It was a little white lie.
No big deal.
You figured the defense would never learn about it.
You didn't even bother to tell your own lawyer.
But the moment the opposing attorney asked you about it during your pretrial question and answer session known as a deposition, you knew there was no way you were going to tell him the truth.
You figured it had nothing whatsoever to do with your medical malpractice or accident or wrongful death case. You were right about that. However, your intentional decision to tell a falsehood (also known as a lie) will have some devastating consequences for you, your case and possibly even your own attorney.
If you lied under oath, you could be prosecuted for perjury.
The judge might refer you and your case to the district attorney for criminal investigation and possible prosecution.
If you lied under oath, your credibility will be destroyed and it could easily destroy your otherwise valid case.
If you intentionally lied, there is the possibility that the judge will think your attorney knew about it and had an ulterior motive for putting you on the witness stand, knowing you were going to lie in order to try and achieve a favorable result.
