Actors likeness is NOT included in film deals. Merchandising is a completely separate contract, and likeness rights are seperate from that as well. A toy company (in this example McFarlane) pays a licensing fee to DC for the characters, and then another fee to the movie studio. Then, they must obtain likeness rights from the actors themselves, which varies by actor. Some don’t want their likeness used, which is why we have a lot of figures that have never been realized. Some don’t care and simply give permission. But most demand payment for their likeness rights. It’s quite a process, and can be very costly.

11:40 neca sending out 2 of those diorama, the second one is basically counts as a gift, you have no right to send it back, and neca has no right to beg for them back. Like I'm curious how much it cost naked to produce one figure or diorama at their Factory versus how much they sell them for because it would blow my mind that if the diorama costs like maybe 10 bucks to produce, but sell them for 20 times the price. Neca can produce more, and they don't want to.

As someone who just started collecting DC Multiverse figures and lovin it. I dont know how to feel about the whole Joker and Murray two oack situation, the price is ridiculous. But NECA! Ive been collecting Neca figs for a long time and honestly Im very dissapointed and I dont know if I wanna buy there stuff anymore. A bit of an exaggeration I know but wow.... great video by the way

Neca is holding customers responsible for THEIR mistake. What they should do is take the loss, order additional product to make their customers whole, and overhaul their shipping department at the same time. If they go out of business because of it, oh well. Sometimes companies make mistakes they can't recover from. Their margins shouldn't be that thin and their money management should be properly handled so that one mistake doesn't doom the company, but that's also ultimately on them......

And one more note, movie rights and likeness rights are most of the time separate. For example that's why you haven't seen a McFarlane Jack Nicholson Joker yet. He's expensive, like Hot Toys level. But Lego, Funko can easily make the character, too generic figures, no likeness fees, they are only paying for DC/WB. Although in this case the parent company, WB put different conditions on the table. Todd i guess rolled with it, because the first movie was super successful. Well, the second... not so. Betting on Hollywood by the toy companies is a losing game these days.

It's the extreme poor handling of the situation by Neca which pisses collectors off. They would just laugh at the fuckup which the company made and some would send the diorama back, but to start with a threat, and then double down on it, taking almost no blame but putting on the customers, to leave hanging the ones who haven't receive it... shameful. Instead of the joke of the day they chose to become the bully of the year. And by the way the 100 credit is for TMNT items from their shop, not cash. Still, do the math. The 20 bucks label, the 100 credit, sending, receiving, handling, all have to be checked because they were sitting for weeks at private homes, but let's be generous and say one returned diorama would cost them only 150. And they would reship them as brand new. Not sure about the regulations. The molds, design, all done to make more. How much would a factory rerun cost to them? I don't see the huge difference between the two solutions moneywise, or how the future of the company would depend on the greedy costumers. They fucked it up, no matter how, it will cost to them. They just chose to eat it with adding a big ass reputational damage. Well done.

It’s not the consumers fault AT ALL but they will suffer regardless. Either NECA bleeds a bunch of money from the returns or they bleed it by going back into production. They will have to make the money back somehow or potentially lose the license in the future…

McF is transitioning to the high-end collectors demographic. It's going full Sideshow because they're losing the 7 inch action figure license next year. This is probably the last hurrah, checking the waters if collectors are willing pay for it.

Regarding the Mcfarlane Joker pricing. I have seen one other youtuber mention theory regarding minimal price for all Joker movie related toys. Even high-end figure producers (HotToys and Inarts (i think)) released the joker only in 2 packs and 4 packs. With price going closer to 500 or 1000 i think. It was also told that Joker movie director was very much against any kind of merch of his movie.
