Her stepfather had been ab*sing her since she was a child and/or at the very least grooming and exploiting her since she was 19. She went on to become a s*x worker which is a very common trauma response. Yes, technically speaking if she wanted to accept payment from her stepfather specifically in exchange for that kind of favours she was legally allowed, but the question of free will and definitions of danger are extremely dubious in this case imo. I don't know if the killing itself was simply out of jealousy - I don't think it could ever be "just" that, considering the step family relationship - but either way this is a very tragic story in which there's no way the victim wasn't the author of the situation to some capacity.

Maybe by the current 'law', he is guilty, but what Sean did was a moral act. His girlfriend was being raped by her abuser from almost a decade, Sean saw the sexual abuse happen before his eyes and he performed an act to subdue the perpetrator from continuing to perform rape upon his longterm victim. A good lawyer could've defended Sean, in my opinion; however I am just a layman. It makes sense why she would say 'stop' to Sean, having been brainwashed/groomed since she was a child by the same man raping her in that moment.

In this instance I disagree with your final conclusion. Miranda had previously charged the victim with SA when she was a child. Even though these accusations were later dropped by her, I believe they were honest and that she later denied them because she was a fragile, abused child in a horrible home life and perhaps decided it in her best interest to withdraw her claims. Furthermore, we don't know what she told Shawn regarding abuses made at the hands of her stepfather. Just because a victim becomes an adult it doesn't negate the fact that they were victimized and could still be operating under the psychological impact of childhood SA. The fact she chose to become a sex worker is a common result of childhood SA. I think the charges were fair, he's guilty of manslaughter, not murder, not even in the 2nd degree. Still, excellent post. I live just a few miles from Maryville and was already aware of this case, though not privy to all the information you've provided and it gave me clearer insight into all the factors that played a role in this case.👍

Sad. I agree with you- I think he thought he was in the right. I feel like there’s a lot of confusion due to the whole, “is she too drunk to consent?” thing. I’ve heard so many men say they are afraid to approach a woman cause they may be intoxicated and the guy may not be aware (the woman may have a high tolerance, or simply may handle themselves well). I can imagine in the same sense, a man would have the confusion of whether or not to protect a woman if they’re intoxicated, or to just let them be. In any sense, unless someone is being violently taken advantage of, it should never have escalated to what it did. If anything, he should have called the police, and maybe at the most kept him held down until the police got there. Her life wasn’t in danger, so the force was unnecessary. Personally, if a woman isn’t saying no verbally, screaming, stumbling, slurring her words, having trouble staying on their feet, and/or falling asleep standing…. she’s more than likely in control of her actions. If you feel like you need to help someone in this kind of situation and they’re not showing any of the above signs, ask them if they need anything or ask them to help you find a bathroom or something- if they need help from who they’re with, they will use that as an excuse to walk away with you. If they don’t, then they’re fine. (Of course- you gotta do that before the person starts the as**lt, but yeah.)

⚖ Totally agree with Dr. Grande unexpert layman's observation. Also, in my opinion, the sentence Sean Foley was given is too lenient, it's unjust. If Sean felt there was danger, call the police. This didn't need to happen. 😥 I don't understand how a judge would give Sean custody of an infant. He is a violent criminal. Also disgusted with Miranda's mother, who failed to protect her child and continued be in a relationship with man accused of SA. And then 2 grandkids were living in the home with a suspected abuser ... this family is toxic. The only thing I disagree on - did Miranda really "consent" to have relations with Jimmy? She is an adult, so legally that appears so. But Jimmy had a position of power over Miranda. Further, if Miranda was abused as a child by Jimmy, she would continue to be vulnerable. Maybe had a trauma bond? Trapped in a cycle of abuse? Plus she was dependant on Jimmy for a place to live... I just don't see this as real consent. Thoughts?

Thank Goodness, you used the words “took down her pants” rather than ‘panties’: specifically in Australia the word panties is only ever used in a erotic context. It makes me nauseous as a survivor to hear the word just thrown around like it just means under garments or under wear or pants,. It’s great to hear you continue to grow and apply appropriate linguistics as you change and grow along with the times etc,. I love U - ha ha yes inappropriate

I agree that "panties" has erotic connotations. However, in the US, we say "pants" to mean the outer garment of the legs (aka trousers, slacks, dungarees, etc.) We usually say underwear or undies colloquially when referring to undergarments.

Possibly a case about a normal guy that got caught up in a toxic family and was in over his head. To him it was insanity, to the family, it was Tuesday. It sucks Jimmy was murdered in his own home like that. It didn’t have to happen. But at the same time it isn’t surprising given all the circumstances.

The family history is disturbing, it shows how far people fall when evil is present in their lives, and it isn't stamped out. Miranda did expose her stepfather but shut it down, probably because her mother opposed her. Her mother jnstead of protecting her, like her stepfather betrayed her. Miranda's work is indictative of unresolved childhood trauma. All exhibit shady behaviour and should be avoided, as they drag others down with them. This is the price they pay for accepting the situation and allowing it to continue. To stop these distractive patterns All of them need Jesus Christ in their lives, he is the one who can set them free and make them whole again.
