I wouldn't agree with the word unfortunate here, that's like not getting the bonus ball in the lotto. However for someone to plead not guilty for such a violent and serious assault and allegedly lie under oath that is not unfortunate. Fantastic talented hurler no doubt, but the law should be the law and any leniency shown because of his hurling ability should not influence the correct and appropriate sentencing.

Kiely didn’t defend Hayes. He said in court he found the footage very disappointing . Kiely was called to give character witness for Hayes. This is everyone’s right in Irish Law . You are entitled to have someone give evidence about your character as they know you . Hayes was totally wrong . No question . But he has done some good in the community as well . This will be taken into account before sentencing .

If it was a black man or a traveller who did that and not a star hurler would they get the same result for a jury? No way. Sport in Ireland occupies an irrational place in our heads. We buy cars from sport heroes, we elect them to councils and the Dáil, we get them to endorse products etc, on the assumption that they are heroic characters. There must have been a few GAA heads on that jury - the trial should have been moved to Dublin.

Kyle Haynes is 16 st. 6’5” tall. Super super fit. Trains 30hrs a week, and as we’ve all seen him play can, shoulder a man , without any great effort ,the same size as himself 10’ off the pitch. My point , he could have just as easily killed Cillian mc Carty with the first or any off his blows. How many times have we seen it. One punch wonders????? Gerry you say the judge has a difficult job ? Being too lenient he’ll get flack or being too tough he’ll get flack. That situation will only arise if the judge pays too much attention to who KH is rather than what the crime is. He needs to apply the law as he would if it were Anyone else. On another note , the respect and admiration that my friends and I had for John Kiely’s has all but diminished. Why you may ask , After he admitted seeing the video footage of KH violent attack, he still decided to be a character witness ! we can only say shame on him and ask ,if it were your son John ,that he violently attach , what would you have done????? He will get a few years with some suspended. He will serve I'd say around 18 to 24 months, maybe up to 36 with another 24 suspended. He was defiant at every stage, ran, fought with gardai, dragged a jury through the lot, never accepted blame even though he seriously damaged a mans eye. 5 yrs with 2 suspended, serve 3 would be fair.

I've noticed that many young sports men like Hayes often make very immature adults: they are child/men. Many of them are also very messed up mentally, but the physicality of sport seems to quench their angst to a certain degree. Managers and trainers just want wins, often at the cost to young men's mental health. Hayes's extraordinarily unprovoked violence is indicative of some serious issues he has which hopefully will be addressed. We should cast a very wary eye over the youngsters we are entrusting to sports bodies.

Terry I am a good few minutes into video, and you haven't analysed the mitigation in favour of the defendent. There must be a degree of provocation. The background is important and the circumstances that resulted in an altercation. Kyle Hayes is entitled to defending himself.

@@terrygorry on the evidence Terry, I just wondered was there more to this, or was Kyle drunken and disorderly. I'm interested to know what led up to the incident. I personally believe Kyle will be going to prison. I don't buy him not being socialised. That's a ridiculous notion. The problem with the eye witness account is that they only saw the assault and not what led up.to it so it's not a full account. The standard of proof in criminal trial cannot be weighed too much on the prosecution case where there is an alternative argument that may not be in the evidence because the garda case is bias on prosecution and not looking at the full facts. And there may be witnesses that could provide a defence but were not available to the defendant. Kyle believes he is not guilty so there must be a reasonable explanation for that.

That grown men chasing balloons, is a method of giving people low socialisation skills. Big difference between modern amateur sport and when I played it. Two matches a week, training two night. There's literally hundreds of thugs and criminals walking our country's streets with dozens and in many cases hundreds of convictions and being given suspended sentences. Hayes made a big mistake but he has no other convictions so i would not like to see him serve a custodial sentence. Instead i think a suspended sentence with community work imo would be sufficient. To compensate his victim financially, also. Hopefully the shame he has brought on himself he may learn a lesson and will never darken a court or garda station again.

This case as far as I am aware is still sub judice as the presiding Judge has not yet given his final decision.This “solicitor” Mr Gorry in his summation of this case is acting as Judge and jury and is clearly very detrimental to Mr Hayes in the comments he has made regarding this whole unfortunate episode.I sincerely hope that council for Mr Hayes are made aware of the comments that this “solicitor”has made on u-tube regarding this on-going case.Let justice prevail without interference from outsiders who have nothing at all to do with the case.

Terry I have some experience of dealing with football players with Dublin. These guys are training to professional standards in an amateur sport. It messes with their heads. This business of assaults is more common than we think. A lot of it is covered up. We all know this.

If Kyle Hayes has not committed any crime in the last six years what point is there to send him to prison when he has clearly demonstrated that he is a reformed man. Of course most of the people on here saying Hayes should be jailed are usually on here saying Bourke should be in jail for refusing to use pronouns they favour!

6 years since the assault without getting into trouble … it kind of proves the point he has pulled his act together . He should of plead guilty When you look at the guard that beat up the taxi driver and benefited from probation act and may well be still on the force …

Terry, Your so worried about Kyle Hayes, Why dont you go a few miles out the road to Bunratty Castle and investigate who murdered Patrick Nugent, your time would be better spent at trying to get justice for Pat Nugent.Kyle Hayes has done great work for young and old, pity you don't look into that, John Kiley gave his opinion,a great man in every walk of life. as a solicitor you are talking out of your ass,.you didnt sit through the the evidence in the case ,you are only talking about 2nd hand evidence that you read in the paper or heard on radio,i have sat on a jury and unless you hear the full evidence presented by the prosecution and defence you should know better and keep your opinions to youself ,kyle hayes maybe ss guilty as sin but unless you have seen the full evidence ...shhhh and be quiet

@terrygorry I think sometimes juries probably don't understand the concept of "innocent until proven guilty" and when they hear the prosecution barrister setting out their case I'd say some of them take it as fact. Just an observation - hope I'm wrong.

There is an option for the judge here that would be an ideal solution. Let Hayes off from a jail sentence, but order him to play the 2024 All-Ireland Hurling Championship - for Kilkenny! I reckon he'd take a jail sentence instead.
