@@jb5146 Yep, sometimes you have a bush that has to be trimmed, and sometimes you have another uncontrollable obstacle like a wall, fence, or even truck blocking your vision and have no choice but to edge out slowly, and you have to realise that the drive can't see you. Rules are different everywhere in the world though. Riding on the footpath is not legal in my country unless you're delivering mail.

In contrast, I think Ms./Mrs. Jackson, the plaintiff, was being honest and respectable. She may not have been a perfect person in this situation (obviously, there are alternative choices of actions she could take, moving forward), but she was very real and upfront with the Judge. Notice that Judge Judy was hardly giving her any trouble. That's a good sign: that the plaintiff or defendant did the right thing in court.

The kid had plenty of time to see the car pull out and stop. He probably got nervous and didn't know what to do. Most kids his age probably would have done the same thing.

You have to stop at your property line. Read your driver manual. Pedestrians ALWAYS have the right of way on sidewalks. I could jog into the side of your car and if I can prove you obstructed the view with a fence or plant or shrub, I’ll win every time against you and your 2000 lb car

Not only did she cross the sidewalk, she sat there like a child herself. She really felt like where she had to go was far more important than the child on the bike.

⁠legally as the driver she's in the wrong. A. It's the sidewalk where pedestrians have the right of way. B. It's a child on a bike. The car insurance company would even find her at fault.

She expected him to stop or go around. However she didn’t leave a child enough room to go around. He was probably afraid he’d end up in the street if he went around the front. So he attempted to go around the back and didn’t have room to turn.

@@TINABLESS88 Yea I get that, but there was a reasonable amount of time and distance for him to stop as well. He just continued as if he didn't know how to stop a bicycle. Having the right of way doesn't mean anything that comes into your path you just run into and take zero responsibility.

there's a principle in the UK Highway Code for road safety that assigns a heirarchy of right of way - Judge Judy seems to be using a similar principle here. cyclists have to stop for pedestrians, cars have to stop for cyclists and pedestrians, and stuff like that. its based on who is more at risk if an accident were to occur and if you go against the code, you're at fault. makes sense to me! as an aside, this is one of the reasons jaywalking is not a crime in the UK - pedestrians on the road always have right of way over vehicles.

JJ ignored the fact that a vehicle was traveling on the sidewalk. If he couldn't stop for an obstacle that should be his problem and he should pay for any damage he causes.

Is that a somewhat recent change in UK law? Because when I was there last summer I remember I was told that cars always have the right of way except for at crosswalks. This was in central London by the way.

​@@Zizzles pedestrians don't really have "right of way" in so much as they can do as they please but if you hit one you are automatically liable unless you can demonstrate it "wasn't your fault" ie they ran out in front of you.

Nothing in the US is that simple but the end result is the same in this case.. If a bicycle stops in front of a car and the car hits the bike, it's the car's fault as long as the car "COULD" have stopped in time..

So she blocked the sidewalk and expected a child to either zip on the road and potentially endanger himself, or to stop so she could have right of way? Yeah, that's not how it works. JJ was right, that bush blocks her sight of the road. She should be happy it wasn't an electric bike she blindsided. Sure the kid had plenty of time to see her and stop, but he had the right of way.

Yeah, it was as if there was a child behind the wheel of the car. She could have easily reversed her car and let him pass. Something was wrong with the way she rationalized the situation.

In my state, bicycles are NOT suppose to be ridden on sideWALKS. So, the road is where he should've been. And if so, he would not have hit the car.

In most states in the US it is illegal to ride a bike on the sidewalk. Sidewalks are meant for people, not bikes.

I really think the kid had enough time to stop his bike before hitting her. Maybe he wasn’t paying attention and looking down. But she did stop when she saw him around the bush. I guess she’s going home and doing yard work.

Kid had enough time but he’s not supposed to have to stop. Nor should child have to dangerously swerve into street. I was on side of plaintiff thinking the bush was at a street corner. It’s her property and her responsibility to make sure vision is clear. JJ around me with her clarity of thought again. Just to play devil’s advocate, you can see the kid’s feet off the pedals at the end. He saw car in front of him and freaked out and bike may be a little too big. He had time but plaintiff cause his to have tunnel vision. If she stopped before hand, he would have been good to go.

I think the kid miscalculated his turn, he probably thought there was enough room for him to take that turn but couldn't see it because of that bush. So yea, either way the bush blocked the view and thankfully the plaintiff did see the child on time.

He has the right a way since he’s riding a bike on the sidewalk. A vehicle is supposed to wait for both bikers and pedestrians. The bush blocked the view.

He took a turn thinking he won't have to go in front of the car but unfortunately due to the car being on the sidewalk, he drove rigt into it. At least that's how I see it.

The kid riding his bicycle on the sidewalk had the right of way. It was the plaintiff's fault for not looking both ways before crossing.

I don't think it's a hood. It is a suburban district. "Hood" is slang with a connotation that doesn't apply. For example, I live in a sedate old mill town, in housing originally built for mill workers in the 1800s. It is a village, not a "hood". Some of us are white, most of us are of European descent, is that why it is not a "hood"? If we, hopefully, diversify, with more ethnicities buyng homes, will this be a 'hood"? No.

I don't think she saw him because of the bush. She said she did because she knows the bush is an obstruction and she would have lost the case. At lease by saying she saw him she could make an argument. The kid tried to go around her but clearly there is no room unless he goes in the street. If he couldn't stop he made the right call.

The mother should teach the boy that he should ride slowly when he's crossing areas (like driveways) where he cannot see an oncoming car..if he values his life. She should also make him wear a helmet, especially since instead of stopping to avoid an obstacle, he just crashes into it. Having said that, he had the right of way so the plaintiff had no case. If she turned into an interception, blocked the street and a car who had the right of way crashed into her, she would be liable.

Your opinion doesn’t matter like she said if she saw the boy coming why did she keep going ? Boy had the right away if she wouldn’t of cross out of her drive way he could of kept going because he was literally in the right and riding in the side walk. The first thing I was taught when i got my driver's license was never assume the other person will do 'x'. That includes breaking the law, so if you see a car coming up to a stop sign, make sure they WILL stop before you proceed. The only thing you have control over when driving is your own car.

Agree. I don't drive but as a pedestrian even when I have the right of way , like at pedestrian lights were its clearly my right to walk, I always wait till the drivers stop as there will always be that idiot trying to beat lights or not paying attention. My dad will say why are you waiting, you have the right of way just walk? It's like dad I don't feel like being hit by a car or cyclist right now so 3 seconds to make sure they stop ain't gonna alter my life like it would if I got hit just based on PRINCIPLE... that said we really can't expect 7 year old to act like adults so def your right the onus is on the driver.

I don't know why im surprised so many people are blaming a child instead of the full grown adult in this situation. When you are in a car you cannot block intersections or paths of easements until you have checked to see if the path is clear. She could not because of the bush on her own property which she can amend herself. To expect a child to know exactly what to do in that situation to cause her no damages is insane. Chalk it up to an accident and pay for it yourself. Correct ruling.

Exactly! When I was a kid my mom would tell me all the time to stay on the sidewalk. And him going around the car into the street probably went against those rules if he had the same rules. She should have backed her car up when she saw him.

Looks like the bike was way too big for the kid-thats why he couldnt stop-he had no control near the car, either to stop or turn effectively......Still, the plaintiff is responsible, our laws dictate that pedestrians and bike riders have right of way in any situation that walking or biking is permitted.

Why do people feel entitled to compensation from pedestrians or people on their bikes if they are the ones driving the vehicle? It will always be your fault by default. That's why you take the L and move on. If you take it to court it will never work out the way you want it to.

Sometimes when I'm exiting a business plaza, there are bushes on the sides which make it nearly impossible to see traffic. They are just accidents waiting to happen, if they didn't already.

Equally, downtown there are buildings that completely block one's view from anything coming from either end of the sidewalk, when pulling out of a local bank driveway. It's impossible to avoid a bicycle coming along in such a case. That's one reason why bicycles are not to be ridden on sideWALKS. The boy was at fault here. Had he been riding along the curb in the road, he never would've hit the car.

The issue is that you’re not supposed to block the sidewalk. The same with stopping at a red light, you’re not supposed to go beyond the wide white line. Many people don’t know that and 99% of traffic officers don’t enforce it.

yes but the problem is that the driveway crosses the sidewalk. there is literally no way for her pull out far enough to observe street traffic without blocking the sidewalk at some point.

Looks like the lady slowed the video down between 30-50% if you speed up the video here by 1.25 or 1.5, you'll see the actual speed of the clip.

The only reason i agree with JJ is because regardless of how much time the kid had to stop… the plaintifff pulled out and blocked the sidewalk. She didn’t inch and stop she kept going. And going till she blocked the entire path. The kid has a bike and you have a car. Which is a weapon. Any normal driver would have reversed or stopped way ahead had they seen the child. But she had that bush. If she did see the child like she claimed and blocked him anyway then that is a jerky and dangerous thing to do. I picture it Like a cross walk with a stop sign. She did a rolling stop and blocked a pedestrians way. It’s not safe to make a child go around your car, they are on the sidewalk for SAFETY. She couldn’t see and she should have treated the child like they have a “right of way”. She blocked his path then watched him run into her.

so ill remember to go and ride my bike into every car that's stopped at a stop sign or stop light over the crosswalk (which basically everyone does) and beat up a bunch of cars for free. not my fault.

The kid was trying to stop. In the video you can see he was pedaling backwards to stop.

The plaintiff is very sneaky with this one. It absolutely looks like the kid had more than enough time to stop, but if you look at clock in the top corner of the footage the seconds are not going at the right rate, I think she messed with the playback speed to make it look like the kid had plenty of time to react. I think JJ got tot the right verdict with the wrong reasoning.

That video was slowed down. She should have not pulled out if she saw him then slowed the video to make it look like the boy had plenty time to stop! She knew she was in the wrong, hence altering the video. I hope you'll don't drive.

JJ made the correct ruling! The driver needs to remove or severely trim the bush at the side of her house. The lady pulled across the sidewalk before she stopped. That is illegal.

1:00 It doesnt need a replay and I cant believe that damn bush caused Plaintiff to lose the case. Not only didn't the kid have enough time to see the front of the car and stop, but he also actually sped up because he cranked the pedals forward 4 times as the car was pulling out and his feet was still moving after the car came to a complete stop. Teaching the kid zero accountability at his young age is a good way for him to end up in the system blaming everyone else for his actions.

What a ridiculous comment. Just because this lady is driving a car she has the right-of-way?!?! I don’t think so. SHES ON THE DAMN SIDEWALK! Cars don’t belong there! She apparently saw the young man and still decided to proceed INTO the sidewalk. That’s outrageous. Yes the kid should have been paying attention and stopped but it was her responsibility no to enter the sidewalk.

The lady had stopped, but she had covered or blocked the pedestrian/ bike path so the kid bumped into her. Yes, the kid should have stopped too, but had she stopped before crossing the pedestrian path leaving it clear for the boy to bike straight ahead then he would not have hit her. Judge Judy thinks if the lady in the car noticed the boy coming down the path, she should have not have blocked his path and by doing so she caused the accident to happen.

The fact that he had time to stop is irrelevant. He’s the pedestrian, meaning it was HER role to stop. Not his. He’s 8. He prolly made a split decision in his mind to go around her car in the back cause he didn’t want to risk going into oncoming traffic in the front. Then saw he had no room and crashed. Had the bush not been there the woman would’ve saw him coming and not blocked the sidewalk. Very ill decisions on her part. Judge was right.

i don't know about the state the plantiff is from but, when taking a driving test if you pull onto a sidewalk to look to see if anything is coming, you flunk the test. period.

The bush which she said was on her property, restricted her view so she would have to move her car further out to see what was coming. The car also went on the sidewalk. Those factors did not help her case.

And ESPECIALLY if he is still learning, he should be wearing a helmet. In my city, helmets are required by law (parents fined, not kids of course) until age 16. I suppose they figure if you can drive a car, you can decide if you want to risk major head injuries when riding your bile.

Who knows what his environment looks like and where it’s safe to ride. “A free pass” lol… we are talking about a child here right? A pedestrian walking a dog should definitely watch where they’re going and not be looking on their phone. If they’re alert to the child, they’ll be fine. I’d advise the mother place a helmet on the child tho.

Always treat a kid on a bike like a deer in the ditch--they are totally unpredictable, except for the fact that they are guarranteed to do something stupid and hurtle themselves into harm's way. But JJ should have severely admonished that boy (and his mom) for not wearing a helmet. Both parties should have gotten their teachable moment, not just the driver.

We can see the car from the perspective of the camera. But the kid probably couldn't see the car until it was in front of him because of the bush. So, he didn't have as much time to stop as people are assuming

The child could not anticipate what the driver was going to do. He couldn’t turn either way because he couldn’t go out in street AND if he tried to pass around on the right, he had no clue if she might back up in the process. There was no way for him to avoid colliding with the car. I’m glad neither party was injured. Could have been a tragedy if he’d made it halfway cross the sidewalk as she pulled across the sidewalk. My nephew was 8 years old when he was riding bikes with his buddy through an upscale neighborhood. The tragedy occurred as a driver hit him. She wasn’t going fast, nor was he. And he was being very careful as he’d been taught to do. Her error in judgment was when she didn’t slow down and failed to anticipate a child’s reaction when he realized a car was swiftly approaching from the rear. She hit him and he’s been a paraplegic ever since, which not only put him in a wheelchair for the rest of his life, but also caused many other complex medical issues due to complete paralysis from the nipple line down. He only has one half of a functioning lung, kidney failure because he can’t tell when his kidneys are not Working properly, bed sores, chronic fatigue and digestive issues, including liver, pancreas and colon malfunctioning. He’s a very sweet person who holds no grudge against the driver. Sadly, both his parents are now deceased and it’s so difficult to get approval from Medicaid and Medicare for full time nursing help in his home. Or even home healthcare from a medical assistant. As adult drivers, we are obligated to expect the unexpected, especially when it comes to children. There was a time when he had a van equipped with a wheelchair lift and hand controls. He rolled his chair right to the driver side. He was the most safety conscious driver ever. Due to his failing physical health, he no longer drives. And he depends on the generosity of a few close friends and relatives to help with his needs. Prayers are greatly appreciated for him and his helpers.
