What happened to the family is wrong, Alex is wrong, all that. I will say though that the family moving seven times in the years since the event may not be entirely related to Jones. It could be, but it would take more information to be certain because it could also be a host of other factors that would make more sense.

The more important legal question is, why are the survivors of sandy hook not suing KZbin for profiteering off the ramblings of a mad man? They are barred from bringing suit against KZbin by section 230 of the communications decency act. This may very well be the test case to see if the Supreme Court will hear a challenge to the Communications decency act. Alex Jones may be avoiding piling up legal fees because he is banking on the case being moved to a higher court on appeal. The reality is his is the sole legal target for what should be a class action lawsuit against KZbin and any other Social Media platforms that profited from the situation.

However, as part of GD’s TOS, you are not allowed to use their services to host illegal content. If we didn’t have Section 230 then almost every online service provider would be sued out of business and into bankruptcy for hosting something that offended someone on their servers that was uploaded by one of their members. There wouldn’t be much of an internet if that happened. That’s why section 230 is important and why SCOTUS won’t rule to overturn it. They’ll kick it back saying that’s up to Congress and/or the FCC.

Yeah, I suppose the counter argument is that their address..etc. is presumably publicly available somewhere (if Alex Jones was able to find it himself). However, the counter-argument to _that_ is that it ignores the mob psychology of social media - if you bad mouth somebody online, but make no mention of their personal information, the % of people who are likely to seek that person out is far smaller than if you bad mouth somebody and then say 'by the way, they live at x address'.

Something that popped into my mind that's a good question upon you stating, "Call your lawyer" is "How do you find a good, competent lawyer in the area you live and of practice you need?" Would it be possible for you to do a video on good practices in how to find an attorney in the area a person lives? Red flags that maybe you don't want this person to be your attorney and other general advice?

Good suggestion! But it very likely is specific to your needs. I had 2 different lawyers for my child custody case, the first a fairly mediocre one. Not slimy, but a bit of a jerk. The second one was referred to me by another lawyer. He spent a half hour asking me questions before he even took my case (not charging me for that time). When I asked him why he had asked me all of those questions, he told me he wanted to make sure that I was doing this for my sons sake and not out of spite for my Tyrannosaurus EX. Following his advice, the judge eventually awarded me full physical and legal custody of my son even though I was only asking for 50% on each. It allowed me to have a wonderful child grow up to be a wonderful man in my life. I still remember that lawyer with gratitude and respect for his integrity throughout the entire process. He was never afraid to challenge my assumptions or prejudices, and kept the focus where it should be: The health and well being of my son.

Well, you might not want to go with my father's choice for finding a good lawyer. Which was not show up to a child support adjustment hearing (my father had been unemployed for some time, so my mom was trying to get the payments lowered to something he might actually be able to cover) which ends up with a bench warrant being filed for failure to show up, which means he gets arrested and hey, court appointed lawyer shows up, files some paperwork to get him on disability and hashes out a new deal. Bing bang boom, my mom is finally getting some help paying for my brother and sister's upkeep (I was over 18 at the time all this happened so I didn't count for child support).

I have a simple theory: if he disclosed, it would ruin him as a fraud to his viewers. This reminds me of a guy who owed a bunch of money on a construction project, that we sued to recover. We hired very expensive lawyers, when it finally came down to the day of Discovery, the guy showed up at this very expensive Law Office downtown with his lawyer. He literally had nothing. We had pages of documents, statements, invoices, etc. His lawyer, stunned, look at all of our evidence, and just said one word, "settle". He had told his lawyer that we had nothing. In the end, he had to pay every dime, and I'll never get back that two years of my life...just like Alex Jones, I realized he was just full of s*** and had nothing.

The plaintiffs seem to think that Jones has deep pockets. They are going after him, and I haven't read where of them sued nor pressed charges against the individuals actually making the death threats. Either they believe Jones has money, or he's the low hanging fruit. Since Jones has five lawyers, I'm inclined to think he is not the low hanging fruit.

As a Court Officer in Brazil, I've seen this behaviour from time to time. People think it's stupidity, contempt, or lunacy from the defendant. But mostly, is the defendant realizing he was bound to lose, so he tries to postpone the issue as long as he can, in hope - and delusion - that something external to the lawsuit happens and change the outcome (changes in law, political influence, somebody relevant to the case dying, etc.). It's a strategy, one that rarely works, but it's all the defendant has at that point.

This being somewhat of a high profile case is I think the only reason this strategy didn't work for Jones. I'm sure it works out frequently when the defendant has a ton of money to spend on lawyers/costs and there isn't a public spotlight on it. I don't know the specifics of this case, but its one the plaintiffs wouldn't of had any problem getting a great lawyer for, even if they had to go the pro bono route, I'm sure there were lots of lawyers willing to take this case, not so much to defend Jones especially not for free.

This is why smart people keep their mouths shut when they’re being sued. Technically nothing you say outside of court is strictly binding, but if the judge gets wind of you consistently calling this a “show trial” or trying to dox or threaten the people suing you, they’re probably more likely to see your actions as malicious rather than merely foolish.

@N Fels So far as I know, generally a judge can’t read a negative inference on a thing you don’t say in criminal cases (pleading the 5th). In civil cases, they probably won’t unless the plaintiff makes a motion for negative inference during discovery. Not responding to a question or demand for evidence during discovery *can* be interpreted negatively. You could make a negative inference about a lack of public comments about a case but I can picture a competent lawyer fending that off. This came up with a piracy case I know of (one of the old Malibu Media cases) when the plaintiff demanded the defendant’s hard drive during discovery, only to find it had been formatted and scrubbed clean. The plaintiffs moved for negative inference on the absence of evidence and got it, since it was formatted after the defendant was served, the judge inferred whatever evidence was on the hard drive must have been negative. I do know the standard of actual malice in libel can take more or less any public statement you make into regard. Alex Jones foolishly conceding the point that he didn’t think that what he said about Sandy Hook was true is a good example, pleading “insanity” aside. That admission undermined his defence that he genuinely believed the things he said were true.

It probably has to do with the fact that this is a civil lawsuit, not a criminal trial. You can't be arrested for ignoring a civil lawsuit because that's not a crime, but it does mean that you'll automatically lose and be forced to pay damages, probably a fair bit more than you might have paid had you defended yourself and still lost. Which is essentially what happened/is happening here, especially given that the judges are clearly fed up with this guy's antics and unlikely to show him any leniency in assessing damages. What WOULD probably be a crime is if Jones then refused to pay those damages, but that's more likely to result in something like wage garnishments than prison time.

It's very rare for people without much money to get sued, because there isn't much to fight over. Aside from the "He actually bought his own grift" possibility, I think he made the choice he did for practicality. The observation I’m making has less to do with legality and more to do with human nature’s propensity for violence when goaded beyond reasonable limits. Having been close to murders myself (as in, people I know having been either murdered or attempted murdered, not as in me killing other people), I can say for certain that in the throes of anger or hate, it evidently feels for at least some people like “making this one person disappear will solve my problems” So becuase of that, I am legitimately surprised none of the parents were goaded to violence by the absolutely inhuman treatment Jones subjected them to. People have killed for significantly less. Edit: it’s worth remembering that laws don’t prevent people from committing acts. They just spell out the consequences for doing them. You might refrain from committing an act because of those consequences but that’s because *in that moment* the cost benefit analysis doesn’t pan out for you. But in other circumstances people self evidently do the cost benefit analysis and determine it’s worth it to commit the act.

Odd. Here in Australia if you ignore a court orders (yes Australian judges also dislike this and you should also not piss them off) they just throw you in jail for contempt of court. You can stay there until you do decide to follow the direction of the court. I would have thought the Texas court would have done the same. The court here stated that this default judgement was done INSTEAD of escalating punishments, which would have ended as you said. I’ve listened to much of the depositions in this case and coverage of Jones’s reactions via the podcast Knowledge Fight (they also have some recent episodes interviewing one of the plaintiff’s lawyers and it’s legitimately hilarious.) I think we shouldn’t dismiss arrogant idiocy and incompetence here. Jones has dealt with MANY defamation suits before and all settled out of court or eventually gave up trying to make him cooperate. Statements made in depositions and in criminal trials he absolutely couldn’t avoid in the past did serious damage to his reputation, and the reality is that Jones is 100% guilty. He was lying in bad faith and relying mostly on 2 sources who were also lying in bad faith, including one highly unwell man who had a personal vendetta against a sandy hook parent. He DOES have a total disregard for the authority of the legal system, AND he believes that complying with discovery will harm him more than losing the money, AND he is an idiot with incompetent staff who does not keep records of anything and therefore cannot produce them, AND has repeatedly fired lawyers for saying things he doesn’t like. All of the above are absolutely true and evident from what he’s said on his show and in the depositions that did happen. He’s a malicious, narcissistic, stupid scammer, and that’s what honest discovery would reveal, so he stonewalled and hoped they’d give up. I hope they bankrupt him.

The Bill of Rights is sadly not taught in complete thoroughness in US public education. They only quiz us on the general details, and rarely are people taught how to interpret legalese. So not many people are privy to the limitations of their legal protections (unless they themselves study it), and quite frankly the US government and corporations benefit from this ignorance.

Sometimes "mean words" can have serious impacts that affect people's livelihood, life, and wellbeing. A prime example are the death threats the families received. Pretty extreme for some "mean words." When you cause serious backlash that hurts someone outside of their feelings, then you should be held accountable.
