This video is basically my reaction to the Luke Combs tumbler lawsuit that is being carried out as well as his response to the lawsuit itself. There is a lot of controversy going on here so I want to know everyone's opinions.

I agree with you 100%. If he wants to help her, that's his prerogative, but the law is the law. I am so tired of people questioning it. I work in publishing and one of our white papers was posted on a company's website with all of our identifying information removed. They took it down after I contacted them, but no remorse, no indication they cared that they violated the law.

The one major thing i have always respected about you is that you always tell people about copyright and trademark infringements. So many content creators don't do that. So thsnk you for that and i truly hope people are listening to you about that.

I always buy the commercial license on SVGs I think I might decide to use on a product I would sell later on. Copyrights and patents are nothing to play with.

Nice job! It amazes me how many people/creators either do not understand, or choose to ignore, laws governing copyright and ownership of material. You did a great job explaining this issue, no doubt you will get a ton of negative reaction for being rational, however, those reactions are emotional not reality based, and the reality is that it is illegal to infringe on copyright and there will be/should be consequences if your are caught doing this. If you want to produce items using material which is copyrighted, be ethical and put forth the effort to request permission to use the material. If you do not receive permission, you do not produce and sell the item, it’s pretty simple, really.

I agree with you about Luke's reaction. Too many people are already under the opinion that they should be immune to getting sued because they are a small business. Too many think because they are small, they won't get caught. Way too many have no idea what the laws are for running their business. I knew a home baker who got caught up in a Disney sweep. They sued and also took everything she used to create these cakes, including utensils and her oven! It only takes one time to ruin your life. It's not worth it to me. With Luke saying that he wouldn't want to hurt a small business is not a good thing. He may feel that way personally, but as you said, sports, schools, they won't feel the same way. You cannot make money using someone else's brand. They worked hard to build their brand and it's not for you to profit off of their name.

While I agree that the email service & the amount of the judgement are unfair, it doesn't erase the fact that she did break the law & continues to do so.

Only use images that you buy at a reputable site. Read the license agreement. Be sure you can use the image as intended.

When using Photoshop to sell images on Etsy, should the images be RGB or CMYK?

Depends on their purpose. RGB is mainly for screens CMYK is what our printers use to print. Sublimation generally CMYK. Anything being printed CMYK. Display stuff RGB

I totally agree with you about her breaking copyright law. The law is strict and needs to be due to the vast offshore and even onshore violations. Start posting some best-selling t-shirt designs or tumbler designs, and you'll see how fast they're copied. It might explain why people want to protect their IP, and sellers need to respect that. Luke is a musician and working hard to be a great one, his image, etc is owned by his management company, so yeah, he probably doesn't understand copyright/ trademark law but his management company knows it'll lose income if it allows infringement of any kind so they step down hard. I think this lady just saw some "guru" saying how much money she could make selling tumblers and didn't really take the time to think. The law that allows email service is horrible. I was actually negatively affected by it out in Oregon. I had purchased a car in California then I moved to Oregon. The dealership paperwork person filed the paperwork incorrectly, so the State of California tax board went after me for failure to pay sales tax (which I didn't owe). They did everything via email to an email address I had in California but closed when I moved. I found out about it when they went into my bank account in Oregon and took the last $2000 I had. They had charged me with failure to pay and then assessed penalties all via emails they sent to a non-existent email address. I finally got most of the money back through appeals, but they wouldn't pay any of the penalties the bank charged me for bouncing checks that only bounced because they took the money they really weren't entitled to.

Wow that's crazy about the tax story. Email should not be a form of communication. I really just hope the Trademark Copyright stuff doesn't get more out of hand than it already has...

Thanks, taught me a lesson. National banks will give any state access to your accounts; all they have to do is have a State official request it. They won't tell you that the state has accessed your private information nor inform you when they take your money. @@ShootingStarSVG

Part of the problem is what if, heaven forbid, one of her products hurts someone, and it has his face all over it. They could decide he was part of the production making by endorsing it or allowing her to use his image and get tied up in an injury lawsuit. While i get he is trying to be nice, unfortunately he is setting himself up for increased risk, which he probably has insurance for through his label, and the insurance carrier could increase the premium for that coverage. I get he just wants to make music, but he needs to educate himself on the business side of his industry.

Yup. I agree. You have covered this topic over and over again. Not that everyone views "Your channel", but sorry, they know what they are doing! The crocodile tears just begin to flow when they get caught. No sympathy here and, she hasn't learned anything . The next time, they'll probably not be so foregiving.

I just read online that Luke Combs had no idea of the lady being sued. He reached out to her already to give her the money that Amazon from her. He is also going to help her through this nightmare.

You're right - I comment on his response in the video but the point is he is now setting a precedent for everyone without taking into consideration what she has done is not legal in the first place.
