They just want out of their contract without paying the penalty fee. This is just a battle about manipulating the puplic perception trying to force HYBE/Ador to let them out without that penalty. If they really believe that HYBE/Ador violated their end of the contract and they have a valid legal claim to terminate the contract, they would let their lawyers handle it (going to court if needed). Instead they're going public with an "emergency press conference" announcing the exit while still being legally under the contract. Doesn't matter if you believe they're morally in the right wanting to leave. Of course we also don't know what's really going on behind closed doors. But this press conference is just a bad idea (from a legal viewpoint) and manipulative at best. But so was their KZbin video with their "demands". Can't imagine a lawyer worth their money would ever agree to any of this. What a mess.

The video stated that NJ can provided documents regarding HYBE statement about "dismissing them" (or whatever people want to call them). But I think they missed a certain fact. LEGALLY speaking HYBE and ADOR are two different entities. NJ girls exclusive contract is WITH ADOR and NOT Hybe. Therefore, unless the statement about "dismissing them" was made by ADOR, ADOR actually never breach any contract agreement. Also, regarding bullying case which focused on "other group management telling their idols to ignore Hanni" this is also action that was done by completely different entity, and ADOR cannot be held responsible for what outsider did to NJ girls. And ADOR actually had followed the procedure by contacting the other label about the matter, so therefore, Ador did the necessary action to protect NJ girls. Whether the outside entities responded to Ador or not is a whole different matter. And Ador is not a court where it can decide anyone guilty nor force other entity to do their bidding. In any case, NJ girls also need to provide all details of proof of any breach of contract. So, far they haven't publicized those concrete proof aside from saying "trust me bro, they breached a lot of things". Of course, none of us know what happened behind a closed door, so we can only speculate based on what were shown to us so far. And lastly, any confirmation and or validation of breach of contract that lead to termination must be done by the court (aka. judge), otherwise why make contract in the first place if any party involved in the contract can claim contract termination anytime.

I'm not familiar with Korean law, but in the U.S., it is not considered a breach in contract if in written word, only if it was put in action. In this case, the internal documents referenced by NJ would be considered invalid. In fact, it would backfire on them as Hybe would have grounds to counterclaim, which they would use action as proof. The act of keeping NJ as signed artists and keeping them active with fan events would prove that they "protected" them and therefore did NOT breach their contract. NJ would lose and Hybe would likely put them on haitus until 2029. Afterwhich, I forsee a difficult battle forth for these girls who have proven themselves to be difficult to work with. This is an industry that is not forgiving as everyone is waiting to take their place. They essentially dug their own graves.

It's a bad move for their careers bcos cases like this takes a lot of time to be resolved and during that time HYBE can file an injunction and put them on hiatus. They wont be able to work while their case is still pending. Even if they win against HYBE, they still need to pay part of their investment. Maybe temporarily but probably not enough to shake them down especially with how popular their other artists are.This type of drama has happened before take TVXQ for instance and yet SM still stands. Back then TVXQ was at the height of their popularity but their legal battle literally crippled their career. They were blacklisted from multiple media sources and were only recently allowed back on. If that doesn't tell you something I don't know what else will. Even if they win this legal battle there's no telling how this will affect their career. In obligations and contracts, either side may pre-terminate a contract. Such pre-termination may either be valid (for legitimate causes) or invalid. Unless it was a mutual rescission of contract, you need an objective party (the courts) to declare if such termination is lawful or not. Also, a mere unilateral declaration of termination does not automatically cease legal obligations. I think that's the reason why after declaring termination of contract, NJ still went ahead with their original work schedule. If they didn't, Ador could sue them for damages. In practical terms, NJ's declaration of independence seems like an empty (and very rude) flex, and means nothing because they are still working per Ador's timetable and for Ador's benefit. The payments from advertisers, concert goers are still be going to Ador's pockets because Ador was the contractual party in those work contracts. So what's the point?

Because they can't just do as they please. Until their contract is legally dismissed whether they have a reason or not, they are still on contract terms. Using company funds to do their activities. If they actually HAVE a reason or if ador/hybe did breach the contract, they may be able to get out. But it doesn't seem likely just yet, there's gonna be a LONG legal process and an even longer one battling for their name. On top of everything they've done without legal council. Who knows.

There was no document that "laid out plans" to exit New Jeans. There was a document that compiled online comments, with an analysis of what would happen if New Jeans was discontinued - which one would hope a company would do when reviewing their strategic roadmap. There is no contract that can be verbally terminated without any proof of breach of contract, and certainly no termination without some penalty to be paid. Common sense is required here. A corrupt decision like that would harm the entire Korean economy, because it would make every contract meaningless, and would mean a contract could be dropped whenever and without material breach. Let's see what happens here.

I think it was more they were not being supported by the label so were forced to cancel future arrangement with immediate affect. They stated they are protecting their mental health. Most legal experts I've seen have said New Jeans almost definitely CAN'T win, and anyone who knows anything about contract law knows that you can't just schedule a press conference and say "I don't like it here anymore. I quit." when you have a signed contract. Most legal experts I've seen have posited that's why they aren't filing with the court (in addition to trying to get out of paying the penalty fee); they know they can't win, too. They also say that the hastily scheduled conference last week was a mistake. It seems people still think that Hybe and Ador is the same entity. Ador is a subsidiary of Hybe, or in other words Hybe is the parent company of Ador since it owns more that 50% of Ador share. However, in the eye of the court (Korea law included), while controlled by the parent company, a subsidiary is still considered a separate legal entity with its own finances and management structure, meaning they have distinct legal identities and liabilities. And therefore, the parent company not liable for the subsidiary actions and vice versa. All I see is that Hybe's problems began when Mhj began her maneuvers to leave the company with a brand new, fully funded label, and an already successful group. Small problem, Hybe picked up on her idea and conducted an audit, which confirmed his fears with what they found. As a result, she is fired because she threatens the company which is still vulnerable because of its rapid growth. There Mhj increases her mediaplay, to which Hybe tries to respond with the same intensity, but as people see Hybe only as a company, almost all the credibility goes to Mhj. Finally, NJ shows up in the drama when no one asked them to and starts blackmailing the company to get Mhj to return to her position. Hybe and Ador take steps to make changes, and limit the damage to the idol's activities, such as changing the CEO as well as everyone involved in truly suspicious maneuvers and discussions with Mhj. They even agree to reinstate Mhj but in a less important position, so that she no longer has the ability to do questionable things, like stealing a label for example. Plus, they completely deny all accusations of harassment or neglect despite continued threats from NJ. When we think it's over, there are more: Mhj stays quiet for a while before announcing that she is ruined and therefore sues Be lift about the controversies with I'll It in the hope of fill her pockets, probably to found her own label who knows. Then she resigned and shortly after NJ announced that they re leaving Ador and Hybe for breach of trust and negligence even though the National Assembly’s Environment and Labor Committee disapproved their complaint for lack of evidence of any kind. Probably in hopes of joining a label that Mhj might start in the next few months.... Honestly, it's better for Hybe to sue NJ for breach of contract and get some money back. And close Ador to focus again on their groups which have been under fire one after the other with the media for 1 year (because of whose interventions?). Second, a contract termiation isn't a signature under a contract and boom, it is a process. So until all that has happed they have to keep working or they could be held legally responsible for not fulfilling their remaining contract.

This is a tactic to put ADOR on the defensive. They know ADOR will not let the contract go without a fight, but if they make ADOR the ones to bring it to court, then ADOR must prove they upheld the contract. My opinion is ADOR can win the lawsuit because saying one thing in an internal document that could be taken many different ways depending on POV versus doing that thing are two different actions. They did not stop supporting NJ even if the document says they wanted to. It could only be considered an idea, not an action. I think that will be important.

Hybe has never supported NJ since their debut (i.e. no photos, interactions, or producer credits with BSH. Every group under Hybe shows up on his IG except NJ). After Hybe took over Ador, new album release has been delayed, world tour delayed, conflict with music directors, and NJ content was brought down.) I don’t see why NJ should stay if new Ador/Hybe isn’t promoting them, even more so, burying them. Remember per the courts, an exclusive contract means they are a partner with Ador not an employee. That’s why the bullying situation was dismissed. Of all the analogies I’ve seen, this relationship is more like a sports athlete and a sports agency. NJ and the athlete are the talent, Ador and the sports agency are the promotional/marketing. They should find the best deals, best sales, advertisements, exposure, etc to make their talent more popular and more money. Because more money the talent makes, the more money the agency makes. Ador was most profitable subsidiary for Hybe last year. Yes, NJ were trainees under SM/Hybe but that was under a different contract since their exclusive contract was signed in 2022 at their debut. If you think NJ should be loyal to Hybe for investing and training them, then you might be right and perhaps there was some appreciation at first. But but since Hybe cut them off since debut, I see why their loyalty resides with Ador that helped generate their success. Will this move work for NJ. I really don’t know. I wish for the best, but expect the worst. It is bold and unprecedented since historically the agency buries the talent. Now the talent is calling out the agency for not doing its job.

If Hybe plays dirty like SM did, then these girls are in for a legal fight that will drag on for a long time , during which they will not be able to work. Then when it's over they will most likely be blackballed by Hybe. Though the difference between this case and the SM cases is that I'm sure NJ is being guided by MHJ behind the scenes. And I'm pretty sure she wouldn't have encouraged them to leave Hybe if she didn't have something and a big heavyweight backing her up. So, we shall see what happens. Honestly, the Sth Korean legal system and Government, should look at acting in the full letter of the law, to do otherwise would set a precedent that would have long reaching implications not only on the Kpop industry but contract law, overall. The country could be thrown into economic crisis if everyone who is unhappy with a contract simply did whatever New Jeans are doing. I suspect that most major Corporations & Businesses will be looking at what these Mean Girls are doing with trepidation.
