I work as a Transport Officer for my local detention center and youd be absolutely stunned how infrequently there is any noticeable security for the attorneys and judge in these courtrooms if my team isnt present with detainees. Deputies rarely stand in, and the bailiffs are often civilians with no weapons or training, just glorified bouncers, except half are small women and the other half are old frail retired men. Its wholly inadequate for the safety of the legal professionals in these rooms. Yall need to have much better security at all times. Your roles are much too contentious to the accused and worse still for the condemned.

I've noticed similar in my rural courthouse. There might be 2-3 cops in the entire building, and one only sits at the door by the metal detector. Disputing parties sitting right there together. Judges sentencing people to bad things sitting there. In other words, people with a motive for violence. The cop in the actual court room kept coming and going, and was at least 375lbs. Anybody who had bad intentions could attack the judge or anyone else for a minute or two before "the" cop gets there so incredibly easy. And let's just say the guy at the metal detector isn't that hard to fool. I was there once to get a restraining order, and they told both parties to go wait in that same room where "maybe" a cop is. Another time I was there for required mediation during a lawsuit. They put me and the other party together, in a very small room, with one single woman employee present. Me and the other guy are both pretty big, and both wanted to attack each other. They thought we were going to work it out like children before having to actually do court. Obviously, if we made it to court, no, we're way past making things work, that's the point of court!

I live in Maryland. I worked in the Clerk's Office at the District Court here and it's much the same. the only actual cops present are there for the Prosecution as a witness so if it's not traffic court day, most days the only "security" present are the bailiffs who are retired cops who are too old to really be of any use against much younger and physically fit people. there was an episode with a female who was there to get a restraining order against her bf and she came to court intoxicated. the bailiff was being a smartass and the female decked him. she came in looking for a restraining order and left in handcuffs and sent to the detention center!!

For the calendar pages: I work for a judge, and all of the judges in our courthouse print out the calendar for the day and make notes. I know some of them also jot down ideas about sentencing factors ahead of time, and they might come up with a general range they're thinking of. But they also listen to what is said in court, and that can sway them one way or the other. So the notes are things they want to consider in their sentence or bring up on the record, but it's not decided until the end of the hearing. Any notes they take based on what the attorneys say can get jotted down there, too. I'm wondering if that's how this judge was using her calendar page.

From my work in Van Nuys Court in the 80s...I worked on a case in Civil Court against Los Angeles County where 5 years previous the Plaintiff was in Divorce Court with her soon to be ex-husband. The ex-husband had made numerous threats to the wife. During the hearing the bailiff, a LA County Sheriff's Deputy, was reading the newspaper and basically not paying attention. As the ex-husband and wife left the courtroom and walked into the hallway, the husband produced a knife and slit the wife's throat from ear to ear. An off duty LAPD officer apprehended the ex-husband while an attorney took his shirt off and stemmed the flow of blood, saving her life. The LA County Sheriff's Deputy stayed inside the courtroom and radioed for help. The wife sued LA County on the grounds she felt the bailiff should have stopped the assault. The reason I'm taking all this space to recount this case is that it came out that the courtroom and back hallways were under the purview of the LA County Sheriff, but once they exited the courtroom into the public hallways, it became LAPD's responsibility. Who knew? Sad facts: the attorney who was shirtless as he was saving the wife's life and the LAPD off-duty officer had both died prior to the trial; one dying in a car accident and the other passing from an illness.

This judge is a PINNACLE of the judiciary system for not changing his sentance - for physically assaulting her. What a symbol of grace. We all need to live life by this system. She knows punishment is coming his way down the line - but she isn't retaliating. PS - Bruce, I always agree with you but, you said something to the effect of 'oh this is problematic' - in my opinion only - nothing about her judgement from the prior hearing is problematic - because she had reviewed his history, and all of his domestic violence and felony assaults (and at least one of 10-15+ being on a protected class...) -- and he had never served a real prison sentence... (somehow...) (I mean shit, after the first time you beat a woman or an elderly person to the point of a conviction for assault - you deserve it in MY book. That's never a justifiable crime. Again, in my book...) But - she LAID OUT EXACTLY how she came to her judgment - WAY before he cleared a 3.5(?) foot vertical?? I mean shoot, Michal Jordan had a 48 inch / 4 foot vertical - which was a record... a judges bench is TALL!) That is beside the point though... (or rather, a separate one...) Nonetheless - I think this judge could have laid any punishment down on him - especially with the superfluous media coverage / support - and she chose to not. That's a decent person. I respect it. I don't know if I'd have the same grace if the world wasn't watching - if someone literally beat the shit out of me for no reason... (which is the standard of good character- in my book, again.) That's all. If I was a judge - I would absolutely do what she did. But - as an individual - in Texas - and as a woman - I would've taken his ass out - if I could. If you were acting as a defense attorney here - and - if she wasn't in a court - with people to help her / trained security / alarms etc - I truly believe that man could have EASILY killed her. He seems to have the strength/power to, at least. Mad respect for her for getting assaulted and coming right back to the bench. I bet she (Mary Kay? Ha.) has aspirations.....

They all do this, they look at all the factors before hand and decide a range and write it for each case on their calendar day so as they are working their way through all the cases for the day they refer to that and then also jot notes about what they hear in the courtroom that day and that determines which end of the range they decide on
@abasdarhon

Of course she can. The problem is more to do with optics and ethics since it can look like a CYA move when the judge gives him the maximum penalty for the original charges; the judge can then argue against claims that their sentence was retaliatory against the defendant for his subsequent behavior.

In this case it was justifiable for the judge to have made a ruling before arguments considering she would have made herself familiar with his repeated past criminal history and see he is in no way learning any lessons from his behaviour. Honestly, this kid is so unstable and unpredictable he should have to sit his ass in prison for a long time.

Don't judges often figure out and right down the sentence before hearing defense and prosecution arguments? Doesn't mean they can't change it based on what one or both of them say. I thought figuring out what the sentence will probably be -- everything else being equal -- was more of a time-saver than anything else.

I mean…how else will the sentence fit the crime. The protector some am for something high. The defence will ask for something ridiculously low. You can not just decide to be in the middle. They have to decide what THEY think is fair then if the defence or protector bring up a consideration they hadn’t thought of they can still change…But most of the time there is nothing new in the argument. Just pleas for mercy despite the facts from the defence

This guy's sister said that he was born addicted to crack. It was astonishing have quickly he went from calm to trying to kill the judge...and that vertical leap was amazing. Would that account for his behavior? I don't know. When my daughter was in the NICU as a micro-preemie, the little one next to her was not as early as my daughter. His nervous system was not fully developed. His own cry would upset him so much, he was unable to be comforted, or even calm himself. He had to be sedated every time he cried. It was horrible to witness a tiny baby hysterically crying because he had a wet diaper, or when he was changed. He couldn't tolerate touch or clothing. I couldn't imagine not being able to hold my baby. I felt guilty in the NICU. We knew my baby would be early, and prepared for it with steroid injections. She was so chill, still is. There was a crack baby in the unit. His responses were similar to the little one next to us. He shook violently, screamed when he cried, and no one there by his side. If it were not for our daughter and her unusual care, we would have welcomed that little one as well. Anyway, the defendent's sister told the press about his birth and being a crack baby. So sad what people do. This is why certain procedures should be legal.

8 years ago I was convicted of a DUI and I had several court appearances and I rembember always seeing two deputies standing there on each side of the bench all the time. This court was mostly for non violent crimes, mainly DUIs and probation violations and things like that. So when I saw this video the first time I thought where is security? this dude could have broken the lady judge's neck if her clerk didn't put his own body and safty on the line. I doubt that any parole board will let him free after 19 months, he will probably serve the full 48 months plus whatever time he will be sentenced afterwards for what he did this day.

I love when KZbinrs are describing the content of what they are viewing or reacting to since I cannot see any of it for myself, so I realize soling solely on my hearing. Please excuse any mistakes that might pop up in my commentary, I am using dictation, so on rare occasions, it will misinterpret something that I say. mental health professional here who works often with patients who present with significant legal issues- NO thats not mental illness- under this basic criteria- Regardless of the egregiousness of his actions- - what triggered him to act, although an overreaction- was observable. - His overreaction , although clearly destructive to his original goal, was purposeful to satisfy an immediate emotional need... Mental illness is when easily observable reality is conflicting with both the stimulous and course of action. To be impulsive and violent is not mental illness . Its indicative of any number of personality and mood disorders - and he would benefit from psychiatric medication like a strong mood stablizer ..but no this guy is Sane. All i wrote is arguably moot because i can see his further charges relect that of someone who knew right from wrong. This guy is being held accountable.
