One other thing I'd take into account is how common the scroll is, unless you have a no-scroll rule. Spells like Haste and Misty Step for example are very useful but feel very much like a waste to learn given how abundantly you can find the scrolls in shops.

I’m a bit surprised you’ve kept some of the AoE damage spells so high in this list. In Act 3 they just aren’t as useful as single target or control spells IMO. Spending a level 10 magical secrets slot on them feels pretty wasteful. At this point I’d personally drop fireball down to ‘not the worst choice’ and lightning bolt and call lightning down to ‘item/build dependent’ (since lightning damage can at least be doubled on wet targets). Others I’d probably bump down at level 10 are mass healing word (build dependent) and hellish rebuke (something better above). I also think banishing smite deserves a bit more love here. 5d10 force damage on top of your weapon damage is excellent, especially when you can double it with a crit. Having the ability to banish any enemy that drops below 50hp is a nice bonus too. I’d shift this one to ‘usually good’.

I'd think there's a strong case to be made that for a melee swords bard, banishing smite is top-tier. For a Smiting swords bard in particular, you can stack a regular divine smite on top of a banishing smite. Combined with an auto crit (from luck of the far realms, or executioner, or a paralyzing condition) I believe that's the most damage a single swing can do without tons of set up.
