It seems like your case is taking forever.
It's been months since you met with your attorney.
You haven't heard anything.
You know these cases take a while, but this length of time without a word is ridiculous.
Then, after your lawyer finally confirms you have a valid medical malpractice case, you can't understand what's taking so long. You expect the justice system to move quickly.
You know the facts of your case.
Your lawyer knows all the details of your case.
You expect the attorneys for the doctors will quickly get up to speed on your case and want to move this along quickly.
Then, when a discovery schedule is set up, you can't understand why it's taking so long for pretrial depositions to take place.
You're frustrated.
You're anxious.
You're upset this is taking forever.

hey ive always wondered - how can cases drag on this long? after your lawyer filed the lawsuit, and then had the CMC ~ 6months after that, didnt the judge set a trail date that was ~12 months after that? so how did you get to 4 years?

@ My first attorney waited until 2 weeks before the deadline to file the case 😡 The defendants constantly filing motions to dismiss. When they lost a few months ago. That’s when the case started moving forward. We’re currently in the discovery phase

Isn't it easier if the plaintiff gets the records? I've had no problem getting my medical records myself in very short time with a medical records release form.

What happens if you are near the end of a multiple settlements, afrer investing time and money into the case, and you die. Does a new lawyer take over and credit your estate. It's like having a lots of un-hatched eggs

All states have laws that require hospitals/doctors offices to turn over records within a reasonable time. In Texas, the law says they have 60 days to respond. So the hospitals/doctors cant delay it forever.
