And when her selective memory prevents her from answering questions, the judge should have the latitude to impose a rigorous mental evaluation to determine her competence to be a witness, hold a job, possess a drivers license, or live life outside an institution. Repeatedly claiming “I don’t recall” shouldn’t go unchecked, and a severe deterrent should be in place to curb the practice of using that as a convenient means to avoid answering questions. If you want to claim the 5th, then do it. But claiming you don’t recall should come with a price.

There is one problem, the AG needs to convince the entire jury to convict so if one person in the jury decides to disregard the evidence simply because they like the defendant, which is a lot of people, it doesn't matter how much damning evidence he has. I bet that the AG is dying to light these people up, but knows that he has a very real chance of not being able to simply because one person will vote with their political bias and, because of the law which prevents prosecutors from charging someone for the same crime twice, forever lose the chance to convict that person.

Yes but notice when the judge said "rephrase the question" the attorney pushed back, said he was entitled to ask his question the way he wanted, and the judge said okay. The judge knew his point was valid the witness can't be rewarded for being uncooperative.

This wasn’t even a question of specific facts relating to her memory of past actions. It’s a simple yes or no answer to a question on a simple matter of law and her understanding of it. The judge should have held her in contempt for not answering the question. She isn’t being asked about her actions specifically with this question, so she can’t even plead the 5th, she can be compelled to answer or held in contempt.

Administrative law judges aren’t regular judges. They’re lawyers with a JD. (Many states allow you to pass the bar and practice law with just a Masters degree.) And they aren’t immune from being too old mentally to do the job.
