Daniel Perry was not defending himself. Jordan Neely did not assault anyone at the time of the shooting and Daniel Perry came up and attacked Jordan from behind. Furthermore even if Daniel had been acting in self defense, he chose to go beyond what was allowed by continuing to strangke Jordan even when Jordan was unconscious and no longer a threat.

Exactly right! Imagine the scene in NY City and the other big city cesspools when the SHTF. Anybody within a three day walking distance from a major city is in for a Mad Max situation. The average person will walk 10 miles per day. A good rule of thumb is to estimate 20 miles per day. Thus, if you are within 60 miles of a major metropolitan area when the SHTF you are in BIG trouble.

Being under the assumption the bigger guy is the 36 year old and the aggressor and armed with a gun and knife. The 32 year old seemed to be avoiding physical contact with the aggressor. The 32 year old apparently wound up defending himself by using the aggressor's gun and succeeded. This is where NYC also sucks at protecting citizens if "charges are pending" against a person defending himself is an accurate statement. Perhaps just an investigation to see if charges are warranted is more accurate I hope.
