I could be wrong, but I’m curious about how persuasive expert evidence would be here. If a musicologist took the snippets “I can buy myself flowers” and “I should have bought you flowers” I feel like the most objective similarities would be lyrical and thematic (buying flowers and strife between lovers). However, melodically (pitch AND rhythm) the two phrases are distinct enough that a child would be able to tell the difference. I’m also not sure if there were other examples of how the songs were similar, but something about this being the main example fills me with doubt.

those are not just similar, Mileys song is a counter part to Bruno's song, sort of a response where she tell women they should not expect men to treat them right, but they should and are able to treat themselves better than any man ever could. She stated it was totally inspired in Bruno's when asked about the similarities. Edit: and yeah, as it was stated in this video she made the song "dedicated" to Hemsworth because he dedicated Bruno's song to her when they were a couple.

I thought this song was a response to Mars' "When I Was Your Man" song and that Bruno not only knew about it, but was contacted to sing on Miley's version. And that he declined, saying it was such a great song he didn't want to overshadow it as it's own piece of music/art. Maybe that's all lore created to sell the song, but I remember reading that somewhere. So... if that's true, and it was meant to be likened to the original song; that is actually the intent of the song. What a buzz kill, if they win this lawsuit. IMHO this is money grubbing leaches killing creative collaboration, but I par for the course these days. These people will stop at nothing to make a profit, even if it's killing off the very thing that makes them money: creation.

Men at Work's lawyers should have used this "Fatal Flaw" argument when they were sued in a similar manner for their song "Down Under" which really damaged the bands bank accounts and put them "Down Under". If my memory serves me well, they were sued by an investment banking company too not the original author. Who died years before the suit was filled. Those money grabbing bastards. It will be interesting to see how this plays out. Maybe you should do a video on that case too as a follow up to how these companies might be successfully taking advantage of this tactic? Or to put it another way, every single love song and every single breakup song, or every single song about light and day, and every single song about night and darkness would essentially be copyright infringements..

I could be wrong but I think I read that Miley loved “when I was your man” and played it at her wedding - she even told Bruno how it was the couple’s favorite song. When she found out she was allegedly cheated on throughout her marriage she wrote “Flowers” (after getting permission from Bruno) as a “revenge” song. It deliberately takes the sentiments from “when I was your man” and says “I don’t need you for this, you sucked at it anyway. I can do all these romantic things for myself”.

Part owners of assets file lawsuits all the time without being in agreement with other owners (stocks, bonds, real estate, etc.) It’s most likely that Mr. Lawrence conveyed all his rights to the new owner, so essentially the investment company is the equivalent of Mr. Lawrence. If a copyright is infringed upon for paintings, photos, movies, etc. the current owners can sue -they don’t need the permission of the original creator(s). If this particular song is structured as a LLC then the operating agreement may specify the members’ rights to bring litigation.

Barbra Streisand sang You Don't Bring Me Flowers Anymore in 1978, and bruno's song arguably has a lot of inspiration from that one. Response songs are not uncommon.

The punchline here is a lawyer boasting about being a music industry related lawyer trying cases involving music, calling these two songs very "similar" at least twice here, meanwhile the fact is they're not even close to "similar" in any aspect of music, there is nothing to compare. The lawsuit brought by greedy boys...allege "the Cyrus song would not exist without the Mars song". And...? Thats the same as saying nearly all of Swifts songs wouldnt exist without her dozens of breakups with boys. Can the boys sue? Laughable. Do you have any idea how many major songs throughout history were inspired by another song or its lyrics? Bruno wants no part of this, he knows better, which tells the whole story in itself. The fact is as a complimentary response to Mars' song about Mileys breakup, is picture perfect.

This is a really good interesting case. There are two issues here, lack of standing and the fundamental kernel of facts. You know the root cause that brought everyone together to argue about the copyright infringement. So let's just say this case is dismissed, who pays all the attorney's fees ? ( because plaintiffs sued everybody and their sister ) What is Bruno Mars take on the situation?

Those songs are not alike except for the word "flowers". I have a couple songs about buying flowers. Not even the phrasing match "i should have bought you flowers" and " I can buy myself flowers" are different. Brunos uses it once at the end of a chorus and mileys reoccurs at the beginning of the chorus. They are in different keys. Buying flowers is a common thing and probably been used in a million songs because musicians like to be romantic. Damn near all musicians have written songs about buying flowers. You cant copywrite a common phrase. Im sure more than one artist has written "I Love You". Should I sue them

Bruno Mars is probably flattered his song was relevant enough to have been "responded" to. There's not even ANY musical or even lyrical overlap in those 2 songs. These music lawsuits need to be made illega/impossible unless you have actual grounds and actually own the "original".
