Week 2 got underway in the Elizabeth Holmes trial, in this episode Pete Sartes gives an update and some predictions on what comes next. The trial started with two witnesses Denise Yam and Erika Cheung. What clues are we seeing from the prosecution and defense on their strategy here?
Will the defense lean into the claims of abuse by Sun Balwani and go the #meToo route? Will the prosecution be able to avoid getting lost in big numbers and confusing scientific dialogs?
Over $2 million in legal fees were racked up in one week in the defense of Elizabeth Holmes related to this Theranos case, was it money well spent? Pete digs into that and all of the details on this case.

In the amazon documentary she looks so sure and professional, she enjoyed having the doors opened for her without her having to wait for it, we are to believe she is a victim now? Pleassseeee.

In some countries we have abuse through coercive control. It's mental abuse not physical. Is there such a law in the US?

As much as I despise both EH & SB, abuse doesn’t have to have to be physical. That said, I don’t believe she was coerced, she was lying before he joined.

This is the part of the legalities (the entire legal system/proceedings), that drive me nuts at times. FIRST, literally the entire world now knows about Elizabeth Holmes and Theranos story just by the available numerous videos and published information from numerous journalists, etc. The one point is, it is abundantly clear that there is wrongdoing and there is only one person who is responsible for it all and Holmes has been documented publicly lying. (Yes, the boyfriend had some involvement and will be dealt with separately). QUESTION 1) So what’s to “argue”? She is “guilty”. Is this a matter of coming to some agreement as to “what” she is guilty of, and clearly defining the list of “falsehoods” in order to determine the degree of the penalty? SECOND, also well documented, is Holmes parents. Research is quite easy and finds both of the parents are “well connected” with government(s) as well as having a high level past. With this information in hand, it goes without saying that the parents could very easily be using their personal connections for the one purpose to influence anyone and everyone, at the highest levels, to affect, in one way, shape, or form, the outcome of this trial and anything related …in favour of Elizabeth Holmes. Now this part, is the part that truly concerns me. QUESTION 2) Can the parents be investigated, behind the scenes, for ALL their activities since the day this saga broke …or even earlier? The reason for the question is, if the parents were influencing people BEFOREHAND (no different than the board of directors being Kissinger and Shultz, etc., …who introduced these people to Elizabeh/Theranos?) or AFTERWARDS …this point being the parents campaigning/hobnobbing behind the scenes, to come up with some way of protecting Elizabeth from any kind of prosecution, …the boss’s, boss’s, boss, scenario. Have the parents been manipulating people for the past several years …and if so, is this legal? To further support this questioning, why is there no media currently providing any articles on this trial? This is the stuff society is usually looking for. It “sells”. Is there some kind of “directive” coming for the very top, squelching the current court coverage of Elizabeth Holmes? Back to the “board”, one could easily ask, “what did this board actually DO?” …considering the fact there was no functioning product “as advertised”. Were they promoting …OR USED TO PROMOTE THIS FICTITIOUS PRODUCT? QUESTION 3) If the board was used in some way, shape, or form, to promote this product …ARE THEY ALL NOT LIABLE TO PROSECUTION AS WELL …..otherwise, WHY WAS THERE A “BOARD”?? I think when everyone thinks about this saga in their own ways, it is not difficult to come to conclusions that wreak of corruption in many places.

It appears this attorney wasn't attending the trial in San Jose so he is working off hearsay and pitching his info on a lot of conjecture and speculation. Not sure where he got some of the witness testimony.All the info he is throwing out is already in several documentaries and the book Bad Blood. This really isn't an update to the second week of the trial. He is talking about things that aren't even relative to the charges. Holmes, faces a total of 12 charges-two counts of conspiracy to commit wire fraud and 10 counts of wire fraud-for allegedly engaging in a multi-million dollar fraud scheme alongside Theranos' former COO Ramesh “Sunny” Balwani, with whom she was romantically involved. So in reality what this attorney is talking about regarding speculative witness testimony means nothing..for instance money she spent on jewelry, jets has nothing to do with the wire fraud charges or conspiracy to commit wire fraud charges. I'm sure her attorneys would have objected as irrelevant and had it stricken from the record. Especially if the witnesses didn't know why or what the money was spent on and for what reason...and again nothing relevant to wire fraud charges she is on trial for. There is a lot to come but people interested should read the book or watch one of the many documentaries out (some on KZbin) The truth is the elements are there for wire fraud. However, proving when money was transferred by the investors that she was intentionally defrauding them is another story. Its a very difficult thing to prove! Their argument can be she thought she had a working model when she took the money for the company. Or when she took the money she had all indications that any bugs could be fixed and the product and service could be delivered. Not really any different than Elon Musk taking money from customers for Tesla model 3 when they were just on the drawing board. If he had taken that money with the intent of never building them, that would be fraud. But if he believed with reasonable certainty the cars could be built and delivered and made the effort to produce them...that's not fraud. Keep in mind that strangely to date not one investor has sued her in a civil action. The only legal issue so far was with Walgreens and basically that was settled out of court, saying that Theranos didn't fulfill the terms of the contract.

Ian fell for Holmes’ charisma, but if anyone was battered it was him and the other employees of theranos . She courted them in the beginning then pressured and berated them when they questioned her, gaslighted them. Techniques Straight out of the abusers playbook.

This case is getting minimal coverage on all the news channels, I am absolutely gobsmacked that Court Tv and other Court channels have barely covered it, and when they do the coverage it is not at all extensive. FRUSTRATING!

Cameras are not being allowed in the courtroom. That obviously makes it very difficult to cover on TV. It's a shame that decision was made. I was looking forward to the circus.

The media and mainstream population does not want see the golden girl be tried and possibly found guilty. Remember, she made good press and their coverage pushed her agenda to defraud. In other words they propagated fake news and helped her defraud. The mainstream population includes the super wealthy that invested in her business. Yes, they are victims now but while she was on every form of media more were encouraged to invest. That means the original investor’s money increased in value. Who wants to see/hear their names linked with fraudster and the world know they are not so smart. Hey, a working gal or guy trying to better prepare for retirement may think twice before diversifying their portfolio to include their companies. I’m just saying.

Elizabeth Holmes parents are well-connected with governments. It is very possible/likely that the parents have been influencing and manipulating everyone they can, behind the scenes to both attempt to reduce any penalties against her, as well as attempt to squelch any/all media coverage. Only an investigation into what her parents have been doing for the past several years would determine this possibility.

One of the hazards of using the Svengali defense: You pretty much have to admit you did what you are accused of. You can’t very well say I didn’t do it, but if you decide I did, that guy made me do it.

She is clearly guilty. Whether she gets convicted is another matter entirely. She was lying even before Sunny turned up.

She probably won’t get convicted . There’s no justice in the American criminal system. I’ve given hope. She’s white and rich. Watch her get away with it somehow and the fact that she’s now a mother.

@@framboise8845Hold up. I did not say anything about her being abused or that abused women shouldn't be parents. You made that assumption on your own. It's just a question because her defense may be mental defect. The court may see the fact she's a parent as well as something else to look into. I'd ask the same about a man using a defense citing mental defect who was a parent as well. Men can be victims of abuse, as we both know. Try to keep an open mind here. Again, it's just a curious question. (He did say to ask questions in the comments 🤷‍♀️). However, I admit that I think she knew exactly what she was doing when she lied to the public and investors ,whether she was being abused or not. Her relationship didn't last the entire reign of Theranos did it? So there was a period of time when she can't claim she was doing this because of abuse. It's also ironic that her employees claim she created a toxic and abusive work environment herself. I find that interesting. Thanks for sharing your thoughts. Take care.

She apparently got married (secret wedding) to some rich kid (from the family fortune) ....and just had a baby a couple of months ago. Elizabeth is very clearly a lying manipulator ....and appears to be very desperate to stay out of jail. I hope the judge takes this baby aspect into consideration, and for the correct reasons, adds time behind bars. She very clearly knows she is in trouble and it is very unlikely she is ignoring that fact when getting pregnant in the first place. Getting pregnant under these circumstances very powerfully suggests she is simply EXPLOITING becoming a mother in order to stay out of jail.

Didn’t E Holmes start the whole Theranose thing? At what point did She bring Balwani in the picture? She is the mastermind, she can’t put blame on anyone else.. She invented her baritone voice long before that, tactics to deceive are her choice.

Good point, Holmes started Theranos in 2003 with over $90 million in venture capital invested by 2009, that is when Balwani joined.

Not necessarily the smoking gun, but the prosecution’s position is that is a lot of (investor) money to be shelling out for a start up.

Keep it coming! I’ve been looking for updates, but haven’t seen any other channels posting. I agree about the defense team for Sunny. You can’t get a feel for the courtroom atmosphere without being there in person.

The trial is in federal court. Judge says no TV cameras. Therefore not too much media coverage.

She was clever enough to attract investors who had little to none medical and health industry expertise. They were also mostly older men who seemed slightly infatuated with a young lady. Some people with medical knowledge saw through her lies and were skeptical all along.

There are always plea deal discussions. She's one of those that chose to take her chances with a trial. It's not uncommon if you think you have the fire power and money to win. We shall see how that bet works out.

I don’t know if there are any plea discussions specifically. But I would be shocked if discussions were not had and there is even the possibility that plea agreements were drafted and disseminated. But my gut is the plea agreements came with prison time and huge restitution numbers.

Fraud embezzlement false advertising putting people at risk, that's just off the top of my head any lawyer worth his salt would nail her. Unfortunately I believe her families connection to incredible wealth and power will keep her out of prison and she will run away with a lot of other peoples money

Did they differentiate between the Edison and the Minilab in the testimony? Seems like in my prior reading, the Edison was the earlier machine that she was trying to make that used lots of micro-fluidics, and then when that didn't work they pivoted to the MiniLab. I'm sure the minilab was the machine they used after the Walgreens deal, but they were only doing "less than a dozen" tests purely on the Minilab with the nano-tainers. And then they used nanotainer-sized samples of blood in hacked 3rd party machines for some tests, and full venous draw samples in 3rd party machines for other tests. But I'm not sure if the early machine ever really 'worked' even to the extent that the Minilab 'worked'.

My understanding, based solely on reading about Theranos, is that the first machine attempted, and subsequent discarded, was based on microfluidics. This machine was replaced with fairly primitive technology that used a robotic arm to pipette - which Holmes named the Edison. Over time, there were changes to this, and the fourth and final version was named the Minilab by Holmes.

And that's how they defense will probably win the case. They will confuse people with all the technical details the jurors will not understand. The defense is already going down that path.

Dear Pete, I worked in both hospital and clinical lab settings for 39 years. Every time I think of the patients health and lives that Elizabeth Holmes put at risk, I get sick to my stomach. Many thanks to you for reporting on this critical court case. Please keep up the great work!

As far as I can tell, Holmes never said they don't use third-party devices to test blood. She said they don't use third-part devices to test blood from the nanotainers. If true, that's an important distinction, and as far as I can tell that is the truth. That position is supported by the fact that Theranos was collecting traditional venous vials along with the finger pricks for a lot of tests. That doesn't mean she didn't mislead people - I think she did. But if you care about accurate reporting then you need to double-check the assertion that she said they don't use third-party devices to test any blood samples. From what I've seen, that assertion is not backed by fact.

Holmes’ defense strategy is a grasping-at-straws Hail-Mary toss that is extremely transparent and I think will work against her. 1. The battered woman defense as you mentioned being in alignment with “me too” I think will work against her because it seems like she is just trying to take advantage of the movement. 2. Historical disparities in the justice system regarding race is also a current hot topic and nobody wants to see another white-collar criminal get away with large-scale years-long fraud with a slap on the wrist. 3. Having a baby during all of this seems like yet another manipulative tactic and is quite transparent. If she does go to jail for decades, she won’t be able to have a baby when she gets out, but the timing is questionable at best. 4. Finally doesn’t using a “battered woman,” “mental defect” defense imply she was indeed aware of fraud? How can you say “I didn’t do anything wrong, a failed business isn’t tantamount to fraud” while also saying “but if I did do something wrong, Sunny made me do it?” Sounds like they’re talking out of both sides of their mouths.

Playing on known needle phobia (1 in 4 supposedly don't get Covid-19 vaccinated due to fear of needles) for shame Liz. 50 year drawing blood next year here. Venipuncture is barbaric and we'll all be relieved when we move to mostly saliva testing for medical insider information. Perhaps folks have always been needle phobic but the phobia seems to be getting worse including folks who are sleeved with tattoos. Tatts are fine, but a blood draw for meaningful medical info? I'll take the ink. whew

My question is on the timeline / when did sunny come onboard ? I mean she pitched this product idea to a Stanford professor when she was like 19, and that professor told her ‘no’ that’s not possible at this point in time in medical knowledge. And she still went on with it/ without sunny being in the picture. Also/ wasn’t there a conflict of interest in her shaking up w sunny even though he was himself an investor? There’s just so many levels of shade w elizabeth. And her snake eyes glare that she always has isn’t going to help

The general consensus is that Elizabeth and Sunny met in 2002 while she was 18 (and still in high school) and he was 37 but the word on the street is they didn’t start a romantic relationship until 2 years later. Balwani was a successful business man in his own right having made millions off of companies he had founded and sold during the .com era. Balwani didn’t officially join Theranos until 2009. He went from vice president to COO in lightning speed even though he doesn’t have a background in bio engineering. Part of the issue in the trial is going to be whether the investors of Theranos were told the Holmes and Balwani were involved in an intimate relationship.

Looking at her behaviours, I think she is very vulnerable and susceptible to manuipulation. She doesn't have the capacity for the alleged scale of manipulation. The lawyers don't want to see it as affects theur livelihoods. The chief architects are reviewed later. The question is who supported her position in the company, from startup tp IPO and beyond. This is a complex case, take a lot of time.

Has there been any hint that the blood testing device she was working on was connected to the Global Health system and PEPFAR? Holmes' father at one time worked for the Peace Corps and as such it does not seem out of the realm of possibility that Elizabeth's connections to Shultz, Kissinger, high level military people would stem from those programs - and the potential of government contracts to supply her blood testing devices around the world to third world countries.

Be interesting to see if EH had any technical understanding of how Edison was supposed to work and do so many test on such a small amount of blood - or did she just have some crazy idea this could work & expect other employees to somehow find / develop a solution? Her job seemed to be one of selling the idea with very little technical input a stark contrast to say Elon Musk polar opposites. How much has EH kept of company money to pay expensive lawyers and how did this get into her private account?

Simplest thing would be to take five edison machines (I feel Edison would be rolling over in his grave for having his name attached to this dumpster fire) and get them all to do simultaneous tests on the same blood sample. Hilarity will ensue. I'm guessing these machines all disappeared in a mysterious dumpster fire.

The defendant has a right to a trial by jury. That is a right that can be waived in many instances, at which point the judge becomes the trier of law (judge) and the trier of fact (jury). Normally bench trials are reserved for small matters or for matters where there is little exposure (think cases where you can’t go to jail if you lose). The reason a bench trial is not common in complex matters or in cases where the prison is a possibility is because it is much easier to convince 1 person of guilt; it is much harder to convince 6 (or in some instances 12) people unanimously of guilt. Remember, a guilty verdict must be unanimous. If there is 1 hold out then it becomes a hung jury and a conviction can’t stand.

The professional laboratory testing community (i.e. clinical pathologists), including myself, had substantial doubts fairly early on. The 'red flags' were: (a) How is it possible to run so many tests on such a small sample volume in a single small machine? (b) A fingerpick causes tissue injury and will cause interstitial fluid to mix with the blood, i.e. the sample is not blood per se. However, all relevant clinical laboratory reference values are meant for blood, not interstitial fluid. (c) There was never any known principle of how the instrument would function, i.e. the plausibility of how this would work was lacking. (d) There were never any peer-reviewed publications, nor comparative side-by-side tests with established laboratories, to my knowledge.
