set out to kill anyone that day and it was almost certainly a tragic accident, but then he and his people try to deflect responsibility, beat the rap, and go back to filming the movie that *killed somebody.” I knew he would get off, I just wish he would accept some responsibility, and I wish the criminal justice system would hold him accountable.
