Unfortunate that Hayes, a role model for young hurlers across the country, has stooped to this low act. Do you think his employer will terminate his contract prison sentence or no prison sentence? The man works in HR!! As another commenter has said, a gurrier in his position would face the full force of the law and so should Hayes. No special treatment.

I wouldn't agree with the word unfortunate here, that's like not getting the bonus ball in the lotto. However for someone to plead not guilty for such a violent and serious assault and allegedly lie under oath that is not unfortunate. Fantastic talented hurler no doubt, but the law should be the law and any leniency shown because of his hurling ability should not influence the correct and appropriate sentencing.

The victim has a name. Its Cillian McCarthy. Not saying his name detaches people from the reality here. And its not a sad case for Kyle Hayes. This judge needs to step up and do the right thing without worry about "criticism".

Seems to me that the law ALLOWS kicking on the ground, and stomping on people's heads ( not heads in this case, I think ), because the generally low penalties clearly do not deter. In England, people seem to get longer sentences for typing a few words that some woke person deems a hate crime. Bizarre. We live in strange times, where the law has ceased to deliver justice, and is now a mere sausage machine cash cow for the Marxist-driven goobal governance that controls the global agenda at every level. /

What county is Terry Gorry solr from. I bet he is not a native of Limerick. Has this solicitor Terry Gorry ever heard of corruption in the garda force. The guards gave conflicting evidence. I could safely say they too are not a natives of Limerick. This case If it was anyone else other than a Limerick hurler would be done and dusted long ago. Kyle Hayes is being trialled by media. He told you the truth and im telling you now that Hayes will get off without a sentence because of who he is, the 2 month wait for sentencing is to allow the heat go off the case for Hayes to walk free, Hayes lied in his plea and his evidence, a suspended sentence is the same as no conviction and walking free and thats what he will get, If John Kiely, Jim Bolger or any other big shit got that horrific assault they would get justice and force it hard to have the thug jailed, who gives a shit about who Kyle Hayes is, take a look @ the unprovoked attack and injuries of the assaulted man@@terrygorry

The person i am most disappointed is the limerick manager that saw the evidence and still went on the stand to defend this thug and his behaviour, Altercations happen in life and there is all ways two sides to every story but when someone is seriously injured as i believe the other party was then the two sides to every story becomes meaningless.

Kiely didn’t defend Hayes. He said in court he found the footage very disappointing . Kiely was called to give character witness for Hayes. This is everyone’s right in Irish Law . You are entitled to have someone give evidence about your character as they know you . Hayes was totally wrong . No question . But he has done some good in the community as well . This will be taken into account before sentencing .

@FoMoCo123 character reference witnesses can sometimes look silly when it comes to defending someone in a case as clear cut as this, more so when the guilty party is arrogant enough to plead not guilty and all the evidence is stacked against him.

One point the gentleman in the video missed,the Judge noted Mr Kiely's Character reference but also noted that he had not attended the trial at any stage over the two weeks.

If it was a black man or a traveller who did that and not a star hurler would they get the same result for a jury? No way. Sport in Ireland occupies an irrational place in our heads. We buy cars from sport heroes, we elect them to councils and the Dáil, we get them to endorse products etc, on the assumption that they are heroic characters. There must have been a few GAA heads on that jury - the trial should have been moved to Dublin.

He should be treated just like a regular criminal and sentenced accordingly, his GAA standing should not enter into it at all otherwise justice will not be served.

this is a great case of *sure he didnt mean it, there was drink involved sure i know him, he plays gaelic* the bottom line is, people need to take responsibility for their actions regardless of drink/drugs the man giving a character reference done it for the ga and made himself look like a fool the defence obviously didnt brief him you do the crime, you do the time no matter who you are! with reference to the charge that was dropped, is it a case in that the other two convictions included this particular charge? i have come across this before where if a charge duplicates, it gets dropped. is that the mistake of the arresting officer and paperwork? or what constitutes this decision? thanks

Considering that Diarmuid Connolly committed an unprovoked assault in a pub where he broke the victim's eye socket with the first punch and continued the assault with the victim lying on the ground but who now does not even have a conviction on his record due to... a guilty plea, an apology and a donation of 5k, it seems that Kyle Hayes is either very headstrong or badly advised.

He could have been on drugs and a mix of alcohol, so acted out-of character.. a mix of both can make some people exceptionally aggressive on a night when alcohol and drugs taken, but he should have taken responsibility for his actions and fessed up and done his punishment.

I wouldn’t have you representing me in a criminal case ! If your advice is to plead guilty then no legal representation would be needed! He wasn’t convicted of assault by a jury of his peers ! He was convicted on violent disorder and it’s up to the Judge to determine his sentence! A fine and probation seems appropriate no jail time as you say!

Kyle Haynes is 16 st. 6’5” tall. Super super fit. Trains 30hrs a week, and as we’ve all seen him play can, shoulder a man , without any great effort ,the same size as himself 10’ off the pitch. My point , he could have just as easily killed Cillian mc Carty with the first or any off his blows. How many times have we seen it. One punch wonders????? Gerry you say the judge has a difficult job ? Being too lenient he’ll get flack or being too tough he’ll get flack. That situation will only arise if the judge pays too much attention to who KH is rather than what the crime is. He needs to apply the law as he would if it were Anyone else. On another note , the respect and admiration that my friends and I had for John Kiely’s has all but diminished. Why you may ask , After he admitted seeing the video footage of KH violent attack, he still decided to be a character witness ! we can only say shame on him and ask ,if it were your son John ,that he violently attach , what would you have done????? We can only ask and wonder ,did the GAA put pressure on John kiely to testify? Just as your assuming the judge is being put under the same pressure. Well if he applies the law same as if it were anyone else he will be walking out the door with a community service order. Any judge who hears that he has not committed any crime in the last six years would definitely reach a conclusion that there is no point in jailing Kyle Hayes.

Why are the Irish are so dam* “forgiving?” The judge needs to simply do his job - in his own best interest Mr Hayes requires a custodial sentence containing a compulsory anger management component! His absolute refusal to accept responsibility for his actions speaks volumes.

Pity, because this is the tip of the iceberg as far as this Limerick team is concerned. We thought Cody's Kilkenny took aggression to it's limit but this Limerick team make them look like girls playing badminton. If you get away with the physical stuff on the pitch you think you can get away with it anywhere. Gillane was in trouble as well and when they win their five in a row this year I don't think anyone will care much except possibly JP.

He will get a few years with some suspended. He will serve I'd say around 18 to 24 months, maybe up to 36 with another 24 suspended. He was defiant at every stage, ran, fought with gardai, dragged a jury through the lot, never accepted blame even though he seriously damaged a mans eye. 5 yrs with 2 suspended, serve 3 would be fair.

Terry I said the same he would get a suspended sentence kyle wont do a day in jail what he did was stupid but he was found guilty. His victim will now get substantial damages in my opinion. Lastly thank you for your advice and help before covid when I was studying law in Limerick got my degree thsmks.

I've noticed that many young sports men like Hayes often make very immature adults: they are child/men. Many of them are also very messed up mentally, but the physicality of sport seems to quench their angst to a certain degree. Managers and trainers just want wins, often at the cost to young men's mental health. Hayes's extraordinarily unprovoked violence is indicative of some serious issues he has which hopefully will be addressed. We should cast a very wary eye over the youngsters we are entrusting to sports bodies.

Terry I am a good few minutes into video, and you haven't analysed the mitigation in favour of the defendent. There must be a degree of provocation. The background is important and the circumstances that resulted in an altercation. Kyle Hayes is entitled to defending himself.

@@terrygorry on the evidence Terry, I just wondered was there more to this, or was Kyle drunken and disorderly. I'm interested to know what led up to the incident. I personally believe Kyle will be going to prison. I don't buy him not being socialised. That's a ridiculous notion. The problem with the eye witness account is that they only saw the assault and not what led up.to it so it's not a full account. The standard of proof in criminal trial cannot be weighed too much on the prosecution case where there is an alternative argument that may not be in the evidence because the garda case is bias on prosecution and not looking at the full facts. And there may be witnesses that could provide a defence but were not available to the defendant. Kyle believes he is not guilty so there must be a reasonable explanation for that.

you are not up to speed on the case, hayes assaulted the man in an unprovoked attack simply because he spoke to 2 women he knew in a nightclub yet hayes took issue with this, simple as, there was no altercation simply a vicious assault instigated by hayes on the victim, he is a gutter thug and the cctv evidence and garda evidence from the street outside club proove this, hayes isnt defending himself but trying to use his hurling profile and big name character references to walk free

Interesting juxtaposition. Last week you said playing sport was the ruination of young men. Now you have a judge agreeing with me. That grown men chasing balloons, is a method of giving people low socialisation skills. Big difference between modern amateur sport and when I played it. Two matches a week, training two night. No need for the GYM. We walked everywhere. Food was smaller portions. So we were as fit as fleas. Afterwards a few pints and try and chat up a few girls. Nowadays everyone is chasing a shiny eggcup. If you don't win the piece of tin, it's the end of the world.

There's literally hundreds of thugs and criminals walking our country's streets with dozens and in many cases hundreds of convictions and being given suspended sentences. Hayes made a big mistake but he has no other convictions so i would not like to see him serve a custodial sentence. Instead i think a suspended sentence with community work imo would be sufficient. To compensate his victim financially, also. Hopefully the shame he has brought on himself he may learn a lesson and will never darken a court or garda station again.

While that's true, he also made a plea of not guilty. This normally doesn't favour well in sentencing for people who are convicted.

He could regret getting involved - that doesn't mean he should have pleaded guilty. Maybe he believed that he didn't intend to use violence and didn't threaten to use violence. Much worse things have been done by pillars of society in the last four years.

Hey Terry, just came across this because it appears that the goof is back in court. I’m in the US and it’s insane that there’s video footage of this strong athlete kicking a human being on the ground. Is this victim pursuing civil damages? The victim needs a fund. This is a disgusting story. Just subscribed.

It seems to me like Kyle Hayes has an issue with alcohol, he blacked out and couldn't remember. He's a "mean drunk" from what it sounds like, and should be required to attend an alcoholic treatment program while serving time in prison.

I'm struggling to see why this man is giving us his opinion on this. The jury found him guilty and the judge will give him his sentence. Leave his hobbies out of it.

I suspect Kyle will get some sort of prison sentence on the basis he is a high profile GAA player. If he was a gurrier in front of the courts every day of the week he would be let off and given another chance as we see in the Dublin courts.

Quite the opposite,I know of lots of cases where gaa players are involved in drugs and have being caught but yet its swept under the carpet,gardai and gaa all the one gang of corrupt bastards, sure half the gaa are guards.if there was any chance this could have being kept quite it would have being.hope the victim gets justice and compensation for his injuries.

That's a joke of a statement, I witnessed a prominent gaa player in waterford attack a man on his way home one night an unprovoked attack. The man defended himself and the gaa man was put to sleep. The garda wouldn't take statements from witnesses there and an innocent man was charged with assault on an arrogant gaa dope. It's a joke these lads get off with everything

Had the assault was on Kyle Hazes by the victim would the outcome be the same? I very much doubt it. John Kyle should not have been allowed to speak for the accused either. I also think you gave an excellent view on the case. Thank you for sharing.

This case as far as I am aware is still sub judice as the presiding Judge has not yet given his final decision.This “solicitor” Mr Gorry in his summation of this case is acting as Judge and jury and is clearly very detrimental to Mr Hayes in the comments he has made regarding this whole unfortunate episode.I sincerely hope that council for Mr Hayes are made aware of the comments that this “solicitor”has made on u-tube regarding this on-going case.Let justice prevail without interference from outsiders who have nothing at all to do with the case.

Who is this judge anyway that thinks he is still a judge .Everybody knows what he did was wrong 5 years ago .Listening to one gaa pod lots of similar assaults have occured in Gaa circles without half the publicity .With Kyle Hayes or without him we will still make history .🏃‍♂️🏃‍♂️🏃‍♂️🏃‍♂️🏃‍♂️🏃‍♂️

Terry I have some experience of dealing with football players with Dublin. These guys are training to professional standards in an amateur sport. It messes with their heads. This business of assaults is more common than we think. A lot of it is covered up. We all know this.

If Kyle Hayes has not committed any crime in the last six years what point is there to send him to prison when he has clearly demonstrated that he is a reformed man. Of course most of the people on here saying Hayes should be jailed are usually on here saying Bourke should be in jail for refusing to use pronouns they favour!

I knew what Kyle did was wrong. .Never kick a person when they are on the ground thats not a GAA thing. First offense should be suspended sentence.... If he was a migrant he would be getting off with a warning!!

6 years since the assault without getting into trouble … it kind of proves the point he has pulled his act together . He should of plead guilty When you look at the guard that beat up the taxi driver and benefited from probation act and may well be still on the force …

Terry, Your so worried about Kyle Hayes, Why dont you go a few miles out the road to Bunratty Castle and investigate who murdered Patrick Nugent, your time would be better spent at trying to get justice for Pat Nugent.Kyle Hayes has done great work for young and old, pity you don't look into that, John Kiley gave his opinion,a great man in every walk of life. as a solicitor you are talking out of your ass,.you didnt sit through the the evidence in the case ,you are only talking about 2nd hand evidence that you read in the paper or heard on radio,i have sat on a jury and unless you hear the full evidence presented by the prosecution and defence you should know better and keep your opinions to youself ,kyle hayes maybe ss guilty as sin but unless you have seen the full evidence ...shhhh and be quiet

​@terrygorry I think sometimes juries probably don't understand the concept of "innocent until proven guilty" and when they hear the prosecution barrister setting out their case I'd say some of them take it as fact. Just an observation - hope I'm wrong.

There is an option for the judge here that would be an ideal solution. Let Hayes off from a jail sentence, but order him to play the 2024 All-Ireland Hurling Championship - for Kilkenny! I reckon he'd take a jail sentence instead.

Your flippant remarks here shows disrespect for the main person in this case, the victim, the chap that had his head and eye socket hammered to the point of near blindness. In his autobiography, he admitted in his autobiography to stealing a taxi car while drunk, then playing his GAA-star card in the Garda station to get off on charges. The only thing he is guilty off is winning five All Ireland hurling medals. If I blame Hayes for anything it’s for not going Mano to Mano on McCarthy and I would never approve of kicking someone on the ground but hey there were all testosterone fuelled young lads. If the judge wants to be kind to McCarthy he will find in his heart and in his brain forgiveness!
