Thus judge has a duty to move this case along and also making sure due process is protected and let's face it the victims rights is a joke compared to the defendants rights in this country so I'm glad she made this ruling. I believe she made sure nothing would jeopardize any appeals before she decided this. Their objections are still heard but she doesn't want the 15 minute sidebars that are exactly the same every single objection on these videos. You can still object to something the judge has ruled on but to object on each and every one of the judges ruling and then to present the same exact argument that she already denied during each witness testimony is just a way for them to draw out the process. The judge caught on to it pretty quickly. If you’re going to object and make the same exact argument that you had already made you can just say continuing objection instead of literally repeating everything you said when she ruled on the objecting earlier.

Depends what you mean by “as many times as necessary”. Showing the same photo or video more than once is cumulative and prejudicial to the defendant. Once a piece of evidence is published, the jury has access to it during deliberations. If they want to rewatch it, they can ask the judge to let them.

As a juror in the murder trial I was in, 6 of us (jurors) sent a letter to the judge and requested this very thing. They kept removing us from the courtroom for every sidebar and we were losing our train of thought, which could lead to a mistrial. The judge agreed with us and our assessment. He questioned each of us if we can provide a fair and unbiased decision with all the side bars and the easy answer was "No". The judge was not irritated with us, but he was irritated with the prosecution and defense.

In a horrific case like this it can make the public defender look immoral, but they just as well could've been assigned to a case where their client was being railroaded with excessive charges, or completely innocent but the easiest target. I'm not against the death penalty here, but consider that in the year 2000, Florida was spending $51 MILLION per YEAR to keep the death penalty active in the state, compared to what would be saved if all death sentences were commuted to life without parole (and LWOP became the only penalty for 1st degree murder). Capital punishment in the US isn't cheap.

The trick of this is that the jury is to decide based upon the evidence whether or not this is a death penalty case, in most cases when a defendant pleads guilty he or she is given life, because they have admitted their guilt. If it were up to me based on the facts, the evidence, and his demeanor following the act and following his arrest, I’d vote for the death penalty. He knew what he was doing, I don’t see any evidence of insanity, I see no remorse. He has only shown remorse since his arrest due to the fact that he did not get away with it.

It may be the case that Florida appellate courts require that the basis for the objection be laid out as well. Some states have appellate courts that would say “well you objected These 4 times but the 5th Time you didn’t specify what the objection was so that objection was Never Made.” I think his lawyers are just trying to be thorough and do what they can. Cruz is gonna spend the rest of his life in prison or he’ll be killed regardless so I think it best That the process just plays itself out. Now, however, the Defense May well say the trial court denied them the ability to make objections.

Honestly, when you're on camera killing someone or multiple people and your trial is nationally televised because it's so high profile and gruesome, you don't have a mistrial coming. The defense attorneys are doing their jobs preserving the record for an appeal. In any trial, if an objection is not made during a trial, it cannot be used on appeal. It is called "preserving the record". It should also be stated, Cruz has pleaded guilty. This phase of the trial is all about punishment: life imprisonment or the death penalty. This discussion outside the presence of the jury shows that the defense attorneys have already conceded Cruz is more likely getting the death penalty. The defense attorneys are preserving the record. While tedious, it is their job.

No matter what happens in the case. This case will see probably a minimum of 12 appeal hearings. It's extremely expensive to conduct death sentences. Just get rid of death sentences and give him life. We can spend the next 60 years asking him question and figuring out why he did it, and learn how to spot it. (This is how the FBI got good at profiling serial killers, by talking to the ones locked-up.)

It’s not a trial, it’s a penalty phase. He is guilty of the crime, but the jury is being presented evidence to prove motive, intent, premeditation, etc. in order to determine the eligibility of death penalty or life in prison. Once the penalty phase is over, there will be a sentencing phase. Then we will likely never hear or see him again.

The prior phase is called the "guilt phase" and he already pleaded guilty to 1st degree murder charges (1st degree requires intent and premeditation). This is why I decided not to go to law school after getting my degree (even though I took courses that were basically pre-law). When you are an attorney it is your job, obligation, to represent your client to the best of your ability, personal feelings aside. A client could tell you “I’m guilty” in private but if you see a loophole or chance to cast reasonable doubt it’s your job to do so personal feelings aside. Attorney Client privilege is a double edge sword at times. I could not bring myself to imagining I had to represent someone I knew to be guilty or prosecute someone I thought to be innocent simply because it was my job and thus I knew I couldn’t do that job effectively. I can only imagine what his defense team is going through. They’re doing their best knowing he’s the worst
