bad verdict ! who the hell is gonna pay for a rental that still needs repairs and is not fully ready yet ? this judge was biased because she too is a landlord and she is out of touch with those who have alot less money than she does . in my neck of the woods landlords do not demand payment when necessary repairs have not been done . and the realtor should not had been allowed to keep the fee because she did not find a place that was fully ready for a new tenant .

I don't understand why you need a broker or real estate agent to get you an apartment I'm in SC and we don't do that here. Fill out the app pay the $25-$100 application fee pay the deposit and first month and move in thats it.

This is New York City that has a population of 8 million. Technically no one needs a broker however the volume of listings is huge as a renter. As an owner or landlord, it is your job to wade through the huge number of applicants including any credit or background checks. Also the landlords were elderly so it was easier to hire a middleman. Some properties will only rent through a broker for many reasons.

Fair ruling, but tough lesson learned the hard way for the plaintiffs. Never agree to an apartment that isn't ready when being shown to you. The broker needs to adjust her professionalism to reflect that. She should never show something that isn't rent ready. So that's her reputation, and why she didn't use the company name. She knows that she's sleazy and just out to make a buck, regardless of whether the product is of good quality.

What do they need a broker for anyway? In FL we rent directly from the landlord unless they have a leasing agent that they pay for themselves. NY laws are so messed up. What a ripoff. I can't believe people stay there.

she failed to do the only job she had to do , which was to find them a place that was ready for a new tenant , the place was not ready for a new tenant and they never actually lived there for any reasonable amount of time because of that so she should have to give the fee back , she failed to do the ONE thing she was paid to do , she was not paid just to find any place that was being advertised , they put their trust in her to find a ready place and she failed them and took their money , this was a very bad verdict .
