I just don’t get why American law school is set up the way it is. Aussie law school will at least teach you enough to get you started. That includes how to research, how to write, how to form arguments, how to cite cases properly, etc. Also, we have assignments as well as exams, and our lectures are recorded so we can watch or rewatch at our convenience. No need to rely on a fellow student and hope they take decent notes. It’s just a much better system.

I covered a first-degree murder trial once where it was clear the defendant committed the crime. The defense knew they had no defense so the best they could do was argue that it was second-degree murder and not first-degree. In opening arguments, the defense attorney literally said something to the effect of, "Find my client guilty, but don't find him guilty of first-degree murder." I actually had to listen to my audio recording multiple times to make sure I heard that correctly.

From someone who lives in an advanced nation (Australia), it's very hard for me to imagine how awful it must be to live in a place where you have to pay for your tertiary education. It seems like a lot of lives would be wasted that way. People who are more than capable of becoming an engineer/ lawyer/ doctor/ whatever, but simply can't afford to pay for university. That's the kind of thing you'd expect in a third world nation and I really don't understand why it still happens in the usa...
@wraitholme3 жыл бұрын
Unfortunately, most of the time when you get state-funded education, the quality drops. The best teachers and the best facilities are _expensive_, and that's how you get places like MIT and Harvard.
@Raz.C3 жыл бұрын
@@wraitholme While that might be true in the usa, the exact opposite is true here (and the rest of the developed world, I expect). You see, the pay-for-it universities here like, for example Duke uni, are not taken seriously as educational institutions because they'll let ANYONE enrol, as long as they can afford to pay for it. The prestigious universities like (my uni) University of Queensland, or University of Sydney, etc, are much harder to get into, only admitting a certain number of students per year and only those who have the grades for it. The tuition is paid for by the government (though you can pay it yourself if you like and with a 25% discount if you pay outright), though in either case, the university still gets paid and so does everyone who works there. There's no drop in quality and everyone has the chance to become whatever they want to be- as long as they're intellectually capable.
@wraitholme3 жыл бұрын
@@Raz.C Sure, there's always going to be universities at the top of whatever the local pile is, and I'm sure a system based around exclusivity and scholarships will keep quality up... But with all due respect to the Universities of Queensland or Sydney, they aren't exactly Harvard, Oxford or MIT :P And for what it's worth I'm not American, so I'm not defending them out of the usual US conditioned patriotism. I'm just saying what I've seen, and if you have state-funded education then you better hope it's one of the state's highest priorities, because now you're competing for budget with things like defense, or ministerial luxury cars and housing. Not a lot of people who make it into higher-level politics have the kind of mind that cares about someone _else's_ benefit.
@Raz.C3 жыл бұрын
@@wraitholme The universities I mentioned are consistently in the top 5 universities in Australia. So 'Yes,' they are the Australian equivalent of Harvard or Oxford. Though the latter two are more well known because there are more american and British movies and shows that mention/ explore them. If you look at how much a nation's universities contribute to world knowledge, you'll find that american universities have fallen behind most developed nations.
@eji743 жыл бұрын
@@Raz.C American universities do have minimum standards for enrollment, they do not just "let anyone enroll if they can afford it." The problem is the public school system is pretty much garbage, especially in the big cities, and when these students get to college, many can't hack it. This, IMO, is a major contributor to American universities not named MIT, Harvard, Carnegie Mellon or Johns Hopkins - private institutions with high enrollment standards - are falling behind. And we have people who actually want to lower the standards even more, when we should be doing the exact opposite. I'm completely fine with raising enrollment standards for universities, while steering those who may not achieve those standards but still want a higher education or learn a skill to community colleges or trade schools.
