Luckily in europe contracts work diffrently. All their Bullerpoints must point to the topic and cant be applied to anything of topic. So not be able to sue publicy would only apply to the Disney+ Stream and even though you can write everything you want into contracts it doesnt mean they apply im general. If their points are against the law in the first place. Like they cant deny you your right of justice. So you can sue them AS often and on every court AS you like. It actully is worse for them because If you set Up a contact that has points in it that are illegal in the first place, the whole contact is Not valid in the first place which means If the Disney plus user decides to call his bank and to get all his monthly paid checks Back by reverse Check. They are legaly allowed to and Disney cant do anything about it. Funny enough Disney knows this very well and in the German contracts that exact line of not be able to sue has a disclaimer that this only applys to people living in the US lol

One of the issues is that these companies are intertwined with, and own, so many other companies that boycotting Disney isn't enough. Disney can siphon off money from their subsidiary companies and continue whatever agenda they've decided to push for a long game. The entire system has to be addressed and unilaterally boycotted/exposed to really affect lasting and expedient change.

@@Cancoillotteman Europe largely leans on Continental Law, the US is Common Law. one of the reasons that Disney auto-refute liability is because it makes a hefty precedent for future potential suits. no company wants to open that box -- that's just capitalism. it would cost them a lot more than 50K (which isn't the real figure of the suit)

What is illegal in Europe is to have "tickboxes" regarding data protection where they make you accept terms in an "if you agree to this, then you also agree to that" kind of way. I.e. by agreeing to data handling terms through a tickbox, they can't say that now you have also agreed to getting targeted ads. I see a very similar discrepancy in Disney's case - but hey, all corporate giants are the same, Google does it (including KZbin), M$ does it (just by using Windows, they argue how you have agreed to all sorts of stuff)...

If you go parachuting, for example, there is a possibility of accident unrelated to the provider of the service, where they're not responsible, like a bird flying into the plane engine, but there should never be a possibility you being forbidden to sue if it was their fault, like parachute being faulty.

@@fearlesspotato3429I'm not sure what to think about the 40k live action on Amazon. On one hand, it'd be so freaking awesome to have a (true to lore) live action, high-budget 40k show. On the other hand, Rings of Power was (and is) absolute garbage, and they tarnished the name and work of an AMAZING author with their terribly written, poorly acted, and banal garbage. But considering how much money, for example, Deadpool & Wolverine and Black Myth: Wukong made, I believe we may be looking at a real cultural shift when it comes to Hollywood away from the wºke and dɛi stuff. It doesn't mean that they want it, but it does mean the shareholders may demand it for the $$. So it truly could go either way. I just hope and pray to the God Emperor that they don't destroy 40k, and sadly, if the show is made, I'd say it's more likely than not that they will. Hopefully Henry Cavill can stand up to the mob and keep it legit. We'll see.

A few months ago I went on a purge of everything Disney. I canceled subscriptions to anything and everything Disney-connected, too. I won't put up with their ceaseless price-gouging and sharp practices. ------ Upon examination.. I discovered they had nothing to offer worth my attention. If I want to watch a Disney Classic, I can buy a DVD at a yard sale. My purge is painless.... I lose nothing... they have nothing to offer any more. ------ When my National Geographic came up for renewal and I saw Disney in the mix... I cancelled it. I now knew why so much NatGeo content was over-produced trash. That was the catalyst for my purge of Disney. ------- Disney is low class, low talent, con artists trying to trade on the talent of long-dead cartoonists. They really haven't produced anything but derivative drivel for fifty years. The only thing they ever had to offer was the product that Walt and crew created. The rest is junk.... we get to see parody of classic Disney... weak imitation by mediocre talents. ------- Or so it seems to me with seven decade wide experience to draw upon.

I believe it's because if they know of even one use of copyrighted material and don't challenge it, they leave real infringers with an argument in court that may allow them to get away with a major infringement. Can’t recall the exact mechanics of it right now and I'm not looking all that carp up again. Don't make the mistake of informing them in such tiny circumstances because they have to act. Lawyers are just as much to blame as the corporations.

I don't have cable tv at all, so babysitting my grandsons can be challenging (5 years and 7 years). I hit on the idea of showing them some silent movies, they weren't impressed at first, until I put on Buster Keaton's The General and Harold Lloyds Safety Last. The 7 year old was fascinated when I explained Keaton and Lloyd did most of their own stunts. The 5 year old laughed his head off at Laurel and Hardy. The 7 year old wanted to know more, so we watched a documentary about Keaton that evening. I don't know how long the interest will last, but I have hope for the 7 year old.

It's more like you need *several* lawyers... *each* of whom will probably give you multiple opinions. Just a reminder that every case that goes to court has two different lawyers with two different opinions... at minimum. The judge might even have a third opinion of his/her own... such as the judge who decided that no one in their right mind could believe what a certain news presenter said she literally meant... literally.

Part of me have been wondering if this might actually be a good use case for AI: Read through legalese and translate it into normal folk speak, with special emphasis on the ways it would screw you over if you signed or agreed to it. Normally I'm on the fence with AI since most of the time it just seems to not add any actual value, but I also hate reading through formal documents, so that might be something I could consider. Problem is, then I would have to trust it not to hallucinate, so idk if it would actually work.

I was raised Pentecostal, I was an '80's kid, loved everything Disney/ Star Wars. I went to Disney World in '89 to All 3 Theme Parks, with special passes to go to the front of the line , so I wouldn't wait for rides...I had cancer and that was my wish. My True Wish is that no kid ever had to go through cancer. I only cherished going to Florida with my Mom & Aunt, time spent. I hate Anything Disney...No Christian should support it. I feel brainwashed by the school system, it was All about Disney & NASA, and PTA Propaganda. Keep Playing, we are living in such evil times, everything entertainment related is 99% wicked. I’ve written on other videos about this topic: upon getting the notice that the man wanted only $50,000 for the wrongful death of his wife, Disney could have easily written him the cheque, then had him sign a no-fault agreement and an NDA, and probably saved money. They could probably have even spun the situation by “generously” giving him a couple thousand more, unlimited Disney world tickets, and making a statement about how it was an unfortunate tragedy but that Disney cared for it’s customers.

Note: they aren't seeking only 50k. 50k is just the minimum amount needed in Florida to get your case in circuit court. They don't need to state their total claim at the start, only say they are seeking damages in excess of 50k, which they did. Either way, it's still despicable of Disney

Yeah I heard a story when I was younger that really helped make my mind up. A preschool in I think Florida painted a mural on their wall of Disney characters, somehow Disney caught word and proceeded to file a lawsuit against the preschool, the school was forced to paint over it but Hannah Barbera allowed the school to use all their characters and saved the day.

Something I like about Norwegian law is that you cannot sign away your rights. Apple tried this by offering a reduced warranty compared with what was mandated in Norwegian law. They argued that people had agreed to the reduced warranty in the user agreement, but the Norwegian justice system said very clearly that right guaranteed by law cannot be signed away. This is how it should be in all countries really. That your rights as guaranteed by law cannot be taken away by any agreement, regardless if you signed it or not. This is highly relevant in this case where Disney claims that all disputed have to be settle in arbitration rather than court due to a user agreement. If US law was like Norwegian law, then such a clause would be meaningless. On a different note, I agree regarding the race swapping of characters. There are interesting mythologies and traditional stories everywhere that can be used as inspiration. This idea that European fairytales are somehow superior is strange to me. Heck, fairytales can be very different across Europe as well, you can't really put them all into a single category, and it's the same with the fairytales from any other continent, or any other thing one wants to compare between places. No continent, no people is truly homogenous.

I'm annoyed by that aspect as well. You can't just dump all "white people" into a box and say that they're all the same. They're not. I would be fairly confident in saying that Romanians probably do not see themselves as being the same as the English or French. Heck, even here in the U.S. there are cultural groups. We're all the same country, but white people living in the rural South are NOT the same as white people living in Brooklyn. It's a very different lived experience.

Couple of things. The suit is not for $50,000. This is a misunderstanding of the law. The suit is for in excess of $50,000. The filing requires this information so the suit can be routed to the proper Court. Based on her age and career, and her human life value, the suit will be well over $10 million, just for replacement of wages. Add negligence and loss of companionship and the suit will likely be in excess of $100 million.

Imagine if Disney had come forward and apologized, and offered to help, and to set up safeguards to prevent this tragedy from happening again. Doesn’t matter if it was employees who screwed up because the company is ultimately responsible *and liable* for training and putting practices in place to prevent this kind of thing. The basis of the legal maneuver is the attempt to extend the requirement for arbitration from the streaming service to *all* dealings the customer may have with Disney. It is about as sleazy as anything any lawyer has ever thought up. This kind of thing is why Shakespeare had one of his characters say “the first thing we do, let’s kill all the lawyers” in his play Henry VI.

Not only is this utterly heartless (not to mention utterly horrible corporate optics), but it also carries a very dangerous risk of setting a legal precedent that would allow companies to remove any responsibility for their actions by worming this clause into their fine print. This is something that the mega corporations have been trying to steer the ship towards for decades and it frankly wouldn’t surprise me if Disney was deliberately trying it’s luck here to set that very precedent for future cases.

As a lawyer I should point out that this is INVALID in Europe. So even if your Disney+ ToS has any such terms, they're null and void since criminal liability can NOT be wavered away by any private agreement (and what the Restaurant here can be charged with is neglectful murder). I'm not as well versed in American Law HOWEVER I find it extremely implausible that such isn't true for the US as well. Otherwise, in extremis, you could actually bring back murder as long as there was a private agreement. As for Disney... I've long stopped giving them money. And in memory of Walt and his legacy - both of which are admirable - I've stopped calling them "Disney" but rather "The Bob Iger Company", 'cause this turn to evil corporate politically-charged company only happened under his charge.

In regards to the skin color of a mermaid: as a diver, once you get around 40 feet down, it starts getting dark pretty quick, and about 60 feet down you need a flashlight to get good pictures, as everything becomes almost monochromatic blue. If memory serves, 2-3 feet of water cut down UV exposure by about 60%, and the further down you go, it attenuates into the visible spectrum, hence the monochromatic blue you see when you dive. If there was a humanoid creature that lived exclusively in the ocean, and spent most of their time under 60 feet, their skin would be pretty pale, as they’re not receiving nearly as much UV exposure as you are on the surface.

I study food-manufacturing at a vocational college, and 90% of our studies comprise of preparing dishes, at school, or during internships, and they really drive home this point of severity of allergies and allergenic cross-contaminations (also including non-allergic intolerances, like the coeliac disease). But one thing that baffles me is the EU-list (leave it for the EU to make the most non-sensical directives, standards, lists, etc. possible) of allergens to be highlighted, in the list of ingredients, including rare allergens, like soy; but excluding more common and/or well-known allergens, such as citrus fruit and tomatoes. 🤯

Disney Springs is a shopping area that is owned by Disney but has businesses within that may not be. Those businesses have to abide by whatever rules/standards Disney has for them. I think the lawsuit claim is that Disney had standards that the restaurant was supposed to abide by but didn't, and the claim, i think, is that disney didn't enforce those standards.

While I don't want to automatically jump to the corporations' defense, I have heard some cases that left me thinking people were really tempting fate. (I should point out, with nut allergies being so common, I'm not claiming the case in this video is one of them). A few years ago it was in the news that a 14 year old boy died from a milk allergy at an IHOP. The family realized that he forgot his epipen before they went into the restaurant. I don't want to victim blame, but it was IHOP, a restaurant where almost EVERYTHING contains dairy. Yeah, the restaurant screwed up, but talk about living dangerously.

i know how you feel. i used to work in a Planters production facility and whenever we would get a tourist that was allergic to nuts, we would make sure and give them gloves and a mask. you can never be too safe!

Here’s the kicker. He wasn’t with her when she suffered the attack 45 minutes later (that was at least when she was found in another pet of the park by a stranger) and by the time he made it to the hospital she was gone.

A bystander was helping her and answered her phone when he called but she had already been taken to the hospital and by the time he got there she was already gone.

Amazing Story. By the way, $50,000 is a lot but certainly not a huge dollar amount, for a Wrongful Death. Thirty years ago in '95, at a restaurant, a tray of glasses was dropped on my hand, with several cuts that needed stitches. They (a Chain) settled for $4,000 and seemed genuinely concerned. I healed and had no long-term negative effects. Ironically happened in my home city of Orlando.... also the home of Disney.

As someone with an autoimmune disorder triggered by certain foods, this is literally a recurring nightmare. Not at all helped by the times people argue that you're "not really allergic" to the thing you think you can't eat, or the food service employees who laugh on social media about intentionally cross-contaminating or outright swapping foods because they find people with allergies annoying and/or don't believe that they have it/that it's that serious, or the people who genuinely think allergies and other food intolerances aren't a big deal because you can just pop an EpiPen or something. Cutting corners with food safety is so far from okay.

Last year I took a flight in Europe, at the last min. we were told a passenger has a nut allergy, the menu will be changed and no passenger will be allowed to board the flight with any chocolates or sweets. Annoying, but I think we all understood the seriousness of the situation.

The lawsuit is for an unspecified amount of money more than $50 K. That is the MINIMUM amount. That is written into the lawsuit in order to get it on the court docket. If it is not above $50K it goes to small claims court.

Kimba the White Lion scandal was enough to convince me of Disney being evil. Not even a nod or recognition for source that inspired the Lion King. Worse going after the original studio for trying to release Kimba the White Lion movie a few years later. Even The Simpsons took a shot at Disney over it.

@@bluesh0es Yes I've seen the YMS video on this subject. It isn't convincing. It really addresses mostly the post surge of videos posted about 4-5 years ago with cookie cutter arguments, and presenting clips from the Kimba the White Lion film which came out a few years after The Lion King which sadly dominate the Lion King vs Kimba the White Lion YT videos, I miss being able to find the older ones prior to that. Basically YMS addresses nonsense videos and sadly better older videos are harder to find. 1. It ignores the original working title for The Lion King was The King of the Jungle which was very similar to the english translation of Japanese title for Kimba which was The Jungle King. Mind you at the time that wasn't the english title used so if Disney translated the original Japanese title themselves it could very well came out as The King of the Jungle. Again someone can call this a coincidence but there are a lot of coincidences. 2. Disney tried but failed to acquire the localization rights to Kimba the White Lion during production of The Lion King, and since also sued over the Kimba the White Lion movie coming to the states just a few years later. Why would Disney care? If they were not similar, and were unique? Unless they knew, and had reasons to care behind the scenes. Heck when they went after the Kimba the White Lion film, it actually helped fuel the conspiracy more. It was a stupid PR move, but Disney found it necessary. 3. He doesn't address even that some of the Disney staff some of which since redacted their claims (because well Disney), that they believed at one point in production they were working on a Kimba the White Lion adaptation. Even the Co-Producer admitted the similarities are undeniable in recent years but then claims they had no prior knowledge to it even existing. Sadly it's hard to find videos of those interviews all these years later.. I've not been able to find them in recent years. So either they're lost on the platform or they were false claimed and removed. 4. Story differences are irrelevant. I don't even know why this is an argument. Likely something some people tried to claim a few years back. But I don't know anyone at least during the 90s who were claiming Disney ripped off Kimba the White Lion's story. Maybe a few scenes, but not the story itself. Why that became an argument still baffles me. 5. The fact Kimba the White Lion literally had "Scar" in the original production not the same name or character, but visually an identical character right down to the choice of colors and body features. YMS addresses this but there is good enough reason to accept that it isn't just a coincidence. 6. Simba/Kimba the names were both chosen for the same reason because it's tie in to the word lion in Swahili Disney just took it more directly. Again like Scar you can argue the similarities are only a coincidence, but I've seen enough evidence in my opinion that states otherwise. Disney knew, didn't care not after point #2. Final Statement. I don't think Disney ripped off Kimba the White Lion per se. I'm more annoyed how they've acted/handled the whole situation. it would have been a huge PR win in my opinion if they'd just admitted it at the time, people like when their favorite productions/films/TV/comics are inspiration, and it's actually all Tezuka Productions wanted and honestly why I think they mimicked many scenes from Lion King out of spite in their own film. But I really think they're adamant on preserving that "Original Production" marketing they built around the film. When nothing they've made has been well "Original" they even admit the story is from Hamlet. We know they've also done the same thing with the Theft and the Cobbler, it inspired Aladdin but Disney will never admit it. But being The Theft and the Cobbler was never really a finished film and I think for a time Disney even owned the film. You can easily argue they didn't exactly steal or rip off something they already owned?

Titled "A ‘Kimba’ Surprise for Disney : Movies: ‘The Lion King’ is a hit, but reported similarities to the Japanese-created American cartoon of the ‘60s are raising some questions." It even talks about a lot of other similarities. Mind you this is years before the The Jungle King (Emperor) movie and a decade before KZbin.

If this is the story I read, that's not quite right. The boy died of cancer and loved Spiderman, and so the father wanted to put Spiderman on his tombstone but was told he had to ask Disney for permission and they refused to grant permission because they didn't want their brand associated with death or something like that. But Disney did threaten to sue a daycare for showing one of their cartoons without a license.

I wonder if Disney would use this "loophole" if one of their tourisists gets killed on a ride that malfunctions or one one of their theme park employees acted inappropriately? As a lawyer in the US, I am hundred percent sure that this Disney+ maneuver was not invented by Disney, but by the heartless big law firm that represents Disney. In these kind of cases, the big law firm that is paid millions of dollars does not go to the client to discuss the strategy. The law firm will do whatever they can, even if it is the most immoral thing you’ve ever seen, to have the lawsuit thrown out.

This isn't a fly-by-night one-of deal. This legal team has worked for Disney for years if not decades.

Now top guy knows about it because of negative international coverage. I have negative opinions of Disney and Corporate governance. I have had American contracts that say; you cannot sue for any reason, even if we are negligent cause damage or harm; but if you say or do anything that can be considered negative towards our company, then no amount of money can compensate our loss. ps. you are not allowed to mention this to anybody. Basically the problem is corporations can hide behind contracts and NDA's. Disney took that option because legally in the US they can (no other country would accept such a contract as defence of wrong doing or negligence).
